Who has the right to say how the coin is shipped? (Poll)

The seller of the coin or the buyer of the coin. Think about it for a min. before you vote. Either:

1) You own the coin, are selling it and reserve the right to ship it any way you please. But of couse if you do not have a buyer then you're stuck with the coin, or.
2) You are buying the coin and are telling the seller to ship it a certain way. Heck, if you weren't buying it, there'd be no transaction at all......

    Neither is always right. If you buy a coin, in general I think you implicitly agree to the seller's terms unless you've negotiated different terms.
  • I voted the seller cause until the buyer takes physical possition, the coin is my responsibility.
  • I don't think the buyer has any inherent right to demand that the seller ship a certain way.

    Asa seller, I set my minimum requirements which make me feel comfortable, but if a buyer has higher expectations and wishes to pay for those to be set in place, I am all for it. As a buyer, I would look at the offered shipping and if i felt uncomfortable, I would pay for the upgrade. Case in point, I purchased a coin with a listed shipping of priority mail, but to me that coin would be very hard to replace. I asked for it to be heavily insured, sent registered mail and overnighted it. I had the coin in hand the next day and felt very comfortable.

    As you can see--I prefer being in the drivers seat, and not leaving anything to chance. The worst case scenarios ALWAYS happen to somebody, and it is always so obvious when time for second guessing occurs.

    So, my answer is YOU have the right if you want to get the coin to you or if you want no issues from the buyer (oops lost in the mail, sure wish we had insured that sucker,what? you want a refund?)
  • Once the price of the coin has been established I have always asked the buyer how they would like to have the coin shipped. Their cost.

  • Im with the seller on this one. Especially if the seller is selling lots of coins and he sends them a certain way.

    The seller, but there are always ups and extras that the buyer can pay for.

    Seller has the responsibility for delivery. Therefore final decision remains with the seller.
  • Where does Kaelasdad go to send an item by Registered Mail and overnighted it ? I, for one, have never hear of such a service. Who provides it and what does it cost ?
  • I posted this because I was put into this position today....

    1) The individual is very well known in the hobby.
    2) He has his own insurance coverage which requires you to (these are MUSTS)
    - Use overnight express mail WITHOUT insurance
    - Can not add special services (return receipt/confirmation/etc)
    - HAS to be in a box within the largest overnight box.... (yes it gets wierd)
    - Flat mailers void insurance.....
    - Declare a value.... it voids insurance.....
    - I could go on..... really....
    3) He wont budge from his way of shipping.

    Have you ever run into a situation like this?










  • The seller sets the terms and conditions, but if the buyer wants to pony up extra cash for a better, faster way, then more power to them and I'd be happy to accomodate them.

    I won a coin on e-bay last week. The seller charged $3.95 postage plus mandatory insurance. I paid
    the postage plus insurance. The coin arrived in a non-padded envelope with .63 cents postage. The
    seller dictated the terms of the sale and then IMHO screwed over me. Fortunately the slab was still intact.

    Peaceman, I have shipped this way to a couple dealers. One of them the way you state it, and one that I put my name, return address/hisname, then ship
    to him. I prefer it the last way I put it as it takes it completely out of my hands. He gives me his corporate account number and the last rule is.... Pay no money. Serious.

  • The seller should as he bears the responsibility of getting the item into the buyers hands. Now if the buyer is willing to pay for additional accomodations like registered mail overnight shipped in a double box or whatever ann additional I feel he needs to pay for.

    I have had buyers win something then say just stick it in a plain envelope and only charge me 50 cents S&H. Now that does not meet my minimum standards so I will not honor such a request at all.

    It was 1 millllion dol.., no, I mean 1 Billlion dollars... but it was worth it image

    Actually, I think I was daydreaming as to what I would have liked it to be, I had that coin insured up the wazoo and then had it expressed to me. I think I asked for it to be registered as well, but that was not avilable under those shipping conditions. Had registered mail been available to add, I would have added that puppy on.

