Question on Paypal Dispute?

I won a ebay auction just a little over a month ago from a seller. I am going to open a paypal dispute for the item. He stated in the auction that for anything over $25 he would send it priority mail which he charged me shipping for. He states he will not be giving me a refund because he is not responsible for lost packages but rather I am responsible for the package.
Has anyone been thru the paypal dispute process before and can share it with me? Also, do I need to open a dispute thru ebay as well?
The item was a little 5 gram silver bar. Argor Chiasso.

If there is NO record of it being delivered you will get your $ back. Takes a few weeks.
If I am not mistaken, even if you start with eBay you will finish with PayPal.
If the trk# doesn't show "delivered" you shouldn't have any problem.
It's just a matter of few days, couple of weeks.

Open your dispute on eBay (Item not received...they will handle it automatically for you & after 7 days if the seller does not respond eBay will escalate the case to customer support & refund will be issued)
I have had three sellers of gold generate a shipping label, so a tracking number is generated. The item never appears at the post office. I received a full refund all three times. The biggest problem with when the seller goes through the effort of making a label is it slows down the refund time.

Actually that occurs very infrequently and is overblown. Do you stop driving your car because 33,000 people died in Car Accidents? Same scenario with eBay...With millions of transactions you can expect for some to go sour. Post Office looses mail, do you stop using the mail?

Read the WHOLE story: Paypal will reimburse the buyer not only the cost of the item but the shipping he paid as well! In many cases, the buyer can also make a phone call to paypal a few days after opening the dispute and get the refund taken care of right over the phone. Oh what a horror story for this poor buyer! Paypal sure slapped it to him!
Paypal is a good insurance policy that protects buyers and sellers from theives. If you have a better on-line shopping insurance policy please provide a link. I paid over $4k in paypal fees last year and their buyer and seller protection saved me from losing much more than that from scamming buyers and sellers. The crying over paypal usually comes from people that lost money by not adhering to paypal protection rules.
To the OP: Paypal considers the coin the property of the seller until seller can provide on-line proof of delivery. Insurance protects sellers, not buyers. Open the dispute with paypal, they are the ones controlling the money. Do it from the resolution center in paypal. Be brief, polite and honest. Keep in mind that they have access to all details and messages associated with the transaction.

Scamming has recently seen a dramatic increase with gold bullion coin sales. A matter of time before ebay addresses it with some changes. Paypal has taken a beating over buyer protection with gold bullion. Their past change to temporarily hold funds of sellers with less than 100 feeback as a seller doesn't seem to have stopped the increase in scamming. I had four ebay gold purchases in the last two months turn out to be non-shipment. Paypal buyer protection came through for me in all four cases.

Mine were all more than 9 months to year ago.
