It's may be of little comfort, but I started my 'blocked buyer list' with this loser; sorry to hear of your trouble with him. Just the fact that you've been working with the jerk shows why you have the high feedback percentage.
I can't speak for anyone else, but if you see a guy with 1020 positives and a negative comes along, I discount it entirely, particularly if there's a response indicating the guy was off base on his comments.
As far as his getting his undies bunched up over the wavy PSA lable, for a $16.05 item, that's so pathetic it's laughable. Just goes to show, that the worst situations make the best stories--
To your question, as a seller I leave feedback first. If they pay in a timely way, why not? The buyers upheld their end of the agreement. As a buyer, I expect the seller to leave feedback first--the guys that don't, I figure are either lazy or as appears to be the case here, pretty jaded.
I would also send paypal the scan you used in your auction so they can get a better look at the holder and the card. If you call them, they'll give you an email address where you can send it.
With NAD complaints, paypal usually requires a third party opinion. Since he's claiming PSA's slab has been tampered with, they may require him to send it to them for review (which I doubt he would bother to do on a $16 card).
I have added him to my blocked bidders list. Sometimes people just suck.

I escalated this to a Paypal Claim and here is my response:
"Hello, The card in question was received from PSA and put directly on E-bay. When I mailed off the card it was in very nice condition. I used a bubble mailer and a cardboard envelope so I doubt very much it was damaged in shipping. I take great offense when being accussed by Mr. ------- of removing a card from it's holder and replacing it with another. I would never, ever do this and my feedback speaks for itself. Presently my feedback is at 1020 all positive. If you check my latest feedbacks from buyers a lot involve other PSA graded cards some with higher value then the card in question. I offered Mr. ------- a full refund once I received the card back( I sent him 2 e-mails) and he never replied back to the request and chose to go this route instead. His feedback speaks for itself too and I hope you take this into consideration. I believe the only mistake I made was to leave a positive feedback for him before the transaction was complete. I do this with all my customers once I receive payment. It is because of Mr. ------- that I will never again leave feedback first for fear of retaliatory negative feedback which is very sad. He has already hung this over my head and you may also check this on his correspondence to me. I just want again to make clear that I in know way tampered with the PSA holder. If Mr. ------ had any issues with the grade the card received he should have taken it up with PSA. I have no control over what grade a card receives and cannot be accountable for that. Have Blocked this (POS) bidder also, sounds like he is the one pulling the switch aroo, he had a beat up Mattingly and now cracks the slab and has a mint Mattingly and his money back. My policy on feedback is they pay in a timely manner and have a rating of 99.8% or better, I will leave feedback first otherwise I will wait until they leave feedback. Just MOO
<< <i> To your question, as a seller I leave feedback first. If they pay in a timely way, why not? The buyers upheld their end of the agreement. >>
Then if the seller ships, he's upheld his end of the agreement.
However, it's obviously far more complicated than that. For the transaction to be considered "positive", sellers have obligations other than just shipping the product and buyers have obligations other than just paying in a timely manner.
To my repeat customers i always leave feedback first. To anyone new to me I do not.

Unfortnately I made a mistake on the listing and it states that I do accept returns. In his statement in the claim it says that he was able to just put his finger on the edge and open it. Now if I get the card back all f'd up do I just go back to Paypal and let them know this? Why did he do a claim when I already told him I would take the card back? What is my best play with this POS? Generally, the item has to be returned to the seller "as sold" for the return policy to be "enforced." Remember, EBAY cannot force you to make a refund; only PayPal can do that. EBAY can give you a "strike," but they will remove a first-strike in about a month, if you make a polite request for them to do so.
If the card looks OK when you get it back, then decide what you want to do.
Again, STOP communicating with guy. Ignore his emails.

I need some advice on what to do next. He filed a Paypal claim and I responded through Paypal that I would offer a full refund once I received it. He e-mailed me on April 28th saying it was on it's way. Paypal closed the claim in my favor on May 10th because he did not send proof that he mailed it off. Now get this I get another e-mail today from the idiot asking if I got the card back yet. I have not answered him back on any of the e-mails because that is what Paypal tells you to do. My question is what do I do if I get the card back? Refund his money and get a negative from him, refuse the package, keep it(Why should I pay postage again to send it to this jerk?), or what? Just to make it clear I still have not received the card back or really know if he sent it or not. The above question is what to do if I do get back in the condition I sent it off. Any imput would again be appreciated.

