I was looking to see what they are asking for the new UHL and saw this Go buy from the mint not from coin Dealers/ Filpers, So on.
It's like going to a BM and standing in front of his or her store and say go buy from the mint not this store or am I wrong?

He is selling an item - "a document mailed to you". I think it's OK
There was no document there earlier. He's revised his auction to comply with the policy.

No offense taken, but I think you're casting a pretty broad net there. As a 100% positive ebayer myself, and one who values both that rating and my PowerSeller status, I assure you that I have no intention of cancelling my order for the UHR whether the coin sells on ebay as a presale or not.
It really comes down to simple dollars and cents. If I can turn the coin is a relatively short period of time, for a decent return on my investment, then I'm happy to do so. If not, then I'll hang on to the coin, and enjoy it for what it is. Who knows, if it sells, perhaps I'll buy another to replace it from the secondary market - or even from the Mint if/when they lift the one-per-household restriction.
There are all sorts of reasons why someone may prefer to buy from ebay rather than from the Mint - and may be willing to pay a premium for the convenience. Perhaps they prefer to pay with Paypal, which the Mint doesn't take. Perhaps they've exhausted their one-per-household limit. Perhaps they have an ebay coupon that is about to expire. Who knows?
Anyway - don't jump to the conclusion that all presales are, by definition, evil.

You are correct, which is why ebay has a policy on Pre-Sale Listings that states, in part:
Pre-sale listings are those that describe items for sale that are not in the control or possession of the seller at the time of the listing. These listings generally consist of items that are sold in advance of a delivery date to the public.
eBay permits Pre-sale listings only on a limited basis. The seller must guarantee that the item will be available for shipping within 30 days from the date of purchase (i.e., the day the listing ends or the date the item is purchased from a store front listing). The seller must also clearly indicate within the listing the fact that the item is a pre-sale item with a delivery date that indicates the item will be shipped by the 30th day from the end date of the listing.
I am careful to comply with this policy, as I try hard to comply with all listing policies. If the Mint were to cancel my order, and I were not able to find a replacement coin that met the terms of my obligation to the buyer's satisfaction, I'd refund the buyer's money immediately (if I'd been paid), and cancel the sale.

The problem with selling UHRs at higher prices on ebay right now is not an ethical one, it is a business values/business model question. I wouldn't do it because I would not feel I could stand behind my product at those prices.

At first, he wasn't offering anything - no document, no information - just "Go buy it from the Mint for less, and send me $1 if you appreciate my listing telling you that you can do so." He later revised his listings to include the "document mailed to you ..."
Evidently the folks in San Jose found his revision to be insufficient, as they've pulled all three of his listings.
