eBay will probably start paying attention to copies once they lose their first lawsuit that breaks the "venue" defense.
It's not coming from coin folk, but from designers like Gucci who have people working full time with eBay to shut down fake auctions, and they are pissed about it now.

Below are a couple links that might provide to be useful putting this Jerk out of business. This guy is clearly violating federal law with his non-diclosure and mis-representing a hobby replica coin as a real coin. I'm going to file a report...anybody else want to play?
U.S. MINT/UNITED STATES CODE/HOBBY PROTECTION ACT INFORMATION
Internet Fraud Complaint Center IFFCFBI
HERE'S WHAT I TURNED IN AT THE IFFCFBI:
EBAY SELLER PJD1966 HAS VIOLATED THE HOBBY PROTECTION ACT 15 U.S.C. § 2101,BY LISTING AND SELLING A REPLICA OF A U.S. COIN AS REAL U.S. COINAGE IN EBAY AUCTION Item number: 3953616316 TO AN UNSUSPECTING BUYER 23JAN05 08:45:00 PST. PLEASE DO AN EBAY SEARCH FOR THE ABOVE ITEM NUMBER. HIS AD DID NOT INDICATE THE ITEM WAS A REPLICA AND HIS PHOTOGRAPHY "CONVENIENTLY" CONCEALED THE FEDERALLY REQUIRED STAMPED "COPY" INDICATION ON THE REVERSE BOTTOM OF THE REPLICA COIN. THE UNSUSPECTING BUYER WILL BE DEFRAUDED OUT OF $1725.00 FOR THIS ITEM THAT LEGALLY IS SOLD FOR LESS THAN $50- WHEN PROPERLY ADVERTISED IN ACCORDANCE WITH FEDERAL LAW. ALTHOUGH EBAY ALLOWS THE PRACTICE OF LETTING THE SELLER LIST THE AUTION AS "PRIVATE" THIS DENIES INTERACTION BETWEEN MEMBERS, AND IN THIS CASE PREVENTED COMMUNICATIONS TO WARN THE BIDDERS OF THE MISREPRESENTED ITEM.
WHEN THE SELLER WAS CONTACTED THOUGH THE INTERNAL EBAY MAIL SYSTEM BY ANOTHER EBAY MEMBER TO INFORM THE SELLER OF HIS MISLEADING AD, THE SELLER ACTED IN A THREATENING MANNER AND REFUSED TO TAKE HEED NEVER CHANGING HIS AD DESRIPTION. THIS WILLFUL ACT DELIBERATELY VIOLATED BOTH ADVERTISING AND SELLING PROVISIONS OF THE FEDERAL CODES CONCERNING SALE OF REPLICA "COPY" COINAGE. FEDERAL STATUTE EXCEPTS AND GUIDES TO PROPERLY IDENTIFY REPLICA ITEMS CAN BE FOUND AT THE FOLLOWING U.S. MINT WEBSITE: http://www.usmint.gov/consumer/index.cfm?flash=yes&action=busguide&sub=BusReplicas
PLEASE INVESTIGATE THIS MATTER TO AVOID THIS FRAUDULENT SELLER TO CONTINUE THIS UNETHICAL AND FRAUDULENT SELLING PRACTICE.
PLEASE GO TO TOOLHAUS.ORG WEBSITE AND ENTER EBAYER'S ID PJD1966 FOR FEEDBACKS FROM OTHERS. 99 OTHER EBAY MEMBERS POSTED PROBLEMS INCLUDING SALE OF COUNTERFEIT COINS.

ADDED NEW INFO TO IFFCFBI REPORT

FEEDBACKS CAN READILY BE REVIEWED AT TOOLHAUS.ORG TYPING IN HER EBAY NAME PJD1966 AND SEARCHING FOR FEEDBACK "RECEIVED BY". MANY OF THE TRANSACTIONS INDICATE FRAUDULENT MISREPRESENTATION OF COUNTERFEIT AND COPY COINS AND CURRENCY. FRAUDELENT MISREPRESENTATION OF JEWELRY AND OTHER ITEMS. NON SHIPMENT OF PURCHASED GOODS AND NON PAYMENT OF RETURNED GOODS FOR CREDIT USING THE UNITED STATES POST OFFICE BOX AS BUSINESS FRONT.

EBAY SELLER PJD1966 CONTINUES TO DEFRAUDING CUSTOMERS USING REPLICA PROOF COPIES USING THE SAME DECEPTIVE PRACTICE ON EBAY ITEMS 3945728631 AND 3951116689. NOTICE IN HER ADS THE CONSISTENT ANGLE TO INDUCE GLARE OVER THE "COPY" ENGRAVING AT THE BOTTOM OF THE COIN.
EBAYS PRACTICE OF HIDING AUCTIONS AND SELLERS FEEDBACKS IS A LICENSE TO DEFRAUD AND STEAL AND SHOULD NO LONGER BE ALLOWED AND TOLERATED. AT THE MINIMUM "PRIVATE" AUCTIONS ENCOURAGES SHILL BIDDING. IN MORE EXTREME CASES SUCH AS THIS, OPENS THE DOOR FOR FRAUDULENT CRIMINAL ACTIVITY.
IN THE MOST SEVERE CASE THAT I CAN THINK OF, EBAYS ALLOWANCE OF HIDING AUCTIONS AND SELLER FEEDBACKS ESTABLISHES A CONDUIT PIPELINING MONEY TO INTERNATIONAL TERROISTS OR TERRORIST ORGANIZATIONS WHO CAN EASILY GATHER FUNDS BYEITHER DECEIVING UNSUSPECTING EBAY BUYERS OR TERRORIST MEMBERS MOVING FUNDS THROUGH PHONY AUCTIONS.
PLEASE TAKE AN ACTIVE APPROACH TO STOP THIS MEMBER'S FRAUDULENT ACTIONS AND TO CONTACT EBAY TO CLOSE THE LOOP ON THIS DANGEROUS POLICY.
THANK YOU,
TF