Yes, if it's unopened, you can take it back to the post office and return it to sender.
Please do yourself a favor a block bestbuy791silver from ever bidding on your E-bay auctions right now! He finally gave me my first negative after 1126 positives. Kind of feels good though, sort of like a right of passage. Anyways, after I won the Paypal claim he filed against me I finally got his package and promptly returned it to sender. I did not even open it. He must of got it back today because he left the negative and this e-mail:
" AM LEAVING NEGATIVE FEEDBACK AS THE CARD YOU SAID YOU WOULD ISSUE ME A REFUND WAS RETURNED TO SENDER BY YOU AND MARKED AS "REFUSED"...YOU DID NOT KEEP YOUR END OF BARGAIN. I WILL BE FILING COMPLAINTS AND MAIL FRAUD AS WELL AS OPENING ANOTHER CASE IN PAYPAL IF I DO NOT GET MY REFUND WITHIN 12 HOURS. I EVEN PAID $5 TO SHIP THIS BACK TO YOU! I WANT THIS REFUNDED ALSO."
Here are my questions:
1. Am I wrong not refunding this POS after getting it back from him 3 weeks later? In the Paypal claim I stated I would refund his money, but he did not follow up with them so I won the claim. In my auction it also stated that I would refund providing it came back within 7 days. I would of even accepted 10 days, but not 3 weeks later.
2. Can he open another Paypal claim or does he have any leg to stand on with the mail fraud threat?
3. What is a good reply back to this BS negative he left me?
Any help would again be appreciated. I know better not to answer any of his e-mails back. This guy is a real whack job and needs to be hit by a bus or something.
Thanks.

The post office might tell the clown they'll check into it but they don't have the time or people for crap like this. The Postal Inspectors are working overtime on 419 scams and terrorism; they don't have any time at all to worry about a $15 sale where the guy has the card that he bought!
If you cheated someone out of thousands of dollars or cheated many people who filed a complaint together they might take an hour and look at the case to see if there was anything there, but they definitely won't spend 10 minutes with this guy.
Sorry he screwed you with feedback, I bought from you in the past and everything was great. Did he send a tracking number with his package? If he did he can appeal the Paypal claim if not he would have to go through his credit card company. But he doesn't sound smart enough to know that. Just block him from buying from you and block his emails.
When responding to the feedback he left I would mention that he is an inexperienced psa buyer with a short fuse that you couldn't put out. It's obvious that after almost 8 years you are a good businessman worth dealing with.
Don't yell or call him names, the truth makes him look bad enough and makes you look good.
Could someone please walk me through the steps of blocking a bidder? I can not for the life of me figure it out. I know I've done it before, but now I am befuddled.
Thanks - Jim

I kind of disagree with the whole "Take the high road" approach. There's really nothing wrong with telling somebody how you feel about them. The only thing that stops a restaurant or retail store from telling their problem customers to stop being ridiculous is that it will probably cost them business. It has nothing to do with "being the better person".
The majority of the people we deal with on ebay are good people like us, but I would say 1-2% are crazy or stupid or both. I have no problem telling somebody how ridiculous I think they're acting and why I feel that way. So you get a neg, big deal. If you do enough business on ebay (500+ transactions) a neg here and there isn't really going to hurt you. Personally, I enjoy the satisfaction of feeling like I haven't bent over and taken it from somebody who's acting like a jerk. I'm a reasonable person and my refund policy is more than reasonable (blanket return policy for everything regardless of circumstances), and if that's not good enough for somebody and they feel the need to keep actin' the fool, well they're going to hear my feelings on the matter. Basically, I never want to leave a situation with the feeling that I should've said something but held it back. If I get hit with a neg, so be it. These situations happen so rarely, I really don't think it will have any effect on my sales.
I mean, hell, at this point the guy already negged you. If you tell him why you think he's being ridiculous it will make you feel a lot better, and it really doesn't make you "look bad", and I'm not really sure there's anybody to look bad in front of anyway. I recently had an altercation where I pretty much went off the deep end- by far the most insulting I've ever been to somebody in all my years of dealing in cards- and nothing's going to ever come of it other than this guy not liking me. Do I care about the $18 he was going to spend? Not really. Do you care about the $16 this guy spent? Probably not.
Call it a social commentary, but I think people who act this way will stop doing so if enough people tell them to stop being an idiot. Either that or they will shut themselves away from the world. Either of these situations is beneficial to society.
Let me also say that wheeling and dealing cards is a pseudo-hobby of mine and I find it relaxing and somewhat gratifying. If my livelyhood depended on making money in cards, I might have a different policy, much like restaurants and retail stores.

