Caught Between Paypal and eBay

Last month I won a Canadian half on eBay and paid via Paypal. Five days after payment I check at my Paypal account and see that my package
was delivered the day before. The "seller" had provided Paypal a UPS tracking number. The tracking number given was plugged in at the UPS site
and shows that, indeed, a package was delivered to someone 3 miles from me. It wasn't my address, but the address was never shown on the
tracking number. Evidently this bogus seller had covered her tracks by mailing something to someone in my zip. I opened a complaint with Paypal
and they closed my case as their investigation showed a package had been delivered to my area. Just not to me. I complained at eBay and they
sent me back to Paypal. The seller had no feedback when I won the half and now is at -3. All the negs scream "FAKE TRACKING NUMBER!!!!!" so
that must be the case.

Anyone hear of such deviousness before?

Yeh, happened to me. At least they sent something close to you!

My item was "sent" two states away (~600 miles). Regardless a complaint was filed and I won in my favor.
Your situation is slightly more dicey, but should not be an issue either since it wasn't sent to YOU!!!

If you paid by credit card, which I always do when using PayPal, then you can do a chargeback directly through your credit card. PayPal does not like this at all since they do not control the process, but it can work and you can get your money back.

i am certain it works but be forewarned, the balance to this equation is that since paypal doesn't like those from what i've read previously

it is the quick way to get your money back as well as your account suspended

It doesn't make sense that Paypal would retaliate against one trying to fix a mistake. I will contact my credit card issuer
as my Paypal account is linked to my Visa.

For a while it has been surreal. From ebay to Paypal and UPS, oh my! But because at least 3 other fools were victimized
by this person I thought it would be a service to out this nefarious process.

    Thanks for the help guys!

How can a seller fake a tracking number? How do you know the package delivered to someone 3 miles from your address since the tracking number did not show the address? It sounds like USPS's mistake. It sounds like USPS delivered to a wrong address and Ebay/Paypal no way to verified that. You might get your money back from credit card but I am not sure about it since Paypal can show the tracking info to your credit card company which it showed delivered unless you can prove it delivered to the wrong address.

Just curious what UPS had to say about the delivery since they should have gotten a signature. You could go down to a local UPS office with a signed document or driver's license and prove if the sigs match or not.

"It doesn't make sense that Paypal would retaliate against one trying to fix a mistake. I will contact my credit card issuer

Actually, it does make sense that PayPal would revoke the account or suspend the account. By going through PayPal, you allow PayPal to decide who wins what cases and who loses what cases. More importantly, you allow PayPal to escape the financial responsibility of possibly having to refund your account. If you go directly through your credit card then the credit card makes the determination and this can hurt PayPal finanacially. I went through this process one time perhaps six or seven years ago and PayPal sent me a letter to inform me that if I ever went over their heads again and directly to my credit card that they would terminate my account.

It's threads like these that remind me why one should have no problem using the gift option to save paypal fees..

Edit to add: I hope the OP can get his money back, or at least obtain the seller's contact info to threaten a fraud complaint. I would have no problem going through my CC company if paypal refuses to do the right thing, as you can always open another account as long as you have a different CC or bank account.

You should re-read the OP. Nowhere did he state it was USPS (United States Postal Service). He stated, clearly, and a couple of times, that it was UPS (United Parcel Service). Two COMPLETELY different organizations.

OK. You are correct, my mistake it was not USPS but UPS but it is still the same if he can't prove it was delievered to a wrong address, I don't think he can get his money back.

Call paypal. They require that a package be shipped to the confirmed address. They should fix this promptly. --Jerry

If you have the tracking number, you can call them and they will tell you the address it was delivered to.

To do a CC chargeback you have to have used your CC to make the paypal payment. Just being linked to a CC is not enough. If the online tracking shows a different delivery address than your paypal address then paypal will make good. When you get paypal on the phone keep asking for the next level of supervision until you get satisfaction.

Keep in mind tracking may only show a city and zip. Before you can convince paypal you will need to be able to show a street address that delivery was made to. You may have to contact UPS to establish a street address.

I wouldn't worry too much about this. Ripping eBay is one of the ways people use to signal that they're a Serious Collector here. On the plus side, at least the guy didn't call it "Feebay" or "Fleabay" or some other cutesy derogatory name. image

This was UPS, not USPS. The tracking number on the Paypal invoice just said the package had been delivered.
I had to go to the UPS site to find the local address, not mine, that received the package. That information was
available onlime for just 2 days after the supposed successful delivery.

It is hard to imagine that the seller, some 1500 miles from me, would know someone 3 miles down the road from me.
So I don't suspect more than one person. I'm guessing she just picked out an address in my zip and invested a few bucks
in a package delivery with tracking number.

I had no idea of the inner games between Paypal and other financial institutions. It has been an education to learn so
much in such a short time period. The boards truly serve as a positive force when it comes to education.

    Thanks again.

Does it make a difference if the Paypal payment was made with funds in my Paypal account and not
coming through my Visa? Will Visa step in when the transaction apparently involves just me and Paypal?

I never thought about seeing "Confirmed Address" on a million Paypal invoices. I'm not sure there is a protocol where
Paypal is responsible for making sure a submitted tracking number is indeed headed to the payer. I'll ask.

    Thanks.

Visa won't do anything if you paid with PayPal funds since they have nothing to do with the transaction.

Simply call the eBay buyer protection department and point out to them that this seller is racking up negs for fake tracking numbers. You'll be fine.

Unfortunately you're going to have to fight with paypal/eBay until they make this right. You didn't pay with your credit card so there's nothing they can do for you. It's a tough lesson to learn, but I'm sure if you stick with it you'll be okay. Just don't give up and stay on top of paypal as with each passing day your chances of being made whole diminish.

Also it should be noted that cases like this are exactly why I always transfer money out of pp the moment it is there. I buy a *lot* of stuff on eBay and I always want to use a real credit card (not an all-in-one vs/mc debit card). Those all-in-one debit cards don't have the same protections that regular credit cards typically have. Good luck boyhowdy!

NARU is a good sign for you. It means ebay most likely banned the seller. You can confirm he as been banned by doing an advanced search for him by seller name. If nothing comes up he has been banned. Paypal phone number 1-888-221-1161. keep saying "agent" til you get a live person, then ask for fraud department.
