First, thanks to all for all the valuable information on this forum from a long time lurker in learning mode (childhood coin collector with a reawakened interest) .

An advertisement is deemed false/misleading under Section 43(a) of the Lanhan Act where each of the following are shown: (1) a false or misleading statement of fact; that is (2) used in a commercial advertisement or promotion; that (3) deceives or is likely to deceive in a material way; (4) in interstate commerce; and (5) has caused or is likely to cause competitive or commercial injury to the plaintiff. Additional requirement is that falsity of claim can be shown through objective, scientific information.

"Only 6 examples are graded MS67+, none higher" seems to be a statement of fact which can be readily shown to be objectively false. Will defer to other forum members whether such an objectively untrue statement would satisfy the other elements.

Again, kind regards to all for many interesting reads!

Welcome to our lovely, enjoyable, and sometimes off the wall group! I dont disagree with the assessment, generally the coin hobby is kind of kept "inside the walls' protecting our amazing but little world. We are mostly a group of people who investigate and study things to the "umpteenth" degree, so often little issues are brought to attention as we are trained to do that after so many years collecting/dealing/studying/etc.

Your legal assessment is correct, though I dont think we are trying to suggest there is any kind of legal issue here, more just an issue with the "unspoken rules" of the coin world! With that said, so happy you are here and made your first post. Looking forward to seeing more of your input!

He doesn’t need to explain anything to anybody. Did anybody in here make a counter offer? Who knows that ask price could be the lowest a possible consignor would go. He’s like a natl champ head coach possibly he saw a crease in in the defense downfield, called a play, signaled the QB…

My guess - He possibly sold it to a special very well off private retail client. Probably getting all the money or very close.

Unfortunately Rick isn't on here much so he probably doesn't know the nature of people rallying to his cause.

It’s his inventory, his business. Highly possible that could be the lowest the consignor would go.

Too bad, I preferred your first edit. I've read everything you have said. You quite clearly have not read (or at least understood) anything that I've written. I haven't mentioned one single negative or positive thing about Rick and had barely mentioned him until this post. My concern was with the OP being an alt/troll. Thanks though!

@lermish: I know the troll/alt quite well. I appreciate all your prior posts on all his alts. With 100% accuracy, I might add. A big THANKS to you! Unfortunately, he got far more reaction on this thread that he ever imagined he would.

Thank you for your kind words. I really like this board and the vast majority of the members. It really bugs me when people try to make it worse for no good reason.

The discovery was a joint effort between @DeplorableDan and I...he is just a lot more rationale than I at knowing when to let things go :D

I'm surprised this topic wasn't locked after the OP got banned, but I'm glad it didn't.

If you've been on these boards for a while then none of this is surprising.

And the idea that someone needs be "perfect" to be critical of such things is just a lazy straw man argument.

Yes - I am very surprised the thread has not been locked or deleted (which is what I would have done). What disgusts me is the sleazy way somebody went to his website, copied data in here then trashed him out. He never even had a chance fix the situation or whatever. (Has this person copying his stuff been kicked)? Somebody trashed and threatened me via my private email because I simply agreed with a comment from a poster, pushed the agree button (another thread)! That person needs to be kicked. However that’s my prob but I certainly will find out how report them to the mods. Is them having the ability see who tapped agree for somebody’s post a bug that needs to be fixed or just site sop? I am going to take a vacation from all this. Goodbye and good luck. Have a nice evening.

    This post is getting funky.
It’s officially 🍿 approved now, baby!

Having fun while switching things up and focusing on a next level PCGS slabbed 1950+ type set, while still looking for great examples for the 7070.

You're the one popping out of nowhere to make a critical comment on a topic that you haven't contributed to and has nothing to do with you. You know, like every other post you've ever made. 🙄🙄🙄

Price guides are just that - a guide. When it comes to scarce top pop, single digit pop material it’s a different ballgame.

I know that it is going to be awful when after two days this thread says "139 new". :D

I assume Rick pulled the listing and will relist it after editing the description. Of course, he may have already sold it.

If the piece has been for sale for over two years it would be highly coincidental that it sold during the brief period of this thread. More likely, the description is being revised.
