A question for the lawyers reguarding some credit charges

I made a payment to a large company I it did it over the internet. They way it was supposed to go was out of my checking acount. there was an issue with the way the account was set up it was typed in that it was supposed to come out of my saving account but the Bank routing number I gave is ONLY for my checking account. Well to my surprise I got hit with 2 insufficient funds charges by my bank and the same with the sears insufficient funds. I contacted my bank and asked them if the routing number I gave was for my checking account and they said that It was ONLY for my checking account and didnt give them access to my saving account. Well talking to this peon at sears he said that it was sears policy to only use the written account and not to go by the Bank routing number even if its different.

So if your following it at this point My account said it was supposed to come out of my Saving but the Routing number was only for my checking account. How can Sears do this it dosent seam ok for sears to be going into a different account from what the routing number says.

My question is do I have any recourse?? Im already heading to the bank do do a dispute of charges against the insufficient funds. But other then that how can sears willeynilley go rummageing through your account and dicideing where they want to take funds from???

    IndianaByron, I would run it up the Sear chain of command as far as you can possibly go. Explain as clearly and nicely as possible what occurred. I've found that when trying to deal with difficult situations like this it pays to be nice and very persistent at the same time. If you don't like the answer one person gives you, ask for their supervisor. Eventually, you'll get to a person who really knows what they're talking about and will explain in extremely clear terms what occurred, why, and what you can and cannot do. If you're still not satisfied with that, then you should probably pursue your bank (unless you have already started that pursuit first). Persistence truly pays off...but you must be nice. Don't act all ticked off...that won't usually work. Sears will want to keep a happy customer (I would think) so you might come to an amicable agreement.
  • aahhh ok Im a little p....issed off so sorry for my ranting and raving.

    What took place was I submitted my credit card payment online with an online check. Ok I though no problem. But when i went to check if it had cleared Sears had tried to post it to my saving account. Well i went and checked on my sears account to see how I did the payment to see if i messed it up. Well its is set to be taking out of my saving account but the account type is checking (sears asks for a bank routing # and the number I gave is Only for access to my checking account) Well sears tries to tell me that they only go by the account type and not by Bank routing numbers. So its my fault that they tried 2 times in less then 2 hour to submit the echeck to my saving.

    I called my bank and asked if the routing number I gave was for checking and they said that it is ONLY for my checking and not for access to saving. The rep from the bank said that sears only tried to get the money out of my saving account that they never tried my checking account. Well the amazing thing is that I never gave my saving account number to sears for them to even try to get money from that account. The bank routing number is only for checking!!!.

    Well not i have over 80$ in fees racked up from both the bank and sears. To me is seams very screwy that sears would do this almost seams like they were trying to steal from my account. After all they accessed an account they didnt have premission to access.

  • I would think you some recourse with Sears,providing they did not have access to your savings account # givin by you !

    Heres my quick Sears story.

    Got them to price match a kitchen range from a store 2500 miles away from me,MGR is Hot !

    Range gets to the store and i pick it up and take it home,has a giant dent in the side,Manager says ill get you a nother one but you have to pick it up !

    I say "No Way" he REFUSES to deliver it,i call HQ and 15 minutes later get a call back from HQ, Your stove will be delivered tommorow at 11:00 AM !

    I only gave them access to my checking account through the Bank Routing Nuber for that account.

    I did not give the routing number for my checking even if its only 2 or 3 numbers different hell for that matter 1 million numbers different. Is it right for a company to access an account they dont have premission to access???

    Think of it this way you have a credit card you make a online payment using an echeck or some other verision of that. Well the company dosent put in the routing number correctly or they onpurposely change the routing number to give them access to another part of your account. A different account from the one you gave them premission to access. Then you find out and you try to dispute and they drop the line on you that you have an agreement to pay us and we took the money from your account it dosent matter that it was supposed to come out of your checking we did it from your saving.

    Hmmm but you didnt give them premission to access to get it out of your saving HA what the heck are they doing in your saving anyways??


    I hope this makes it a little bit more personal so you get a better grip of what im getting at.

    You need to clarify this !

    First u say routing for checking,then no routing for checking ?

    In reality,i dont think savings uses routing numbers !

    thats for the banks and the feds to move money to the correct places !

    Maybe there is a routing for wire transfers to savings ?

    If it was there fault and your sure I'd contact the BBB. They can turn up the heat on Sears, they usually back down. They screw up on my account a few times and always backed out their fee if I B1tched enough.

    Byron, I may be missing something, but why didn't you just send them a check? I've had trouble with these electronic payments in the past, so I just mail the payments.

    Generally a routing number is not account specific. Each bank has their own routing number for all accounts. You must specify which account savings or checking that the funds are to come from. You should have an agreement with your bank that if you do not have sufficient funds in your checking account then they automatically transfer funds from your savings account to cover the shortage.

  • Your bank will have the same routing number for all accounts...it is the account number that varies.
  • Well K6AZ I normally do just send a check but this time for some dumb reason I dicided to use their eletronic payment thing. Believe me its the last time I use it.


    100proof1957 Most if not all accounts use a 7 to 9 digit number for your account number (dicided by your bank)( this is different then your banks routing number) with that number the last 2 digits can be made in my case from 00 up to 09 all going to a specific account. In my case my checking account ends with xxxxx03 and my saving ends with xxxxx02. I only gave them my checking number xxxxx03 (the whole 7 to 9 digits are called the account routing number or bankaccount routing number) In sears case they only submitted the charge to my saving acount ( xxxxx02 ) which I didnt give the account number or access to that account to sears.

    I used to think this was true and how it worked. However, with a child in daycare, I have learned different.
    In all my other transactions, electronic, what you say has been true. So, when we paid for daycare with a check and they were doing an electronic transfer with it, I thought it would come from checking.

    Not so. The system (and I don't recall who they use) routes it differently and it ended up coming from my savings image
    I had just transferred from savings to checking to make sure I was covered and I came CLOSE to not having enough in savings because it was almost all in checking right then.

    I was livid and had the wife ask about it since I didn't want to p*ss anyone off. It went up the foodchain, was investigated, and came back as to how the 3rd party system runs the numbers and transfers.

    So, it could depend on how sears' system runs things with your bank/CU. That was how it was for me. Maybe my check/savings number codes are reversed compared to other banks?

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment
