More Ebay crap/dilemma and what to do suggestions welcome?

I am the seller . Quick rundown of transaction.
Auction ended: 2-20-11 sold for $36.10
item: paid for 2-22-11
item: shipped: 2-23-11 with tracking #
item delivered to P.O. Box : according to usps website 2-25-11 10:18 AM (done deal right) NOT

3-10-11 : receive email through ebay: "Hello dear friend; just to let you know that as today I haven't receive my item yet. Thanks"

3-11-11: I respond "Hello M*****, please check through your mail because according to usps tracking
#0309 2880 0000 6340 3xxx this is what the usps.com website shows that your item was delivered to you on 2-25-11. Please advise Best Regards Michael" with Detailed Results: Delivered, February 25, 2011, 10:18 am, SANTA ANA, CA ***** ect ect.

3-15-11: I receive: Case # 5007912**** is now open - please respond
3-15-11: I respond: "Hello, responded to the buyer on March 11, 2011 with tracking number showing the item had been delivered. Received no response until the buyer opened the case against me. Michael "

3-17-11 Received this email from buyer through ebay not the claim department :
" I've been waiting for this item and yes it shows that it was delivered; however, never got into my hands and what it possible happened item most likely was misplaced in a different PO Box number. Is it a way to resolve this case with ebay ???"

info on buyer newbie been on ebay since 12-02-10 total feedback bought 50 items sold 45 items with 1 negative (accused of selling fake item). 98.7 % rating .

Now what would you do?
1. let it escalate and let the Ebaybots decide,
2. offer 50% refund and cuss at the mailman.
3. offer a full refund and forget it . and cuss at the mailman .
4. tell the buyer to pound sand because I did everything I was suppose to do (and think he is lying or just an airhead).
5. Call the guy on the phone and see if I can tell if he is telling the truth.
6. send a email and tell him to break into the other P.O. boxes to look for his item.

The reason I ask, have heard of sellers losing this kind of claim because of it being a P.O. Box & still getting a negative, guess I already have a strike against me since it is an opened ebay case under the new rules for power sellers. Probably will get a negative anyway unless I give this buyer a full refund. also if I do let it go to the E-bots and lose do I then put a disclaimer in my listings stating I absolutely don't ship to P.O. boxes. I have shipped 3,725 items over the last 5 years on ebay: 2 items damaged, 1 item returned, Zero items lost, except for the scam artist about 3 years ago claiming he didn't get his item but was Narued the same day after providing tracking # ( claimed he didn't receive like 57 items over a 2 week spending spree).

    PO Boxes always make me nervous as sometimes the PO does put the stuff in the wrong box. Same with apartments that have a community box. At that point, you have to count on the honesty of whoever does get it to return it to the PO.

    Tough call - what kind of feedback has he left others so far? What kind of items has he bought?

    You shouldn't lose the case if you decide to let it escalate but who the hell knows with Ebay nowadays

    That stinks too, because I have a PO Box, and while they usually get it right, sometimes they have put my items at another persons PO Box. Two of us at the Post Office collect baseball cards, so mine have wound up in someone elses box, and a couple of times, his have wound up in my box.

    There's your answer. You'll win an ebay case, for item not delivered. If he had went the SNAD route he would have won sending you back a small rock or some junk mail.

    Consider yourself lucky then. I have had a PO Box five years and, as stated earlier, have gotten other peoples cards and had my cards misdelivered to someone elses box. It happens....

    I would:

    Let the dispute escalate to a claim.

    Enter the DC# in the EBAY/PP claim form.

    Have NO further written/oral communication with the "buyer."

    ..............

    Under NO circumstances would I contemplate issuing ANY refund.

    If you lose the claim, file an appeal.

    That gang is totally out of control and has allowed SCAMMING
    "buyers" to RUIN the venue.

  • Had the same thing happen recently to me. Buyer filed a claim without contacting me. DC showed his cards were delivered. I escalated it to a claim and won. Buyer then stopped his credit card payment so Paypal opened another case with me. Again escalated it showing the DC number and the fact that it was delivered, won the second case too. What gets me is that in my case and yours the buyer (if even telling the truth) should be going after the PO, not the seller. IMO do not offer any kind of refund, you did everything right.
    From what I can tell, 707 is the DOLLAR STORE compared to deans_cards. For what that guy charges, if I ever bought anything from him I would expect it to be delivered to me in a frickin' limo.

  • You have done everything correctly and have the proof to back you up. At this point I would not do anything except follow the procedures and if the buyer contacts you, be polite but steadfast that you are out of the loop. He should be pusuing this through his post office if something really happened.

    Recently had the same thing happen to me. The buyer opened a case with ebay/pp, it was decided in my favor once I provided delivery confirmation. The buyer left neutral feedback and ebay has yet to remove it. I blocked the buyer of course.

    So let me get this straight: Because the Post Office may mix up PO Boxes, ebay should rule in favor of the buyer?
  • Latest BS: The buyer is now trying to claim I sent it to the wrong address because of what the usps.com says it was out for delivery 92711 but shows it was delivered to 92735. I told ebay the sorting center is 92711 but the item was mailed to 92735-0986.
    I will out this great ebayer after this matter is settled, as I am pretty convinced with some of his emails and lack of the English language, he is just pulling a scam or wanting a partial refund. Oh well I feel a Neg coming my way.

    Hopefully if he is being honest, the buyer will still get his money back from eBay.

    In all the years I have been buying things from eBay (although that seems to be coming to an end) only once did I not receive an item. I waited for 2 weeks for the item to be delivered from New York, a grand total of 90 miles away. When I did not receive it I asked the seller if he shipped it, or did he have tracking info. Well, he actually did. And it showed that it had been delivered a week and a half ago. However, I really did not have the item. So I asked for a refund, and he said no, he did everything he was supposed to. My response was SO DID I! I did nothing wrong. I ordered an item that never showed up in my mailbox. I called eBay and complained, and they refunded my money. It did not come from the seller, but from eBay.

    I hope the the buyer can get a fair deal in this situation as well.

    When I first got big into Ebay, I seriously considered a PO Box just for that stuff, but quickly realized how many packages would go INR.

    Playing ebay's game, you did your part.

    Under no circumstances issue a refund.

    Block bidder

    Your either getting a neg or not regardless of how you handle the situation. Better to get a neg and have the money than get one and be out the money and card.

    Misdelivery happens with houses as well as P.O. Boxes. My parents routinely get mail for someone living at the same number on an entirely different street (same first word, different rest of the words) as well as getting mail for their nextdoor neighbors and for others on their block.

    I got hurt by P.O. Box misdelivery once - 2 packages, including a '40 Play Ball Manush PSA 5, were supposedly delivered to me on the same day that I got mail for the box below me.

    If the item wasn't worth insuring, the buyer should just eat the loss and give his post office grief.
