Wow NARUed Over a .99 cent item

Wow,
Still in shock, 200 Auctions and 600 Store Listings gone, $500.00 or so uncollected Sales, $20K in Inventory (Sitting here now). All gone because of the .99 cent a$$wipe I talked about here on Fri. I screwed up, because I placed a bid on his item even though Bill outbid me in a matter of seconds. Never placed a second bid.
11 Years on E-Bay, last year Sales $34K, this year on track for $25K in Sales, over 10,000 transactions, current Feedback 3901 Positive, one Neg.
I am just totally in shock.
Neil

Yes they called it an attempt to retaliate, even though I was outbid and never bid again on his stuff. I already talked to them (E-Bay) on the phone, they said it will be reviewed in 72 hours but if no new information apply's (Which nothing is going to change), the NARU is permanent.

Rue the day he messed with Neil he will, he might as well start ruing now.

eBay can be a very arbitrary place.
Best of luck
Considering your track record with eBay over the past years, I would suggest that you appeal to eBay for reinstatement.
Unless you have had any other recent violations with eBay, you should be able to put things back in order soon.
eBay should have sent you an email with the following:
Resolving your account suspension
If your account was suspended because of a rules and policies violation, you can appeal your suspension. Reply directly to the suspension notice you received and include any relevant information. Or, you can contact us.
Do not email anyone. Call your Powerseller Rep if you were a Silver Powerseller.
Sorry this happened to you .... I hope everything works out okay!

My thoughts exactly. I'm also shocked that they would perm NARU a powerseller with a record as impressive as Neil's...I mean I can see maybe if he had like 230 next to his name, ok maybe, but he has 3,900 with only a singled neg from this clown and he's a powerseller and he gets permanently NARU'd? That's ridiculous, IMO...how do sellers with multiple negs and complaints still able to sell on ebay then? It defies logic!

Neil, this is ridiculous. I'd sue the friggin' bastage for all your lost sales. I'm happy to help you work up a lawsuit if you like.
Incidentally, what is being done concerning the lot of cards he has up for sale? Bill, are you handling that?

Neil try ebay calling again. Maybe the second time will be the charm?

Crazy!
Seems like the more eBay changes, the worse it gets for sellers.

<< <i>how are they able to determine a retaliation when you were outbid? >>
It was the malicious way in which he clicked on the "bid" button. It was this kind of "Ernst Stavro Blofeld"style click. They've got sensors that can read that stuff over at Ebay. You'd better watch it.

This is NOT a scolding, BUT I have no clue what your
thought process was when you did that.
The thing was already being handled, AND it was
"suggested" that you NOT get involved.
...............
We may be able to think of a way out.
Unwelcome Bidding is a VERY serious violation and
is not taken lightly.
Let's think about it for a bit.
Ok neil, let me see if im reading this right? Some nut buys something off of you, give you a neg for it, you bid on something of his,and bill outbids you on it?Wheres the crime? I dont see where you did anything, sure they can imply you was gonna neg him back, but they cant prove it?????? yeah, its implied
Yes I realize I made a mistake, but wrongly believed once I was Outbid it was a non issue. I didn't go and bid again and its been two days, so figured how could I logically be messing with somebody's auction if I didn't win it???
Neil
<< <i>Thats one of the craziest things ive ever heard of ebay doing!!!! >>
/////////////////////////
They do it many time each day.
It is meant to keep bad sellers from retaliating
against ripped buyers who are also sellers.

Yeah, I would appeal on the grounds that the bid was just due to a temporary loss of temper, and use you what you said above as evidence that you had cooled off and decided to take the high road.
///////////////////////////////////////////////////
They really don't want to know that they are thought
to be stupid, so it is best not have that exact chat
with them.
"I did not recognize the seller's name when I placed the bid," is
about as much as you can strain credulity in this defense.
Properly crafted, it might fly IF contrary statements have not
already been issued to the T&S monkeys.

And that's what I'll probably do tomorrow, call my Power Seller rep. But secondary issue is the fact that even if I throw myself at their mercy and and they forgive me, they Poofed 600 Store Listings and I don't even know how many auctions and I can't get any of that back.
Makes me start thinking of other options.
Neil
All of this would never have happened if sellers had even the slightest voice but we don't so sometimes we get frustrated and this type of innocent thing happens.
eBay cannot afford to lose your business, and as stated, your actions did not actually hurt this dude. You'll be fine, might take a couple days, but it will get worked out.

