The independent seller Segoja is a member here who infrequently visits, and given what I've read about Apmex's selling strategy I'm leaning towards a "borrowed" photo. I could be wrong, and would love to read the whole story.
Looks to me that James has possession of the coin - he has always been a straight shooter with me.
Apmex on the other hand:
At least they are showing photos of the reverse now
They are only marking it up 10% over James' price
BUT - they offer no returns.
Conclusion - don't jump to buy from Apmex and look for these one-of-a-kind pieces on other venues.

Keep in mind that Apmex gets lots of eyeballs. And, yes, it's withing eBay TOS to do, just like if you had a coin in yous B&M store and listed it, too. Might cost an occasional neg, but worth the risk.
What's to stop someone from listing someone else coins without permission or an agreement? If you mark them up and get someone to buy its the same thing. Then just buy from the seller right away.
I'm tempted to buy this coin from Apmex, return a generic white coin and cite their stock images clause. I collect bullion so it's OK right?
Well, it may be acceptable according to ebay rules, but it just seems a bit 'off'....However, not much different than having a coin for sale on a website and also offering it on ebay at the same time....Cheers, RickO

According to said horse he has a dealer agreement with them that apparwntly lets them offer the same coin for sale

I wonder if they buy it from each other then do buyer requested cancelation..? I'm not sure if you get dinged as buyer for doing it too much.

I saw the same thing yesterday. A token on northeast numismatics site, also listed by APMEX on eBay. Same exact piece, different sellers.
