Ebay seller lifts MY photo then apologizes for how "crappy" it is!!!

    Phil, your pictures are....... well....... what can I say? Hmmm, I'd say they're good enough to steal! The collective sense of humor in this forum is one of the things that keeps me coming back.

    Actually that's an excellent picture - your photo skills are never lacking.

    On a side note, the coin he is selling is not a 15th anniversarry panda. It is a standard 1996 issue. There were a limited amount of anniversarry coins made this year, but his is not one of them. >>



    Well, I don't know this series but I asked him about his claim regarding the 15th anniv, I said the book says it's not 15th anniv.... and here is his response:

    sir,i am not sure what book you are referring to,but if you go to the china gold coin inc website,you will indeed see this coin,its description,mintage and facts,also,it was purchased by me here in atlanta in 1996 at southern coin investments,feel free to look them up as well as contact them if you wish!

    He seems to be getting the crap he deserves. I remember is was a stolen photo that I was complaining about that caused bochiman to form his negative opinion of me. I still owned the coins and had them for sale on ebay at the time.

    I have started putting my name on them. I downloaded Photoscape.com at the recommendation of some forum members and it is quick and easy. here is an example I shot this morning in poor light but good enough to get it on ebay:

  • Ok this kinda pertains to this post....

    If I buy a coin from you in an auction and the picture is of the exact coin being sold, would it be permissible for me to copy your picture from the auction to use later on should I decide to sell it? Would I still have to ask you as technically you'll never use it again (unless you say it's a stock photo).

    I have done this once or twice actually but want to follow the "rules"..... image

    It's sort of important to ask permission.

    If you run across the right person...and they find that you are using their pictures for your personal gain...they may not be happy and they may legally desire part of your personal gain.

    Without any sort of evidence that you have permission to use that photo, you are left with weak 'public domain/fair use' arguments which are easily argued down due to the personal gain thing.

    If I sell a coin I would gladly give you the photo but I think legally I still own it so some sellers might not agree. I am always happy for a buyer to save my photo for his personal use.

    But suppose I am selling 100 ASEs with the same photo listing one evey day stating at .99 and one buyer keeps bidding low and wins an occasional one at lower then market price. Then he takes my photo and starts competing against me trying to resell them. I'd have to be in a pretty good mood to say "Sure, go ahead and use my photo". --jerry

  • I would also think that along the lines of who took the photo owns the photo even if the coin is sold. In that case the new owner can take his original photo and own that complete rights to it image

    On a side note the gold panda looks good in pictures. Makes me jealous I dont have a panda army myself.

    No, get it right. It was your method of handling it that I questioned in the thread that caused you to go off on me.
    You were saying that you were going to use one of your other accounts (a buying account) to buy from him and then question if the one you bought was the one in the picture and neg.

    I questioned the method you were using and how you were stating it saying it was likely to get some newbies, around here, in trouble if they went that route because it was against ebay policy and underhanded. That's when you went off.

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    It's a good question....

    If I like the photo, I ask, after winning, if I can have the photo as well. I always copy it local anyway, but I do that for my own personal use until I can take my own. Some folks take just as good, or better, and so I may want it later so I ask. I have never had a seller say no and I have had sellers send me extra photos they have of the coins that never were used on ebay.

    Always pays to treat sellers as you would want to be treated in their place.

    I reported him for a misleading title. Yep, I see that the 15th anniversary 1996 issue is a different coin selling for a much higher price.

    The images are correct. It is a minor point. The auction is mostly okay now, but "15th anniversary" is in that title.

    And I feel like venting some frustration. So I put on my thought police cap and reported it. Not something that I would normally do. But I have an evil itch right now and I scratched it.

    Does it make me feel better? I don't know. I don't think so. In fact, i'm pretty sure it simply perpetuates bad feelings.

    What I really need to do is take photos of my backlog of newps and post them here today. But i'm a lazy sod.

    The item has been relisted as a one day auction.

    It still says "15th Anniversary" in the title which is misleading to someone who is actually looking for a 15th Anniversary edition, which this item is not.

    Also, it is a one day listing, probably to get 'under the wire' of the scrutiny of numismatists.

    And, the initial listing price is $26 higher than the previous listing. The seller is angry.

    To answer this question...I think that Gecko is interested in Pandas. He buys and sells them. It does not take long to search all of eBay for all pandas. He ran across a picture of his in someone elses auction. Personally, if I were to see my picture in another person's auction, I would also be able to recognize it immediately.

    I don't think this is a matter of someone spending all of their time looking for eBay violations. But...

    On the other hand, i'm sure there _are_ folks that spend all of their time looking through eBay auctions or other venues. I know i've gone through phases where I spend too much time searching for stuff. It's just that the goal is not to look for stolen photos. The goal is to seek out cool stuff to buy. If you happen to run across your own photo in the process...well...
