    You're an idiot and your payment terms are outrageous. I set snipes and check ebay every two or three days like most other well-adjusted people who have work schedules. Please block me from all your auctions just in case I might accidentally bid on them.

    If that message was sent through the EBAY system, it is "possible"
    that a successful appeal can be made to have EBAY remove the NEG
    that Sid left.

    CD may be competent to make the case to an EBAY supervisor himself.

    If they were willing to do so, one of the California lawyers here would
    be well positioned to make the request/demand to EBAY.

    The primary basis for the argument is:

    1. Sid was on notice that CD did not want anything to do with Sid. That
    notice was sent via the EBAY message system. Sid disregarded the notice
    and placed a bid for the sole and exclusive purpose of leaving a NEG and
    causing damage to CD's biznez.

    2. While EBAY provides multiple methods by which to block unwelcome
    bidders, and while CD did not avail himself of any of those, the very multiplicity
    of those blocking methods can be argued to be "not stated to be all inclusive
    and thus not the exclusive methods;" thus, opening the door for the original
    email from CD to Sid to be accepted by EBAY as a retrospective bar to Sid's bid.

    (CD's failure to BBL Sid was excusable neglect, due to his reliance on the
    notice he sent to Sid using EBAY's message system. CD could not foresee
    or imagine that someone put upon such notice would EVER think of doing
    what Sid did.)

    3. While CD only stated to Sid that Sid "should block" CD, a reasonable extension
    of CD's intent was meant to convey that Sid was CERTAINLY not welcome to
    bid on CD's items.

    4. The conduct by Sid, viewed in light of all the circustances, was clearly intended
    to violate the spirit of EBAY's Unwelcome Bidder Policy.

    This poorly worded/punctuated language also has to be overcome, to some extent:

    Additionally, members are prohibited from bidding on or purchasing an item to disrupt or to leave non-positive Feedback or Detailed Seller Ratings for the seller, with no intention of completing the transaction.

    While Sid "completed" the transaction, he did so for the sole purpose of
    leaving the NEG. The bid by Sid was a violation of the policy against
    "bidding with the intent to disrupt" a listing.

    Also, obviously, there was NO scratch on the slab when it was shipped.
    Since Sid implied that such a scratch was NOT suffered in transit, Sid
    can be argued to have made a disingenuous comment about the scratch.

    Getting an EBAY T&S supervisor to accept the email from CD as "proper
    notice to Sid to leave me alone" is prolly at the heart of the appeal.

    Such an appeal is FAR from a slam dunk, but it is likely winable if persistent
    efforts are expended.

    EBAY's Policy

    Unwelcome and Malicious Buying


    Sellers may exclude buyers at any time prior to the listing close and are free to cancel unwelcome bids. After a seller has cancelled a bid, the bidder may not place a new bid without the seller's permission. Buyers who do not meet the seller’s terms as outlined in the item listing also are not permitted to bid on or buy the item.

    Additionally, members are prohibited from bidding on or purchasing an item to disrupt or to leave non-positive Feedback or Detailed Seller Ratings for the seller, with no intention of completing the transaction.

    Sellers are permitted to exclude bidders at any time prior to the listing close and are free to cancel unwelcome bids. After a seller has cancelled a bid, the bidder may not place a new bid without the seller's permission.

    Violations of this policy may result in a range of actions, including:

    Listing cancellation

    Limits on account privileges

    Account suspension

    Forfeit of eBay fees on cancelled listings

    Loss of PowerSeller status

    Failure to meet a seller's terms


    Examples:

    Seller states item will only be shipped domestically. Buyer is registered outside the shipping area.

    Seller states that buyers with negative feedback comments are not permitted to bid. The buyer has negative feedback.

    Report a buyer who participated in a listing without meeting the listing terms.



    Buying with the intent to disrupt a listing Examples:

    Buyer places a bid that greatly exceeds the value of the item in order to prevent a sale.

    Buyer bids on multiple items listed by a seller without intent to complete the sale.

    Buyer attempts to purchase an item after having been placed on a seller's blocked bidder list.

    Report a buyer who bid with intent to disrupt a listing.



    Note: Buyers who fail to respond or who back out of a transaction do not fall under the Unwelcome Buying policy. These listings should be reported as Unpaid Items.

    Preventing Unwelcome Buying

    In addition to reporting a user to eBay, there are several steps sellers can take to prevent unwelcome buying including:

    Turn on Buyer Requirements to block buyers who don’t meet certain criteria.

    Use Immediate Payment Required on Buy It Now and Stores listings.

    Place the bidder on a blocked bidder list.

    Cancel bids.

    Why does eBay have this policy?

    This policy is intended to protect the integrity of the eBay marketplace by prohibiting conduct that would interfere with the completion or performance of eBay transactions.

    Good call storm, I just sent ebay an email explaining the situation and your argument. I could care less about the neg but I'm curious to see if ebay will remove it. I'm setting the odds at 9-2.

    It may take going through several supervisors to get the full picture
    of the circumstance across.

    Several folks here have had good luck using email to
    get the job done.

    I always prefer to get the T&S folks on the phone and make
    the case more "personal."

    The key is persistence.

  • someone help me here: what should i do first:

    1. buy something off Bama_sid, and then Neg him
    2. buy something off Bama_sid, and then Neg him.
    3. buy something off Lee, but with the understanding that he is (Nuts) and might scratch my 2.00 psa graded card. ( who cares)
    4. sell something to the OP , but don't expect to get paid for at least 25 hours to 7 days.
    5. quit ebay altogether and seek mental and medical help from anyone willing to do it for free.
    6. quit posting on these boards since everything I type is taken the wrong way.
    7. buy something off Bama_sid, and then Neg him
    8. buy something off Bama_sid, and then Neg him
    9. buy something off Bama_sid, and then Neg him
    10. all of the above and then contact Storm for legal advice.

    Well they answered me within 12 hours and said they won't take away the neg with a nice form letter. I just don't care enough to go any farther with it; if I had to be placed on hold for more than 4 seconds by an ebay rep I would be forced to repeatedly slam my cell phone into my forehead until it crushes my temporal lobe.