Hi Lee,
I agree with you. I know I am the better person and anybody with any sense whatsoever will see that too. So here is what I replied with, "Paypal ruled in MY favor. This guy needs meds and professional help. Help him!" People like this guy need to be wiped off this planet with all the rest of the vermin. I know this sounds kind of harsh, but I truly believe the world would be a much better place without his kind. Thanks for all the support and advice.

Wow, I haven't checked my blocked bidder list in 2-3 years. I couldn't even remember where to find it. So, I followed Storm's directions and found two IDs on my list and ONE OF THEM WAS THIS JACKHOLE!!! I'm sure that I didn't sell anything to him, so if you search the forum you'll probably find that this idiot has blazed many a trail.

To make a long story short I sold a PSA 9 1984 Topps Don Mattingly for about $16.00 on E-bay. I just got this card back from PSA and put it directly on E-bay. The auction ended on 4/17 and the next day the buyer pays through Paypal. On 4/19 he asks me when the card was shipped out. I reply back saying the card will ship out either on 4/20 or 4/21. He then leaves this e-mail yesterday:
"Again-When was this sent?????? Please answer me."
I reply back that the card left Saturday and against my better judgement I left a positive feedback for this guy even though I had a feeling this would turn out bad. I usually leave feedback when I receive the payment, but never again because I just now get this e-mail from this guy.
"Mark, I received the item today. I am very dissapointed in what i have received. I first noticed the red/white PSA label had a ripple in it from air getting into it. I immediately put my fingernail into the top left corner i noticed that this case has been opened before!!!! I want an explanation immediately."
Mind you my feedback is at 1013 all positive and this is for a freaking $16.00 card! His is around 97% and he recently got a comment back from a seller stating that he is rude and that he threatened to leave a negative if he did not get feedback first. I e-mail the guy back asking what is he talking about and that I just got this card back from PSA. He now sent this e-mail to me sounding like he is threatning me with my first negative.
"I seen that-you have perfect feedback! VERY RARE! I know....Trust me....unless it was done during shipping....the PSA case has not been sealed right...did you inspect it when you got it back>?? did you notice the ripple in the psa label at the ps in TOPPS and tt in Mattingly?i do not want this card, do you have another you can substitute before i leave feedback?"
I replied back asking what does he want that is fair. I would take the card back, but it sounds like he is trying to con me. What shall I do? Tell him to go f--k himself and take the negative? Is a week to get a card from an ended auction too long? Any imput would be appreciated. Because of this guy I will never again leave feedback first which is very sad.

I already know he is going to neg me. The card is probably just fine anyways. This POS was just trying to get me to send him a free extra card.

Just wait until the PP dispute/claim is closed.
DO NOT communicate with the buyer, outside of the
dispute/claim process.
If PP decides in your favor, you can decide if you want
to issue a refund or not. I would NOT. The guy is going
to NEG you no matter what you do.
//////////////////////////////////////////////////
Generally, the item has to be returned to the seller "as sold" for the return
policy to be "enforced." Remember, EBAY cannot force you to make a refund;
only PayPal can do that. EBAY can give you a "strike," but they will remove
a first-strike in about a month, if you make a polite request for them to do so.
Thanks, Mark

to do. The guy will NEG you no matter what. I am not
partial to making refunds to bad guys.
You can reply to the NEG:
"Difficult EBAYer. PayPal decided in my favor. Sorry for the controversy."
ANY direct communication you have with the guy now, will
come back and bite you later.
I would likely do NOTHING, rip the page out, and move on.
<< <i>I wouldn't communicate directly with him at all. Refuse the package if it arrives. >>
Got the package in my mailbox today. Only took the idiot 3 weeks to return it after he put up such a big stink at the get go. Can I just go back to the post office and give it back? Did not have the chance to refuse it. Any imput again would be appreciated.

Lenny

Don't yell or call him names, the truth makes him look bad enough and makes you look good.

I ONLY act nice/restrained in order that it will APPEAR that I am "being the better person."
<< <i>I kind of disagree with the whole "Take the high road" approach. There's really nothing wrong with telling somebody how you feel about them. The only thing that stops a restaurant or retail store from telling their problem customers to stop being ridiculous is that it will probably cost them business. It has nothing to do with "being the better person".

Hi Lee,
I agree with you.

This guy is sad and pathetic. I even almost feel sorry for him. Almost. I just want to make it clear that I did offer him a refund in the Paypal claim. He did not follow up and I won the claim. In my auctions it says an item being returned must be done in 7 days not 3 weeks!

<< <i>Hello Everyone,
To make a long story short I sold a PSA 9 1984 Topps Don Mattingly for about $16.00 on E-bay.
"Mark,
I received the item today.
