The core issue here is whether numismatic professionals are going to be able to provide reasoned, impartial, educated opinions to the public without threats of harassing lawsuits. One would hope that the courts will have the foresight to rule against gag orders from disreputable sources.
Retired dealer and avid collector of U.S. type coins, 19th century presidential campaign medalets and selected medals. In recent years I have been working on a set of British coins - at least one coin from each king or queen who issued pieces that are collectible. I am also collecting at least one coin for each Roman emperor from Julius Caesar to ... ?
Anyone setting up an email address for the ANA legal defense fund so I could paypal them?

Thank you "KHayse". It's been a few weeks and honestly I really only had a real bad day or two. My wife had a bad week. Like I said before, she was very early in the pregnancy. Thank God for that.
About the paypal address, that would be so very convenient but I don't know if the ANA could or would do it. Someone should ask them but trying to get a phone call through to Chris Cipoletti isn't easy. Maybe I'll give it a shot tomorrow.

I don't think I like this at all! Possible higher revenue is one thing but I'm not into looking at ads for cars and such. Two page come back from ACG? Looks possible now!!
Something regarding the ACG lawsuit has been bothering me for awhile. There's a legal defense fund for the 46 defendants.......that I completely understand. But why wouldn't some of the hobby's leading companies, such as Collector's Universe, Heritage, NGC, ANACS, ANR, Superior, etc, etc, swoop in with large contributions to the defense fund? One of the Heritage principals was involved in the testimony against the ACG evil empire a couple of years ago, so there's obviously no love between Heritage and ACG. Also, everyone agrees that the hobby will be a much better place without the likes of ACG, so there's definitely a benefit to the aforementioned companies to help the legal cause. It just seems like this should be an easy to defeat if enough money is thrown at it. If ACG wins, then you can expect that shady TPGs will start popping up like mushrooms (or should I say "fungi")
And one final question (and this is a very serious question): Do you think that Alan Hager has a Mini-Me?

C'mon you big, successful TPG's, pony up. This is serious stuff!
As for 'loser pays,' that is the "English rule" (ours is, not surprisingly, called the "American rule"). Loser pays/English rule would allow huge corporations to crush the little guy and there would be a slow, but steady, diminution of law protecting the little guy when he is legitimately hurt at the hands of the big guy. (Read today's US Supreme Court decision holding that when an HMO acts in a manner that constitutes malpractice, ie., by denying certain medically indicated treatment, they cannot be sued under state law for the damage -- guess how many HMO's are going to offer to pay for expensive stuff now). You don't want to live in a society where MacDonalds and Microsoft and Disney can do whatever they want with impunity; believe me, you don't. There is no question that there is entirely too much frivolous litigation in the courts -- I defend against a lot of it and have been doing so for the last 27 years. But, there are rules in place at both the state and federal levels to punish frivolous lawsuits including making the lawyers who file them pony up the money for the other side's fees and costs.
It's a really delicate balance. Don't believe everything the insurance companies tell you in their advertising - they have billions to burn and to use to blame it all on the lawyers. Without the lawyers in this country we 'd be living like in Maoist China or Cambodia under the Kmer Rouge -- instead of pledging to a hammer and sicle flag, we'd be pledging to one with all the great corporate logos on it. Use your heads.
