updated eBay problem - resolved claim with PayPal

  • I would file the claim ASAP with the credit card company. Paypal seems to wait until enough time has passed to make it difficult to reverse the credit card charges. You can always cancel the CC dispute once paypal finds in your favor. Many CC companies only allow a dispute in the first 45-60 days.

    BTW, the CC dispute will light a fire under Paypals butt to act quicker.

    Odds are even with paypal deciding in your favor, they won't be able to get the funds back anyway. I am under the impression that you only get your money returned if they are able to get it out of the other person, not sure if thats a fact or not.

  • Just thinking out loud:

    Are you only able to file a single dispute per transaction?

    In this case the dispute was filed for non-delivery, seller waited till the dispute was filed for non-delivery and shipped a package with enough verification showing that it was delivered and signed for.

    Paypal will now find in the sellers favor because a package was delivered and signed for, dispute closed.

    Are you now able to open another dispute? I would think not since paypal already determined on this dispute in the sellers favor.

  • Never mind, I just spoke with paypal and they said you are able to file a second claim, but must wait for the first to be resolved before opening a second.

    I would still notify my CC company and start the dispute process.

  • I checked with my CC company and was told that I have 60 days to file a claim. The lady did say it's best to try to work out a solution with the merchant (paypal). I called PayPal to get my claim escalated and they did. I was told that the funds are on hold and that if the claim is decided in my favor I will receive the funds. Now the seller has 10 days to respond at which time I'm sure he'll claim that he mailed the coins to me. If needed I'll have my company's CPA draft a letter and go from there.

    Edited to add:

    Here's the latest feedback left for the seller.

    Negative feedback rating did not mail the NGC Morgan until dispute filed-then sent a 68 5cent GCGS LIAR!

    Fact.

    I lost around a grand when I was a Ebay newb (scammer seller didn't have it in account) even after I 1) called Paypal, 2) filed a dispute and 3) escalated it into a claim 8 HOURS AFTER AUCTION! How can that be that money was "lost" if it takes 3 days to get from PP to the seller's bank and they were notified that night (SUNDAY) NON-BANKING DAY?
    AUCTION ENDED THAT AFTERNOON!

    DO NOT TRUST PAYPAL TO DO ANYTHING TO ACTUALLY HELP YOU!
    FILE A DISPUTE IMMEDIATELY WITH CC COMPANY OR AS SOON AS THE CC COMPANY WILL ACCEPT IT!
  • Not that I would expect you to spend a lot of your valuable time on this. But I would suggest saving the packaging and coins to notify the attorney general of this scammer.

    Also you said paypal had the funds frozen(we hope all funds and not just some of the dozens he scammed). The person at Paypal, looking at his account, says no problem your $600 is frozen. But there better $12k frozen if everyone expects to get their money back.

    If they find in his favor for the non delivery, will this free up the funds long enough in between disputes for him to get it out? Maybe cancel this claim and quickly file the next? Or even do it on the phone with a rep so nothing is missed.

    Actually, it is pretty far from "fact."

    Buyers are protected up to the FULL amount of PayPal's advertised "Buyer Protection" scheme.

    NOT all buyers know how to exercise their rights under the scheme, but those who do have
    no problem getting paid.

    Is is possible eBay changed the feedback setting? It just dawned on me that the seller has been naru'd for the whole time.

    For $60, I'd immediately file with the credit card and I'd file mail fraud with the Post Master.

    I received the email today that the dispute on both coins was decided in my favor. Every penny was credited back to my credit card by PayPal. Yesterday was the date that PayPal had set for the seller to respond to the claim and since I didn't have to provide any documentation I'm guessing the seller did not reply to PayPal.

    In the PayPal transaction it lists the amount as recovered from the seller and then credited to my CC. I don't know if PayPal actually recovered the money from the seller or came from the guarantee. Doesn't matter to me as I have my money back.

    Congrats.

    I'm guessing that the seller did not have funds but the amounts fall within the Pay-pal guarantee and they just paid up.

    Or use a photo from coinfacts.com, sell that and send the GCGS coins. image
