Ebay buyer does not want a refund!!

I sold a raw 1962 Topps Mickey Mantle #200 for $62 + shipping. The card was O/C and had 3 dark stains on the back corners. Upon receiving the card the buyer informs me that the card is warped due to moisture damaged. I told him to send the card back for a full refund and he responded by saying that is not an option nor is it fair and reasonable. What the heck can I do?

Copies of all e-mails.

(Him)Unmentioned in your description and also in your response to my email concerns, was the fact that the cards is warped from moisture exposure. We need to make an adjustment on the card. Please let me know what you think might be fair and reasonable given the warped condition of the card. Thanks, Jim (humphrey7)

    This is his attempt to extort a partial refund from you, if it was me there is no way I would give in - even with the possible negative that may come.

    Can you say Extortion!!!!! You need to contact E-Bay ASAP...........even though it won't do you one bit of good, but at least you'll feel better and have performed your CYA.
    Bottom line is a Neg no matter what you do at this point.

    Completely agreed. He wants to keep the card, and also wants you to give him some money to make him go away.

    If he is not happy with the card, why does he want to keep it? Ask him that.

    I just got off the phone with "Amanda" from E-bay. They have sided with me on this one. She said that she marked on my account that if he files a claim that he must return the card for a full refund. She agreed that is it a clear attempt to bully me around and extort money from me. We will see how this plays out in the next few hours.

    Was the card truly warped from previous moisture damage?

    Or was it simply bowed?


    I love these guys who claim a full refund is unreasonable.

    Make sure you reply to his negative in the place provided, it is the only thing sellers can do.

    Most of these were left for 99 cent lots, advertised as EX, VG, etc., and the seller has no other complaints. Looks like he is a real piece of work, he's been on my BBL since post one of this thread.

    After getting off the phone with Ebay I sent him this message:

    Dear humphrey7,

    Jim,

    I just got off the phone with Amanda (ID 16321)
    from Ebay. I discussed with her what the best
    option is and she informed me to stand by my full
    refund offer. So my offer still stands. Please
    send the card back for a full refund.

    and this is what I get in response (he brings up the point that my shipping method was wrong - I mailed it in a First Class bubble mailer with Delivery Confirmation plus the card was in a 4-screw holder. When listing the auction I must have missed where it said Priority Mail Flat Rate Box)

    If I were you, I would not be communicating with the buyer directly anymore after that last message. Either he can return the card to you and get his refund, or he can keep the card.

    Like Neil said earlier, unfortunately you're probably getting a neg from this guy no matter what. Might as well keep it simple.

    Get another 3-4 people like him in your next 1000 or so auctions...and you lose.
    Collecting PSA graded Steve Young, Marcus Allen, Bret Saberhagen and 1980s Topps Cards.
    Raw: Tony Gonzalez (low #'d cards, and especially 1/1's) and Steve Young.

    hope this works out for you, this guy obviously plays this game a lot, Ebay stays away from changing feedback but maybe you have a case if he is acting fraudulently...

    just tell him, it's a graded card and to take it up with SCG or send the card back for a refund. or at best offer a 3.00 refund to basiclly give him free shipping. otherwise tell him to pound sand. this is why sellers should be able to neg buyers. thanks fleebay

    I would like to know who can send a large flat rate priority mail parcel for 4.00?

    It was an obvious mistake.

    Maybe he should have clarified that before bidding?

    Guy should be the next DBOTW.

    I would NOT email or reply to him any longer.


    I'd block him, and I'd only reply to his neg that you are going to get no matter what you do

    short of giving in to his demands.

    I've never had anyone complain like this before. I guess if a refund for returning the card isn't good enough, the card must be good enough to keep.

    Just don't respond to him, unless he emails you after taking his medicine. He has some mental issues.

    Last time I told an Ebayer to send a card back, he kept the card and returned me an empty slab with signature confirmation....be careful!

    Well, no resolution to this issue as of tonight. I will wait for him to neg me or start the claims process and we will see where that takes us. What makes me upset is that I was patient enough to wait for him to pay. His excuse was that he was at his son's baseball tournament. Well anyway I hope to put this past me and move on. Life is to short to hold on to anger and it is a charge against his morality, not mine.

    just make sure to open the package he sends you back in front of a postal worker, because looking at the feedback he leaves and his attitude and comments plus his experience (11yrs on ebay) he probably knows all the tricks and all the rules of ebay.

    when September comes and ebay adds more rules to hinder the sellers more, buyers like this will only get worse.

    wish ebay would start allowing sellers to neg buyers again, especially clowns like this.

    Was this that new game used snot card? I would think the moisture would damage the card. Perhaps this was the card he was really saying was damaged since he did say moisture damage

    Well I am happy to say that as of Monday night this issue has been resolved. I logged onto my Ebay account and see that he has left me positive feedback!! I think I am going to wait a couple of days to return the favor! No other messages have been exchanged, maybe he had a change of heart or realized that he was messing with the wrong person. I am just glad to put this behind me.

    this is the type of ebayer that none of us need. trys blackmail and if that doesn't work ( oh . ok I will keep it) , screw buyers like this JMHO,
