Here is the last discussion.
I filed a mediation complaint with the ANA after sending two letters (unanswered) to the dealer. Today, Paul Sims's manager wrote to me and the ANA, stating that we may send back the coin for a replacement or a refund!
I am sooo happy that I followed this through and didn't let it drop. I am very happy that a very old transaction can be made right, and that the dealer is doing the right thing.
Yippee!

That's fabulous. I read your story with great interest when the thread was initially posted, and admit I had doubts of your recovering any of the money. I think it is a credit to the dealer that he/she decided to do the right thing. I'm equally sure your Dad would be proud.

If you opt for a refund, how much money will you get? If you get back the money at yesterday's price, then you may be better off getting a replacement coin.

The details will have to be worked out. I assumed that a refund would be the price he paid, so that is why I'm thinking replacement would be better.

I'm glad it worked out, but the fact that it did only after going to the ANA is somewhat troubling. The dealer should have stepped up to the plate without that being necessary.

I'm sorry, but this just reinforces my opinion of a complete and total scumbag and a dealer to be avoided.
I'm glad it worked out, but the truth is that had you not known about the ANA mediation, you would have been SOL and I'm sure that is what Scumbag Sims is counting on. 99% wouldn't know about this mediation.
Sims shouldn't be praised. He should be shot.

New collectors, please educate yourself before spending money on coins; there are people who believe that using numismatic knowledge to rip the naïve is what this hobby is all about.
If you opt for replacement, take only pcgs or ngc graded coins, don`t settle for substandard slabs or a shamefully overgraded raw coin.
I agree with Greg, Syms deserves nothing but total avoidance.

A Tax is a fine for doing good.
I was going to ask them to take me off their mailing list, but at 87 cents postage 2X per month, I figured I would soak them for $20 postage a year. They will eventually spend more on wasted postage than they burned me for a few coins.
Coindaughter - I have never seen Sims promote certified coins. As I recall, they claimed your Father's $3 was AU. Make 100% sure it is not cleaned. If they will not provide a PCGS/NGC/ANACS certified, tell them YOU are going to get it certified and it must be at least AU. Make them agree to refund grading fees and provide another coin if it does not properly grade. A lot of their stuff is cleaned. If you don't belong to PCGS Collector's club, I would be glad to organize the transaction for you (will cost about $60 for grading fees plus round-trip shipping & insurance).
NOTE: No trees were killed in the sending of this message. However, a large number of electrons were terribly inconvenienced.
