Selling a counterfeit/replica coin is both illegal under US law and against the rules of eBay unless the coin itself is stamped with the word "COPY". Aside from being required by law, this protects future buyers from purchasing the counterfeit coin as genuine; no dealer can ethically sell such a coin without the "COPY" stamp.
The word "restrike" has a precise meaning in numismatics - it is a genuine coin struck by the Mint (with original dies) at a later date than the date on the coin. The coin in the OP is absolutely not a restrike; it is a privately-produced counterfeit.
