I look at this way if you buy/sell using paypal:
For buyers: Don't buy things with restrictive or conflicting return policies. (or email the seller and ask before buying)
For sellers: Don't have a conflicting return policy, it's similar to letting the seller decide if they want insurance and stating "not insured items are the buyers problem". In either case paypal will refund the full price to the buyer if it gets lost or returned in 7 days.

I also believe if there was any doubt at all the buyer should not have removed the coin, but instead should have contacted the seller and asked for permission to remove the coin, if the seller says No, then just return it. I think the seller seeing that it was repeat customer might have said ok remove the coin for better inspection/maybe not. I also believe it is wrong to accuse the seller of scamming, as someone said before grading is subjective and it is possible to make an honest mistake.
like the Wendys commercial from a long time ago (Where's the Beef) well ( Where's the Link ??) or at least copy the picture and show the pic without revealing the seller. JMHO

Point taken, but we're not exactly talking about deciding 64 vs. 65 here though. According to the OP it was advertised as CH. BU but was actually AU and artificially toned. Such a drastic difference can certainly be told through a clear mylar window with a magnifying glass or loupe without removing it. I'm sure a TPG can get an idea of hinky toning before pulling it from the holder. And remember, the TPG isn't buying the coin with a "you remove it, you own it" codocil. OP was, however...OP even acknowledged same, and decided to flout it anyway.
It's moot though...one way or the other OP will still get his money back.

Okay, you guys are killing me. I have contacted the seller, we talked and there is NO PROBLEM. I told the man I removed the coin and it looked different than it did in the holder. He says " it happens all the time ,no problem " . My money has been refunded and it's over. Have a nice day.

Because this is what this post is about, getting scammed! I'm sure most of you out there think you can tell if a coin is alright looking at it in the holder, and so did I. But now I know better. I guess the part I don't get is where I can order some of these magical holders... I jest. But seriously - I understand the whole thing. This thread started with you wondering what would happen because you omitted the fact that you had broken the sellers terms when you spoke to the seller to return the coin. Then it moved to you taking the moral high ground by considering doing what you should have in the first place. Yes, I understand the situation all too well. Meanwhile what you don't get, and will likely never get, continues to be your inability to accept personal responsibility for the situation you would have found yourself in had the seller stuck to his terms (and more than likely had you not had PayPal to babysit you).
It fascinates me that some people can only ask the question "What did someone else do to me to get me into this situation?" instead of "What did I do to get myself into this situation?". And, it scares the hell out of me to be nearing my 40s and realize just how many more people are like that now, than when I was in my teens.
So... should you ever go scuba diving and have your respirator fail for some unknown reason at 160" you can be content laying at the bottom of the ocean knowing with all certainty it was the manufacturers fault and that you bore no responsibility to test your equipment beforehand. I did that once,but e-mailed the seller to ask if I could remove it from the holder.He reluctantly said yes and I opened the 2x2 and ended up keeping the coin.I'm not sure if you should've opened it without asking first.I suppose you can force him to refund your money the way E-bay operates now,but that don't make it right.
Sorry, you're still missing the bottom line. I hate to say it but I have no sympathy for you. If you don't learn something from this it's likely your next bad experience will be even worse.

Here is the coin. It has been cleaned and played around with. The seller posted this coin for sale as choice bu. Looked that way from his picture and it looked that way in the flip, so I took it out and it looks like this. I don't have the best eyes for this hobby anymore and maybe that's the problem. At any rate I could not see the coin in the right light in the flip and I'm sure you super human coin collectors can, but I missed this one.

coin for sale as choice bu. Looked that way from his picture and it looked that way in the flip, so I took it out and it looks like this. I don't have the best eyes for this hobby anymore and maybe that's the problem. At any rate I could not see the coin in the right light in the flip and I'm sure you super human coin collectors can, but I missed this one.

I see no reason for thinking this way, except to make you look like you were (are) right on moral grounds.
