Does EBAY allow adding a % charge to a final value?

i saw this
When using Paypall add 10% extra to the total amount(item+P&P) up to $50.00 and add 5% to the total amount over $ 50.00.
on THIS item
This was illegal a few years ago... i got busted for it. Is it OK now?
