heritage goofed up

I won an auction from heritage on may 5. They sent my coin to someone else. heritage said they sent numerous emails and left messages on the machine but no reply. They said that they will try to find me another coin but if they cant I will get a refund and a 25.00 coupon. Has this ever happened to anyone else?

The person who received it in error has no right to the coin and the coin's return can be demanded. I think you're referring to the regulations concerning unsolicted merchandise, which doesn't apply to Heritage's mailing error.
Heritage should pursue the person who is keeping the coin in bad faith.

Correct, but the person who received it does not have to foot the bill for sending it back. Of course in this case I'm sure Heritage would be happy to pay for the return postage.
After trying unsucessfully to get the guy to return the coin, they apologized & gave me the new book on Pattern Coins as a good faith gesture. The $25 certificate offer is the same idea.

None the less, I can't resist there massive quantity of nice coins. Plus they always send me their auction catalogs.
i would ask for my money back and this $25 coupon
and for a coupon to auction one coin with no buyers fee up to 5K with a reserve set by you with no buyback
i would not wait for them to find you another coin you never looked at or bid on
