Wrong card sent w/pics Update contacted seller
I bought a card on ebay and the seller shipped a different card..well same card...worse centering and different cert. I want to save the page and the picture to my hard drive for evidence in case he removes picture

I know- same here BUT occasionaly I do read the "Card pictured is exact card your bidding on" in the auction- Im sure it was a mistake Ryan but I wouldnt put it pass someone to tell you "Oh that was just a stock photo" Maybe Im looking into it too much, obviously I hope AND think this will be worked out just fine. LMK more details when you get them..

Ahh man. The whole reason pictures are posted is to give you the ability to see what you are buying. That is so weak if we are getting to the point that we are bidding on items that are not actually pictured and sellers can get away with stating that they did not say that you were bidding on the actual card shown.

Agreed! Im not saying this is/was the case, I just thought it could be something the seller could throw at him- I think Storm888 cleared that theory wrong-I didnt know either way.
But Like Ryan and I discussed, lets allow Ryan to contact the guy first, it could just be a honest mistake, no need to sound the alarms just yet.

Unless the guy specifically states in the auction that the card is a "sample" and not the card one may get? He's selling the card in the auction.
Hopefully he mixed them up - and obviously no one would pay full book for that card.
I'm willing to bet the guy does the right thing and ships you the correct card. Has a good FB rating.

Seller said that he used the wrong picture...that of a card that he has already sold. He said that he will refund my money if I send the card back. I replied that I would send the card back AFTER I receive the refund. Oh well. Probably an honest mistake..Now the question is, do I give him a negative or neutral feedback for this? I have never given anything but a positive in over 300 ebay transactions, but a heads up to others that it could happen again might be warrented. hmmm???

The guy had the money AND the card before he shipped.
Buyer-imposed roadblocks to refunds from honest sellers are usually not productive.
If I thought it was "an honest mistake," I would NEVER contemplate leaving a NEG.
If a seller does what the buyer expects - in this case issue a refund - the only correct
FB is a POSITIVE.

By the way:
Under the May FB changes, neutrals will essentially be calculated, for
percentage purposes, as NEGs.
ALSO, everbody who has been selling to repeat customers for a while
is in for a pleasant surprise. ALL repeat-buyer positives left since 1996
will be ADDED to your total positive count. This could give some sellers
a bunch of extra points.

After I got my refund I would leave NO feedback.
If I did leave feedback (and I wanted to leave a NEG) I'd leave it after I got my refund and
in this case I'd say " sent different card (lower quality) then what was pictured'
Under no circumstances would I leave a Neutral feedback. (maybe if he had left one or a Positive first)

I should have been more CLEAR.
As winpitcher noted, leaving NO FB is also just fine in such a circumstance.
1. I would trust what the seller said - mistakes do happen.
2. Send the card back with delivery confirmation (my hope is you paid with a credit card so you have some recourse if things go bad).
3. Leave positive feedback is all goes smoothly or leave no feedback. (as a seller that made a mistake I would leave positive feedback immediately after I received the card)
4. If there is any delay, seller bs or problems then ignore all of the above. An honest mistake should have the seller bending over backwards to make it right. Anything goofy then I'm not naive anymore, the seller is up to no good.
5. Run everything through ebay and your credit card company.

Always ask before you bid if the card pictured is the card you will get, so we can stop these sellers from doing this. This happened to me too, with an autograph so you can tell the difference with the autos. Of course he gave me the story that he no longer has that card, sold it months ago, and how funny it was because they card he scanned is the card he sent me, YEAH RIGHT!!!!!!
So, always email first, so we can put an end to these
Good luck with that, and hope he does the right thing, but I really don't think he will, just be careful next time. Its not your fault but better safe than sorry in the future.

I call the seller long distance on my dime, and explain what happened. He says that he doesn't know what happened for sure, but he thinks his wife must have put the wrong card in the package. After further discusion, he tells me that maybe his wife used the wrong scan. He then says he will check with her, but he will refund my money. I say thank you.....no accusations..no screaming or yelling. I get an email from him today saying that his wife did use the wrong scan and that I need to mail him the card and then he will send out a refund. I am sorry but the onus is on the seller. I did EVERYTHING the "right" way. I paid within minutes of auction end...I have proven to be trustworthy. The seller has, in my opinion, the obligation to refund me first to demonstrate "good faith" and honesty. He was the one who errored....honest mistake or not...he errored. How do I know that I will ever see my refund? When I get my money back, I will return the card. In regards to feedback, if he refunds my money.....I am OK with it and will leave no feedback. I just hope there wasn't 50 other buyers before me who decided that it was an honest mistake and ddint give a heads up. >>

If you bought something from Sears and it was broke or whatever do you think that they would refund you before you brought it back?
The way it works is the buyer returns the merchandise and the seller refunds the dough.
If anything you should demand the shipping both ways, that I could agree with you for.
Send the guy his card and get your refund, by sticking to your guns you will lose out.

What recourse do I have if I send the card back and never get the refund? Sears is a well known, respected company that for the most part can be trusted to do whats right. I don't know this seller if I was standing next to him.....he has screwed me once already...what do they say about screw me twice?

True Perk. In that scenerio atleast he (the OP) would still have the card that was sent and could try to list it and recoup some of his loss.....instead of possibly being out everything.
I'd also like to know if this was paid for via PP? I'd open a dispute for "Item not as described". I'm sure this was thought of already.

Collecting 1970s Topps baseball wax, rack and cello packs, as well as PCGS graded Half Cents, Large Cents, Two Cent pieces and Three Cent Silver pieces.
Stick to his guns...as in....do not just ship the card back and "hope" for a refund. Do whatever he has to do to ensure his protection....i.e PayPal dispute....if in fact PayPal was used.
I thought I was rather clear. Next time I'll take the time to spell things out slower as to not confuse anyone.

NO seller in his right mind is going to refund money to a buyer he does not know,
UNTIL the merch is back in that seller's hands.
The smart play, if the seller is not trusted, is to file a SNAD with PP. Eventually,
when PP decides in the buyer's favor, PP will instruct the buyer to mail the card
back to the seller. When the seller acknowledges receipt - or the buyer furnishes
PP with the onlice DC - PP will issue a refund.
IF I was the buyer, I would cut PP out of the deal and mail the junk card back
to the seller, with Sig-Con. There is a 50/50 chance that the seller would immediately
issue a refund. (No refund? I SNAD the seller and use my Sig-Con ticket as proof
the item was returned.)
The ONLY argument that really exists here is "who should pay the return postage
on the item?" The seller SHOULD, but he may well balk. If he does, just file a SNAD;
OR, eat the postage and get a likely more rapid refund than PP will facilitate.
On the collectibes-side of my EBAY sales activities, I am as straight as anybody here, BUT
I would not issue a refund to a stranger on invisible merch. I do not know ANY sellers who
would do that.
As previously noted, before the seller shipped the merch, he had BOTH the cash and the stash.
PP will insist that the seller gets the card back, BEFORE a refund is issued.
Making molehills into mountains on principle is a wasteful errand.
