Both appear genuine to me.
The first is a worn business strike, the second is a well known NGC PR65 Matte Proof.

Seller is probably using pirated pics then. I can guarantee the second coin is a genuine Matte Proof.
I can post whatever image I want, regardless of if I own the coin or not, if my desire is to rip someone off.

This is why all the yelling for Ebay to police the site or PCGS to spend "whatever it takes" are missing the point. If eBay suddenly shut down every listing of a counterfeit coin, the crooks would just post fake pictures. At least now you can usually see the fakes, at least the obvious ones.
No doubt. Although sometimes the hardest day ends up being done random day when you don't have ask the daily their and you just get hit with some random memory.
