I won an auction from heritage on may 5. They sent my coin to someone else. heritage said they sent numerous emails and left messages on the machine but no reply. They said that they will try to find me another coin but if they cant I will get a refund and a 25.00 coupon. Has this ever happened to anyone else?

At least they're fessing up and trying to compensate you for the screw up.

That sucks... but, I think with the Postal Laws, the person who recieved the coin can keep it...

The person who received it in error has no right to the coin and the coin's return can be demanded. I think you're referring to the regulations concerning unsolicted merchandise, which doesn't apply to Heritage's mailing error.

Heritage should pursue the person who is keeping the coin in bad faith.

Correct, but the person who received it does not have to foot the bill for sending it back. Of course in this case I'm sure Heritage would be happy to pay for the return postage.

This happened to me last year when ANR sold my coin to a floor bidder that bid the same amount as my internet bid (my bid had priority according to auction rules). Once someone else gets his hands on the coin & doesn't want to return it, practically speaking, there's not much you can do.

After trying unsucessfully to get the guy to return the coin, they apologized & gave me the new book on Pattern Coins as a good faith gesture. The $25 certificate offer is the same idea.

Heritage's goofs, gafs, and other mishaps have become rather infamous in my book.

None the less, I can't resist there massive quantity of nice coins. Plus they always send me their auction catalogs.

and for a coupon to auction one coin with no buyers fee up to 5K with a reserve set by you with no buyback

i would not wait for them to find you another coin you never looked at or bid on

Heritage once sent me a 1995w silver eagle pr69dcam which I had not paid for, i called them and they were almost choking when I told them. Since the invoice was $1800.00 odd dollars I kept it, paid , sold it

Heritage also makes mistakes in the buyers favor. Last year I found a MS65 1880/9-S in their inventory for less the MS64 money. I bought it and wondered if they would deliver. Lo and behold it showed up in a few days and nothing was ever said.
