I dont sell on ebay but have bought a few things, anyway my question is does a seller have the right to charge you 3.5% for using paypal to buy an item from him?

EBay policy forbids this. Though it is often done in BST and other venues as paypal does take quite a chunk away from the seller.

Not only is it against eBay policy, in many states it's also against the law.

Here is the seller's response when I asked him about it:

"YES, THAT IS ONLY IF SOMEONE PUTS IN A LOW OFFER AND I ACCEPT, THAT IS WORKED OUT BETWEEN THEM AND ME IF I ACCEPT THE OFFER. THAT IS..IF YOU PAY FULL ASKING PRICE I CAN'T CHARGE ANY FEE"

PAYPAL AVAILABLE FOR 3.5% ADDITIONAL JUST ASK! THIS IS ONLY IF I ACCEPT LESS THAN MY BUY IT NOW PRICE. IF YOU PAY ASKING PRICE IT DOES NOT APPLY. IF I DID CHARGE THAT ADDITIONAL, IT WOULD BE AGAINST ALLMIGHTY EBAY'S RULES. AND HEAVEN FORBID WE WOULDN'T WANT TO BRAKE ANY EBAY RULES. WE COULD END UP IN EBAY JAIL.... THANKS"

While I do agree with his statement and think people have too much time on their hands to be policing the Internet, he could had spelled some words differently. :-)

Haha, at least he changed his description. He's a Powerseller anyway, I'm sure eBay would have let it slide.

I have a problem with misspellings, also, but spelling has always come easy to me. I know it doesn't for everyone and they do the best they can. However when you made that little critique, you wrote "he could had spelled some words differently." I believe you meant "he could HAVE"? LOL I'm messing with you - sea, it hapens too alot of us!

But I do disagree with him on a couple levels - he could still be spanked by Master feeBay.
