Ebay experts....tell me if this is legit according to ebay policies or if seller is a ****

One of the auctions in question: Auction

This auction will be ended early if bidding does not come close to fair market value of spot + 1.85.
Can you end an auction for this reason? Against policy or not?

Shipping & insurance is $175 for the lower 48 states. Shipping price includes shipping, insurance cost & eBay fees
So, can the additional fees cover ebay fees? Or, is that fee avoidance or something?

If your winning bid is less than the fair market value at the time we receive your payment, your order will be placed on "hold." Your order will be filled once your purchase price meets fair market value. Due to the constant market changes this also includes the "Buy it Now" price! DO NOT BID if you do not agree to our terms! Your bid means you have read our terms and agree to them!
Hmmmm....can they hold the order, even once paid for, like this? Doesn't seem right to me.

I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    What a scam -- and an oxymoron. Plainly, if one has the highest bid but the seller "holds" the item until more cash is ponied up, that bid wasn't a "winning bid."

    What this seller, American Bullion Exchange, needs to do is set a reserve price, and then accept any winning bid over the reserve. Until the seller does this, it's not an auction.

  • There is another one going around with 1 oz gold eagles, 10 for $3800. The catch is you have to be on the approved bidders list, and once you contact the seller, you get the pitch about negotiating a deal with him. No mention of his auction.

    He obviously needs to do some reading of eBay rules and regulations. As for $175 S/H, he REALLY needs to visit the USPS website regarding flat rate shipping.

    They will make a call on it.

    It's just too bad that they only want the auction# and you can't make any statements in that report.

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    I saw a couple of auctions like this for some stamps I was interested in. I also sent the auction numbers to eBay. It's too bad there isn't a way to tell if reporting eBay scams actually does any good.

    Wow, I just saw that auction and was going to post a question about that! What a crock! I know it's in a thread here somewhere, but I'm going to be at work today and don't have time to do a big search, so can anyone post the link to report this garbage to ebay? I haven't ever reported anyone before but this is beyond ridiculous!!

    Mikey, I've seen a few with that so called approved bidders list, and each one was for a fairly significant chunk of gold with a BIN at about half spot, as though a mistake in math had been made. Needless to say, each one was a hijacked account and the 'seller' tried to negotiate another scam/deal off ebay. If you are looking for a small pile of gold there are a couple of reputable on-line sellers around, where you don't have to worry about ebay scammers and/or ebay mania resulting in inflated prices.

    That is a crock!

    I had a keyword spammer I e-mailed. He claimed his auction was not keyt word spamming. He proposed we send our e-mail chain to e-bay and let them decide. I reported the keyword spamming, e-bay ended his auction, so he's mad at me and "has me on his RADAR"!

    Interesting assessment of "fair value", since Tulving sells them DELIVERED for much less than that.

    Same seller has dozens of auctions ending in 10-12 hours from now, all with the same fee avoidance BS in the description.

    As for the idiot that is selling 10-1oz of gold for 3800- 'We' are still waiting for him to show up at the bank in Italy to get his money so I can have my gold.....this one is under a federal investigation, and I started it. neener neener neener.

    If the payment is higher than $1.85+spot, they will refund the difference. If it is lower, they hold it for 45 days. If it doesn't meet the price within that 45 day timeframe, they return it, less ebay fees.

    So let me get this straight. . .

    this seller is selling something that the seller does not have in the seller's possession

    demanding payment within 5 days with S&H covering any/all fees that the seller can think of and probably some others not thought of

    will end the auction if the bid isn't high enough

    will hold your money if the bid is high enough but the price of silver changes to a point were the seller will lose money when the seller actually takes possession of the items being sold

    will refund your money, minus eBay fees if the price does not drop back down to a level at which a buyer may have paid, within 45 days


    I still don't see how someone can auction off something that is not in their possession to begin with. Furthermore, if someone did win one of these auctions, I would think it would be a legally binding auction contract that the seller would have to honor regardless of what the price of silver eagles is at a future date. It sounds to me like the seller will hold your money, decide if the deal will be beneficial to the seller and in any respects cover the seller's eBay fees with the buyer's money.

    I wonder what would happen if I sold some PCGS MS65 Morgans like that? I don't have the Morgans yet but I'll get them at a future date. If I can make money off of you, then I'll ship you the coin. If I can't make money off of you, I'll ship back your money minus my ebay fees.

    Since these are 2005 Eagles that this seller does not even yet have, perhaps we should ask for a copy of the purchase contract from the US Mint.

    There are so many ebay/PayPal policy violations in their auctions it isn't funny. The $175 s/h is fee avoidance, and charging people to use PayPal is in violation of both eBay's and PayPal's TOS. I wouldn't go near this seller.

    These guys are breaking just about every eBay and PayPal rule on the books. I don't usually report auctions, but I think I will in this case. It's just ridiculous!

    E-bay says you can end an auction early as long as you do it at least 12 hours before the end of the auction.

    Yes, and no. One can end the auction for a legitimate reason. Ending a no reserve auction because it didn't meet a particular dollar amount is considered fee avoidance.

    Agreed. However, a legitimate reason is because there is an error in the listing... and this guy has more errors than Michael Jackson has little friends

    Well, the auction closed at $1025. That's about $3300 short of his stated criteria of spot +$1.85, so I don't think the winning bidder is going to be seeing a monster box any time soon.

    does that shock you???? ebay is a public company and the people who run it get their stock options based on revenue less expenses...aka profit.....ebay could care less about anyone of you...period as it is more cost effective to advertize and replace you than do the customer service thing.....now if you " we " went public then its a whole new ballgame and they will do what has to be done for the image thing

    the above adage now has a caveat and that is.. this internet thing where as info flys around at lightening speed has to be selectively controled...especially in narrow casted situations...of which we are one

    ps..me personally...i could care less about this seller...i think we should all go support our local hobby store to get us our bullion where we touchy feely the silver as we hand over our money
    my goal is to find the monsters and i go where they are but i sometimes miss some.... so if you have any and want to sell IM THE BUYER FOR THEM!!!

    You can figure in your costs in the opening bid. You have the right to start the bid at anything you want. However, you can not SURCHARGE for anything aside from reasonable postage/insurance.

    The rest of it is not only against ebay policies, it's totally unethical... it wouldnt suprise me if it's illegal. I would buy anything from the dude.
