PWCC first coin purchase (Based on NGC partnership) - anyone else have any experiences?

I just purchased my first coin / auction win on a 1909 $5 gold Indian (Sunday 2/15/23). I went in to pay the invoice on Monday, 2/16/23 and they tried charging me 8.7% sales tax. Now, I'm not super up to date on how sales tax works but I'm pretty sure I should NOT be charged tax on a purchase of a pre-1933 gold coin (they are located in OR and I'm in AZ). I'm currently still working with customer service to resolve this. Second, I'm wondering if anyone else has had any good or bad experiences with PWCC. How they handle this will make a huge determination on if I bid on other coins from them.

Everything I'm reading tells me both Oregon and Arizona have no sales tax on bullion **or ** rare coins. Based on my previous knowledge of PWCC, and the fact that they were banned from eBay because of "Alleged" shilling, I have no intention to patronize their business at any time now or in the future. Their business on ebay accounted for 200m annually in gross revenue, if Ebay pulled the plug on that it must have been pretty bad.

As a recent transplant to Oregon I can tell you there is no sales tax period on anything!

I’ve had this happen before. Just call them and they will fix if.

It might be they are calling it a sales tax but is really TPT tax. That is what ebay is collecting but under the heading of sales tax, took me some time to figure that out as ebay had never charged AZ residents a sales tax (as they should not). Not sure if that was forced by Ducey or someone in the senate, but the change happened while Ducey was the governor.

Thank you everyone for your feedback. I'll post updates as I know more. Still waiting on "accounting department" to fix the invoice...

@AndyK... If they don't fix it, cancel the sale and do not patronize in the future. Cheers, RickO

Update. They did eventually remove the sales tax and I was able to make payment.

Adding an occasional 8.7% or the like to gross sales would be a very crafty business strategy. Crafty and shifty.

But does that apply to coins in AZ?

After WayFair vs. South Dakota, every state is free to adopt laws based on the buyer's location. The Arizona TPT is Arizona's version. Other states just piled on with regular sales tax.

I know. But the states that I'm aware of mimicked the sales tax exemptions that they had. States that had coin or bullion exemptions also had exemptions on the TPT. I don't know about Arizona, but that's why I asked. The OP's question wasn't about the general Wayfair taxability but the coin exemption.

Actually no. If you collect a tax - even in error - you must remit that tax to the taxing jurisdiction. If you don't there are big penalties.

What would be shifty is to then file for a refund for erroneously collected taxes and not rebate that to the buyer.>

not at all. It is illegal to collect sales tax that is not owed. It is illegal to collect sales tax and not remit it to the state. There would be nothing "crafty" about it.

And I gave you a pointer to the law. Read clauses (21) & following.

What would have been really shifty (and this is AZ, so ...) would be to 'accidentally' drop some of the exemptions.

Imagine how many others who purchased through PWCC, ended up just paying the invoice without going through the rigamarole that OP did by contacting CS. Are the other buyers going to get a refund too, or are we assuming OP is the only customer that was wrongly charged sales tax?

IDK. But if even one of them simply reports them to the State's Attorney General...