I actually tried that when I spoke to the rep earlier, it didn't fly.
Neil
In the through-the-looking-glass "justice" scheme of EBAY,
"intent" is "proven" by a mere act itself. (Clearly, that is
not what the plain language of the TOS says, in this instance.)
Their standard of "proof" is usually "ever-so slightly more likely than not."
Sometimes they just go arbitrary, and you have as good a chance
of prevailing as losing; whether you are telling the truth or not.
They do tend to think the accused party is lying at the get go,
but can sometimes be converted; depends on the issue.
Lorrie Norrington has PERSONALLY used stories about NARUing
Unwelcome Bidders to calm angry sellers. It's a bad issue to
have to deal with, right now.
"I intended to retaliate, but changed my mind," could win,
but I, personally, would NEVER use it.
It may be the only hope, though.

Unwelcome and Malicious Buying
Sellers may exclude buyers at any time prior to the listing close and are free to cancel unwelcome bids. After a seller has cancelled a bid, the bidder may not place a new bid without the seller's permission. Buyers who do not meet the seller’s terms as outlined in the item listing also are not permitted to bid on or buy the item.
Additionally, members are prohibited from bidding on or purchasing an item to disrupt or to leave non-positive Feedback or Detailed Seller Ratings for the seller, with no intention of completing the transaction.
Sellers are permitted to exclude bidders at any time prior to the listing close and are free to cancel unwelcome bids. After a seller has cancelled a bid, the bidder may not place a new bid without the seller's permission.
Violations of this policy may result in a range of actions, including:
Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
Some Examples
Failure to meet a seller's terms
Examples:
Seller states item will only be shipped domestically. Buyer is registered outside the shipping area.
Seller states that buyers with negative feedback comments are not permitted to bid. The buyer has negative feedback.
Report a buyer who participated in a listing without meeting the listing terms.
Buying with the intent to disrupt a listing Examples:
Buyer places a bid that greatly exceeds the value of the item in order to prevent a sale.
Buyer bids on multiple items listed by a seller without intent to complete the sale.
Buyer attempts to purchase an item after having been placed on a seller's blocked bidder list.
Report a buyer who bid with intent to disrupt a listing.
Note: Buyers who fail to respond or who back out of a transaction do not fall under the Unwelcome Buying policy. These listings should be reported as Unpaid Items.
Additional Information
Preventing Unwelcome Buying
In addition to reporting a user to eBay, there are several steps sellers can take to prevent unwelcome buying including:
Turn on Buyer Requirements to block buyers who don’t meet certain criteria.
Use Immediate Payment Required on Buy It Now and Stores listings.
Place the bidder on a blocked bidder list.
Cancel bids.
Why does eBay have this policy?
This policy is intended to protect the integrity of the eBay marketplace by prohibiting conduct that would interfere with the completion or performance of eBay transactions.
That said, you are obviously a reputable seller and buyer, and I hope you find a way to get reinstated.
I actually had my account suspended about seven years ago. I was lazy and did not pay for a batch of small auctions before I left for vacation. I returned to find 4 NPB's and a suspended account. I made my case to ebay to no avail. But after a few months, one day they just reinstated it when I asked again. It was sort of like - alright, you've served enough time...
I hope you can resolve yours quicker than I did.
/////////////////////////////////////
I am pretty sure that all of us reasonable folks agree with that.
That does not preclude, obvioulsy, trying to figure out ways to
help a member get out of the mess.
.............
Also, the subject buyer/seller is an AH.
I hope he is in for a very interesting future on EBAY.
<< <i>While it is not the popular position on this thread, I understand and agree with both ebay's policy and their action in this case. This was a clear violation of the policy and they really have no choice but to suspend the account.

Well Neil, Matt had to sit in the time out chair for a while, maybe you'll have to do the same, hopefully you can find the right person to anywer the phone who actually wants to help you and isnt there just taking up space, doing nothing, and collecting a paycheck

At the end of the day a single negative would have zero impact on your business since your reputation should stand for itself. Now your actions in violation of eBay policies have cost you your total business (or at least the reputation you have built under your current user name).
Yup.
Sorry this happened to you.

I think Bill is just trying to come up with a way for Neil to save face and get his ebay life back... I think Neil knows what he did was wrong and I'm sure if he could go back he would not place the bid.
This is just further proof that Sellers have no power anymore on ebay!
<< <i>Based on your history of buying random lots, I would use the excuse that you did not even realize it was the same guy. >>
Agreed.
Unfortunately, think this is your only "excuse" that may appeal to eBay.
Sorry this happened to you and best of luck.

Ooooooooooh, that's right. Need more coffee...
If they pulled that on me, I'd take my business elsewhere. There are a number of other avenues on which to sell goods.