<< <i>There is no way eBay can continue to argue they are "just a third party conduit" when they are this blatantly negligent in protecting their users. >>
Exactly the opposite. Their "blatant neglect" is a must if they are going to maintain their "just a third party conduit" argument. As soon as they start taking a proactive role in the protection of the consumer they also assume responsibility and liability for their protection as well.

Holy Shi-ite!
That feedback roster is a hoot. Many many sellers quoted - "Doesn't Look All Good To Me", or somethign along those lines.
Most common response to negative feedback: "Tried to resolve but this newbie is a (insert crazy person, nut case or completely unreasonable)".
Most recent ebay link
Another scam ebay link
*It is an eBay auction, and a private one at that. The buyer has accepted responsibility for bidding in a venue where they can't physically inspect the coin. The seller obviously responds to emails, could not the buyer request additional images? What if there was a deep scratch in the reflection area? What if there is a raised bar with the word "COPY"?
*The bidder obviously knows how to read, buy, and purchase online. The 2005 Redbook is available in every bookstore in the country and on every major online bookseller for $10.
*There are thousands of legitimate circulated morgan dollars on eBay that may be purchased for $20 or less. Many even have pictures that show the reverse. A comparison would literally take a few seconds.
*The title of the auction doesn't say "1893-cc PROOF MORGAN DOLLAR". It says: COIN FROM AN ESTATE COINS COLLECTION NO RESERVE. The coin wasn't listed in Coins->US->Morgans->Proof, it was listed in "Collections: Lots". And, hell, the text of the auction doesn't even mention what the coin is. So the buyer was intentionally looking through countless auctions, trying to find a steal. Trying to catch the seller sleeping.
*This seller has 6,000 sales, the majority in coins. Yet the buyer apparently thinks the seller doesn't know what a proof morgan is, even when it is listed on the 2x2.
*A genuine 1893-cc morgan proof is a $50,000 to $200,000 coin, maybe more.
I submit that the seller is a worthless, piece of crap scam artist. But I also maintain that the buyer is 100% responsible for their own actions and is being driven by greed. They think they're going to get rich by paying $2k for a $200K coin. They're not interested in educating themselves, they're blinded to over the top red flags and warning signs.
I have sympathy for the buyer, but not much. Maybe a $2,000 lesson will keep them from losing their home or retirement savings.

Aren't there authorities other than eBay who might take an interest in this mail fraud?

I doubt it, deadhorse. My company has had bookleg product sold on eBay for a year. I've worked with postal inspectors, FBI in 4 municipalities, Attorney Generals in two states, State police in three states, local police at the location of the seller. We know the individual's name and address, they have previous records and are well known to the local cops. And there can be absolutely no doubt that the product being sold is counterfeit.
Nobody will do a thing.
Unless it is hurting a big company and unless the losses are in the tens or hundreds of thousands of dollars, you're not even a gnat in their ear.

You're correct that they must avoid being proactive in order to maintain a viable argument that they are nothing more than a third party venue. However, that isn't applicable here. They have had dozens of reports of fraud on this seller involving many auctions over an extended period of time. That makes any action they take reactive. Ignoring those reports and doing nothing is negligence by every definition.

I gotta agree with you. There's enough red flags in this auction to ward off any but the most stupid of bidders. The "winner" clearly has more money than brains. I do about an hour of research for a $50 eBay purchase -- and this one would be an obvious fake in the first couple minutes.
The seller needs to be strung up, of course. But the seller could not work her evil without numbskull bidders.

I bid on 2 of his items, I have perfect feedback and Ill sacrifice one to leave a neg. Maybe I'll pay the small change and then neg him after I get his feedback.
Like the Aerosmith song........."Don't get Mad, Get Even"
Although they weren't quick about it, the MANY REPORTS SUBMITTED BY OTHERS probably "bothered" them into action. The IFFCFBI deals with Internet fraud and in the case of the International fraud the Chinese guy in forum threads "China Again" perpetrated, the system worked. Reporting these scam artists may not always be 100% effective but nothing will happen if no one tries.

Although the Government Investigation bodies have their hands full protecting us from terrorists (which I and my family greatly appreciate), eBay provides a potential pipeline to transfer funds between terrorist groups who could either generate funds they "steal" from unsuspecting eBay members in fraudulent transactions or transfer other monies they generate virtually undetected through phony auctions, especially "PRIVATE" auctions. The massive eBay network may be an easy way to channel funds INTERNATIONALLY between terrorist memeber/organizations.
As primarily as an eBay buyer, I believe eBays allowance of "PRIVATE" auctions and "HIDING MEMBERS FEEDBACKS" a dis-service with high potentials for fraud and other criminal activities. Any flagrant lack of good business practices such as in auctions such as those offered by PJD1966 shouldn't be tolerated and needs to be reported.
