Bought some AG on Ebay now the seller says listing price was an "error" What to do?

Help please...

I bought some mint sets on E bay yesterday on a BUY IT NOW.
The listing looked pretty old as it had silver priced at about $30/oz.

I bought it and w/in an hr. got an E mail saying"Sorry... Listing error".

I wrote back and basically said that weeks ago when you put up the listing it was priced at market and was his resp. as seller to update listing. He has 1,000's of feedbacks.

He said basically was refunding $. Tough

I said that if silver dropped after I bought, would he make me buy?

I have not heard back and he has not refunded my $

I then suggested that ok... maybe he did make error.

With all going on in world how about he agrees to make a donation to charlty(his choice), I'll drop claim...

No response... No refund...

    If it's an older listing, based on silver performance, I would call it a seller error. Seller failed to adjust his BIN price accordingly as silver price moved up. In a buy it now with no bids, seller is free to make revision except within 12 hrs. of auction ending. With this type error I would reflect my feelings in the feedback I provided. A listing error in BIN price is obvious and should not be held against a seller. Sounds like you have an understandable yet inexcusable seller error that is a result of the seller not staying on top of his markets.

    In addition your feedback for the seller, seller will probably send you a request through ebay system to cancel the transaction. This will enable him to recover his ebay fees. Choice is yours and should never be "yes" before receiving a refund.

    It all boils down to what you feel was the right thing for the seller to do.

  • Thank you... Interestingly enough, he has NOT sent out a request to cancel the "trade"?
    I'll wait another day or so then contact ebay...

    You won't have a claim as far as ebay is concerned. Why any buyer would think a seller "has" to sell them something for a price that is obviously wrong is beyond me.

    I wouldn't have said that- eBay could consider it some sort of extortion. But then, that's just me...

    The other day a seller had a BIN of $1k for a UHR. I'm sure that was a mistake also. Move on & forget about it.

    I disagree with all reply's but I'm not a professional eBayer either.

    If seller did not refund $$ instantly I'd be calling eBay & raising T-total cain!!!

    If the seller can't keep up with they listings how is buyer at fault?

    12 hour~Oops I made a boo boo is ample time for seller error to be corrected.

    This is why our country is falling apart total unaccountability for ones actions.

    I agree. I can understand seller error, such as listing a buy it now at $100.00 when it should be $10000, but this was just poor management by the seller. I bet he was thrilled that the auction sold, and then he decided to check silver prices one more time and couldn't believe it went up so much. The seller should deliver the product. He hasn't even given a refund yet. I bet he has already spent your money and has no way to refund you. I would be on the phone to ebay immediately. I would dispute this auction with ebay as soon as is allowed. I would not give this seller any more chances.

    Seller does not have to honor the sale unless you win in court. You cannot deny his refund. Once he has refunded, the transaction has been completed. Only thing left is feedback and an optional request from the seller to "officially" cancel the transaction so that he can get his fees back. Buyer does not have to agree to the cancellation and any claim made by buyer (if it can even be filed after a refund has been made) will be found in favor of seller because of the refund. If he hasn't refunded, I'd request he do so immediately. If he doesn't, I'd get the clock started soon with a claim. Once you file a claim it will take a while to get your money back and it will hold his paypal funds. In this case quick refund is best for both parties.

    Also, keep in mind ebay will read all messages between the two of you. Don't say anything you might later regret.

    It's not the buyer's fault. But there's nothing the buyer can do about it, aside from leaving negative feedback.

    Which is more than sellers can do with non-paying bidders.
  • I called Ebay... This seller has re listed item exactly the same way with increase in price.
    I figure at this point .... No refund from him, no answer about the donation to his charity for a fraction of the cost of item. Ebay says they will get item for me... We'll see... Stay tuned... Oh... BTW... Listing was put up on April 2, 2011. He had plenty of time to amend listing...

    I'm not defending the seller, but it is no more possible to force a seller to sell than a buyer to buy, if they choose not to.

    I am just amazed that this seller with 1,000's of 100% feedbacks acts this way...

    I thought that I gave him an "easy out"... He relists item a day later at a new price w/o refunding my $. That takes Bxxxs!

    Neg him ASAP. When eBay emails you if you agreed to cancel the transaction, say "NO!" At a minimum, he will have to pay the final valuation fee. Let us know what happens.

  • This is the 1st time in 8 years that a seller re negged...

    I want to flush this out w/Ebay and this guy... Flush I guess is the right term.
    Will keep you posted. Ebay said that they would close down his listing... Let's see what they do?

  • Seems to be happening a bit (selling below spot) if one can find it. I just spent about 2 hours last night buying about 60 different silver world coins from a local site. Seller had been having a 20% off sale and with the recent increase in silver prices it had pushed a lot of coins to below spot, luckily from my collecting area. As a seller I probably wouldn't mind too much, the coins are selling and at a price above what he would have got a couple weeks ago.

    There are bargins to be had, just need to find them.

    i had a similar problem.
    i bid on the coin, early.
    paid for the coin.
    2 days after, i got an email stating it had already been sold...

    all i could do was leave a negative over it.

    If you haven't negged him yet, do it immediately. Your neg may have an affect on him selling the relisted item.
