Paypal Dispute

OK guys...help me out here.

I sold a 67 butkus rookie on ebay 3/18; buyer paid via paypal 3/23. I shipped 3/24; have PO receipt showing buyers city/state and zip.

I received dispute tonight(4/18) saying card was never rec'd. No previous contact from buyer. Uncomfirmed address in paypal. My ad clearly states: No Refunds unless buyer purchases nsurance.

What do you think?

    Sadly, you have a losing lottery ticket.

    No hope for you to prevail; unless the card shows up.

    "Insurance" is to protect the seller, NOT the buyer in a PayPal transaction.

    PO receipts don't fly with PP. They want DC or SigCon.

    Shipping to non-con addys is an ivite to INR claims, unless you are a
    PSer; in which case you would be covered on that front, IF you had
    DC.

    Absolutely none of that information is necessary. The OP has provided all of the necessary information and it unfortunately sounds like he's out of luck here. Always use Delivery Confirmation ... or Signature Confirmation for anything over $200.

    Original poster. Unfortunately, there are buyers who will use unconfirmed addresses to scam honest sellers. Hopefully,you pulled your money out of Paypal and have nothing coming in...let them turn your account negative and try to collect, those dirtbags.

  • I just thought it was another one of those $1 cards were this whole thing shouldn't trag on for that low, but $56 is a pretty big deal for you to lose.

    Like others have already said, its hard, but hope everything works out for you.

  • Well, this isn't what I wanted to hear, but thanks to all of you for the info. As you might guess, I am a relatively new Ebayer...used to do shows on wekends from 83-98...didn't do anything for almost ten years...had been having a blast with the ebay since early March; not a lot of $$$, but a ton of fun. Listing about 20 cards a week, If Paypal does hit my account for the $$$$(sounds like a certainty from your replies)it will leave a sour taste, but it won't deter me from selling. It's too much fun, and it gives me some money to buy stuff I want. (Heritage, Heritage and more Heritage!! Oh and vintage also...mostly 60's baseball and football.

    I'll try and use the negative experience to make me a smarter seller. So, the two lessons here are: don't ship to an unconfirmed address and always use DC? Any other advice?

    Will Paypal at least refund the fee they took out of the original sale..seems like the least they can do since they allow a customer to list with an unconfirmed address. It isn't the 1.50 or 2>00, it's more the principal.

    If anyones feeling real sympathetic, my Ebay seller name is Ballfan2007...have a look!! (<:

    Go to the PayPal site.

    Read and Understand the terms/conditions attendant to BOTH
    buyer-protection and seller-protection.

    Follow the rules.

    Insure items you sell via PayPal, unless you are prepared to
    lose money.

  • Grote- this is clearly not Paypals fault the seller did not follow the Paypal rules for protection and will get burned.

    OP-You took Paypal their rules trump anything in your auction about not being responsible for uninsured mail. My favorite question on things like that is what if the buyer purchases insurance the item gets damamged in shipping and the USPS refuses to pay.

    I agree with that statement. Though I will no longer accept paypal as a payment option for high-end items (over $500) and have not noticed any significant difference with those auctions so far, though I haven't had that many. I've heard too many horror stories about sellers who DID follow all the rules only to get whacked by Paypal because the credit card used for payment was "stolen" or the buyer called the CC to dispute the charge. In that case, Paypal is obligated to honor the CC directive and will debit your account even if you follow the rules.

    If ALL of the PP-rules are followed by the seller, the ONLY CC-chargeback
    that PP cannot defend against is a SNAD claim. That is the glaring hole in
    the "seller-protection" scheme.

    PP defends:

    1. Claims of lost/stolen CC.
    2. Claims of INR.

    Provided the seller has followed ALL of the rules, those claims will not
    be excluded from PP seller-protection.

    In reality, a seller's private merchant-account exposes him to at least
    as much risk as does PP.

    If I take a stolen CC over the counter, my merchant accounts provide
    limited protection. If I have too many such incidents, my MAs will be
    taken away.

  • Well guys..this story has a happy ending after all. I called Paypal Cust. Serv. since the only three options in their request for information were: Offer Full Refund, I have Confirmation of delivery(which I didn't) or a full refund has already been made. Since I didn't like any of those options, I called Paypal Cust. Serv. and a very nice agent by the name of Jeff provided me with the Resolution at Paypal.com email address to state my case. I did, sent it in and this morning when I checked my email, I have a note from Paypal saying thebuyer contacted them and stated "theire was an amicable settlement" and he was withdrawing his claim/dispute and the case is now closed. I called Paypal tonight to see if they could tell me any additional detail...like, the buyer located the card...the buyer had previously made similar claims 4 times in the past 6 months....any detail that might explain why all of a sudden the case was closed. The customer service person...another very competent sounding young man by the name of Erin; couldn't provide any add'l detail. So I'm still curious at to what sudenly happened, but at least I didn't get hit for the $60.

    I think you're about to get 'Midnight Expressed'.
  • He either got the card just late. Or got scared when Paypal contacted him and dropped the case.

    It may be possible that he filed on the wrong card too.

    It does not matter what Paypal sent you to do they would have only accepted one of those three options and without DC you would have been SOL no matter on anything else. I have seen scammers leave positive feedback saying the item was great or whatever or even send an email saying they recieve it and Paypal will still refund when they file a SNAD.

    I had a buyer a few years ago that sent me an item claiming he never recieved it. I replied well the DC shows it was recieved on such and such day. His response was there is no way you could have that since DC was not on the package. My reply to that was how would you know there was no DC on it if you did not recieve it. He replied "OH, my bad..."
