Coin scratch advice. Will this 1823 CBH Patched 3 cross to PCGS with this obverse scratch?

I've had a couple coins over the years go into genuine holders because of a scratch.

This scratch had to have happened well over a hundred years ago.

I also had a Grant w/star commemorative with a big old scratch on Grant's cheek get graded.....I called him 'Scarface.'

Please chime in, I would like to hear your opinions.

    I’ve read here on the forums that PCGS has tightened up a bit in the last year or so. I was already thinking this coin is probably a toss up for a successful crossover, so maybe the odds are a little less in its favor at the moment.

    They don't want to be the bag holder; what advantage is it for them to endorse it as a no problem coin?

    The scratch on the Grant looks a little more natural, like it could have happened from another coin in a mint bag that was handled aggressively.
    The bust half scratch looks either intentional, or from a staple during careless removal from a holder. I don’t see it crossing over.

    This coin does not look like a 40 regardless of the scratch, so that is a no-go for me. I think the scratch would detail the coin.

    Not sure the grade would hold, and the scratch looks like a sure "details" maker on that one.
