The item is a silver round in a deceptive box that resembles a GSA holder.
BUT his argument is, "They bid it up. What can I do about that?"
For starters you could call it a "silver round" and not imply that it is some sort of branch mint proof that came from an "estate."
Of course then it would only bring $10 or so, which would take all of the "fun" out of it.

Yes, you can. If it's not legal tender in any country of the world, it is not a coin. A coin MUST be legal tender in order to be called a coin. Otherwise, it's just a 'round'. If this coin was legal tender, then it would be a counterfit and technically illegal. So there is a lot of basis for getting this auction nuked and the seller in trouble.

Well, I found this interesting article which seems to state that the word 'coin' can only be designated in certain circumstances according to the US FTC.

Not correct. Or did US half cents not become coins until 1965? Were Trade dollars coins in 1873 - 76, not coins from 1876 to 1965, and are now coins again?
Interesting thing is that feedback score is only 19 with over 400 feedbacks total. Ebay does have the system in place to help potential buyers identify blatant shilling activity but one must be willing and able to take the time to "read between the lines."
