    Ebay auction

I am taking the card back due to the mislabeling by PSA.....he doesnt like the smudge in the card, but it is a LOW END 7.....It went for low-end price.....and I had scans......to quote Stan Lee...'Nuff Said.

  • I hate to say it, but I might want to return it too because of the mislabeling. It is highly possible that the buyer did not see it until he had it in hand.

I am taking it back due to the mislabeling.....I am going to get it fixed......but he is wanting me to refund before he even sends the card back (newbie bidder with only 3 feedback, 1 of them being mine)....

This one I can understand coming back. It is mis-labeled maybe the grade is wrong also? I could see a PD qualifier.

The grade might be wrong.....but most of the time they undergrade them......how many PSA submitters do you know of that look at a card and say....I think PSA missed this one...I want them to knock it down two slots........ uh....try ZERO....as a matter of fact....this is the first card I ever got from PSA that I thought had a generous grade....but I do not work for PSA....maybe the sharp corners and centering make up the the print mark....usually Im cracking them out because I have 7's in 5 holders....

Tell him this is against PP regulations. Go to Paypal user regulations and do a cut and paste in the section that states the return process. Tell him you are bound by PP's rules as he is. Use you PO employee again, you may be being targeted. You never know!

I find it interesting that of this guy's 3 feedback, one of them is for buying a PRO graded 58 Mantle.

HA! Good catch DigiCat....maybe I should send the smudged Mantle to PRO, where it can get a 9 grade and be worth more money!!!! At least it won't be trimmed, unlike 99.99999998 percent of their cards!

Solely on the issue of SNAD as it relates to PayPal and EBAY:

    .....

EBAY oficially names the acceptable graders in their policies section:

    Trading cards

    Grade your trading cards with:

    Beckett Grading Services (BGS)

    Global Authentication Inc. (GAI)

    Professional Sports Authenticator (PSA)

    Sportcard Guaranty (SGC)

When handled correctly, it is almost impossible for a seller to lose - on appeal -
a SNAD that is based on a buyer trying to substitute his grading "expertise"
for that of an "approved" grader.

The same concept applies to coins, stamps, currency, and comics.

A buyer's disagreement with an expertised-grade does NOT form the basis for a valid SNAD claim.

I am interested in the Mantle. Maybe we can work out a deal when you get the thing cleared up with the original buyer. Please keep me in mind.

Storm..what is your take on the wrong label though? PSA stated it was a 1966, but I called it a 1964 in the auction and in the header....?
  • bobbyw8469bobbyw8469 Posts: 7,144 ✭✭✭
Ok Mickey...would you be interested in the same price the winning bidder paid? All Star Cards currently pays $275 for that particular card in that particular grade....just not quite sure if I wanted to send it to them though...

Can I ask a question? When you listed it did you know it was mislabeled?

If so, why didn't you mention that fact in the listing?

A couple years back I knowingly bought a mis labeled card, got it for 50% of it's value too.

It was graded a 7, when I was selling my 65 topps set I threw the card in on a deal.

The 'buyer' sent it back to PSA for correct label and it was graded an 8!

    Steve

    Good for you.

No...honestly I didnt catch it...I knew it was card #50....unfortunately, both the 1964 Card and the 1966 card are BOTH #50.......I am submitting too many cards now, and I just didn't catch it...
  • WinPitcherWinPitcher Posts: 27,726 ✭✭✭
Bobby gotcha, the right thing to do is to accept the return then, like you, the buyer may not have caught it either.

he may want to use the card on the registery and can't.

    For our purposes, it's SNAD.

Conflicting listing terms/descriptions are construed in the light
most favorable to the buyer in a SNAD claim. The fact that the
buyer could have "easily seen" that the item was mislabeled,
is not a viable defense in fighting such a SNAD claim.

Just tell the guy to send it back, and refund him. Then try
again on the card. Keep it professional and stop communicating
with him if he refuses to return the card FIRST. Let him go to
PP and they will set him straight on the process.

Sadly, the buyer will likely leave a NEG.

I know......Im just about through with Ebay if I get another Neg......I know Ebay calls me all the time asking me why I am not purchasing on the site like I used to in the past....I wonder if they would call me as much asking why I am not SELLING as much as I used to??
  • WinPitcherWinPitcher Posts: 27,726 ✭✭✭
Why should the guy neg you? Email him and tell him that you too did not catch the error, as soon as the card is back in your hands
    his refund will be sent.

I assume you have more then 3 feedback.

Yeah I know ebay called me today, I picked up and hung up all in one motion.

I saw who it was on the TV.

    Good for you.

Simple solution to your problem---add this to your next graded auction---"NO REFUNDS ON ANY PSA/GAI/SGC GRADED CARDS. YOU ARE BUYING THE CARDS AS GRADED BY PSA/GAI/SGC."
  • bobbyw8469bobbyw8469 Posts: 7,144 ✭✭✭
I have this listed already in my auction. Apparently bidders don't read the auction listing. This one didn't even look at the scan, or he could have seen I was hiding nothing from him!!!!! Ebay has it now where, you can put anything you want in your listing....doesn't amount to a hill of beans.....
  • Not examining the scan is inexcusable on the buyer's part.

I'd tell him/her to poop in their hat and enjoy the new purchase.

Woah wait a second here, the seller did not realize it was mis labeled either.

I see a card, know it is a 64, I bid on it, Win it, I get it and the cert says 1966.

I can see that happening. Had the seller stated it in his description, then I'd agree and tell the
    buyer to pound sand.

    Steve
    Good for you.

I know its annoying getting a PSA card returned, but Steve caught you saying that you really did not know about the mislabeling either, therefore, you must empathize with the buyer who also missed it. Just take care of him.

You say you submit alot of cards. Well then, submit that Mantle for a correction on your next submission since you will be sending stuff to PSA anyway.

It plainly states no returns/refunds on graded cards......however you gave him an out with the label issue.

Otherwise tell them to read the auction next time.

Tell him he will be refunded after the card is returned.

You are doing the right thing by accpeting the return on the label issue. If not for that I would tell him to jump on a 3rd rail.