    So, technically, I asked for all those things, but I only got 2 out of 3 image

  • As a seller on ebay We usally decide how the items are going to be shipped. On occasion, people will ask for certain things, such as 2nd day air, delivery conformation, etc. We also ship alot overseas, so we give them options, such as surface or airmail.
  • I think the buyer has every right to have his or her preferences of shipping !!

    The seller has no investment in the shipping fee's, the buyer has paid that !!

    The coin no longer belongs to the seller once the auction/purchase has been completed by payment in full !!


    I have asked /insisted on particular shipping methods many times, IMO my shipping preference generally exceeds that which was offered by the seller. And as long as they fall within the price charged for shipping , no additional money should be required !!!

    Shipping methods and cost are always a part of the negotiation. If they aren't discussed or agreed
    upon in advance then the party shipping makes these decisions.

    It is the buyers choice since he/she now owns the coin. Of course if upgrades are needed beyond the sellers normal shipping method, the seller also has to pay for it. Seems only fair to me.

  • Seller calls the shot as he is responsible until the buyer gets it, however, a buyer's request should be considered.
  • Actually the person paying for the shipping should decide but the seller is responsible until the item is received. Ironically this is the opposite of business . In accordance with CCC and most state laws, the buyer takes possession once the item is delivered to a licensed courier. The buyer would need to file with the courier if the item is not received.
  • When selling I'm responsible to get the coin to the buyer. As such I really don't give the buyer much leway in terms of how it gets shipped.
    Depending on price the item goes out either:
    USPS Priority Mail Insured with Signature Confirmation
    (it is redundant for both sig conf and Ins but I can check online with sig con)
    or USPS Registered Insured Mail with Return Receipt.

    I've had many coins, some expensive, arrive very shabily shipped with not so much as even delivery confirmation, which IMHO is a waste of money as that only shows it WAS delivered not WHERE it was delivered. When I paid more for and specifically requested how I wanted it shipped.

    I've had at least 2 S-VDB's dissapear somewhere as they were being sent to me but the cheap, substandard bubble wrap envelope made it ripped to shreads. Both were insured but I wanted the coins not to file an insurance claim.

    If a buyer doesn't like the way I ship I really don't care. As stated above I want to make sure as best as I can that the buyer does receive the item purchased. I've only had one sale where the guy said he didn't receive the coin. When I showed him the date and time along with his signature of receipt he meraculously found the coin and then I blocked him from any more bidding on my auctions.

    Do you have proof of this?? Most laws I have read and lawyers will tell you just the opposite. Paypal protection to be eligible you have to prove delivery.

    What you are saying is if I mail you a MO and it never arrives you will ship the item since you took legal possession and responsibility of the item when I mailed it. I seriously doubt that. You would expect me to send the payment again before you would ship. That is a 2 way street sellers cannot have their cake and eat it too.

    I believe that the shipment method is negotiable matter when the purchase is from an established dealer and the amount of purchase justifies tolerance by the seller. I do not buy coins from e-Bay or from unknown sources. In almost all of my purchases of coins where the cost was over 4 figures , I the buyer selected the shipment method with concurrance of the seller. The selection method is made principally for safety, insurability, documentability and when all these are assured for my convenience. Insurability is critical and in some instances the sellers insurance coverage trumped my preferences. On a couple of occassions the seller had very specific shipment preferences and I either accepted the method or not . When purchases are from auction houses the delivery was by their preferred method although if it is a house where I am well known they have been flexible when requested. I have been fortunate and have never had a coin sent by FED-X or Registered US Mail fail to be delivered or damaged enroute.

  • The seller sets his shipping policy. If the buyer doesn't like it he can try to negotiate with the seller.

    Naturally it makes sense for most sellers to try to make their buyers happy so they should have a flexible shipping policy.
  • The seller, since you are setting the terms and responsible for delivery.
    I just had a complaint on a $300.00 coin for shipping charges because of the way I shipped,
    which I would not compromise on. Shipping cost was $10.58, I charged $11.00.
    It was sent priority mail, insured tracking, signature required.
  • Also this is kind of a dead issue since most auctions state shipping cost and terms up front.
    Why would you bid on something knowing this if it is a problem?
