Beautiful toning. I don't grade Jeffs - the reverse seems to mushy for MS 66 or 67 to me. Are the 39s known for a mushy strike? Thanks for sharing the coin! zap
It's an MS66. Obverse strike is pretty good, center columns of Monticello though are soft for the date. I got this one for the toning, but I will say that the fields on this one are excellent, pretty much MS67 quality, and that combined with the toning merits the MS66 in my opinion.

The top riser is thicker on the Rev of 40 and the steps have a defined start and end with a vertical line. The Reverse of 38 is often described as having wavy steps. The 38 is shown on the left and 40 on the right. Some day I am going to update my example photos to full steppers, just too lazy!
To the OP, I think PCGS was a little harsh on that coin. Based on that image, I see nothing that would prevent it from an MS67 There are some very minor marks on the reverse which is a little mushy, but the obverse is pristine, very lustrous, and incredibly attractive. That coin would certainly grade MS67* at NGC. Here is my NGC MS67, it is also my avatar.
