Pretty sick ebay predicament....

OK, so I bid on a bunch of 61-62 Fleer basketball today and got many of them at a great price. I'm getting the following messages now, a few hours after the auctions ended:

Dear feartheterps,


We are contacting you about the following item: 1961 fleer rudy larusso IA psa 7 (#140221260459)

The seller, 61fleerfan tells us you have mutually agreed not to complete the transaction (e.g. because you returned or are returning the item for a refund or because there was a misunderstanding) and has requested a credit for their eBay fees.

Please respond by Apr-14-2008 so eBay knows whether you have made this agreement.

Please note: Both you and the seller will still be able to leave feedback for each other regarding this transaction.

So I email the guy and ask what's the deal, this is his response:

"first off i want to apoloigize. but my son listed these items without my permisssion as they belong to me...im so sorry but im trying to get ahold of everyone as i have just found out. please be understanding to this matter as i was unaware, please accept this offer if you would be so kind, thanx 61fleerfan"



I don't believe this for a second, but I suppose there's a small chance it could be true. I really don't want to let him off the hook because I want the cards and I feel he's not happy with the final prices so he's cancelling everything. What would you do? Keep in mind these are not cards that show up often, and when they do they sell for about 40% more than I got them for. 10 cards total.

    If they were really listed in error, then he would've known about the listings sooner (especially if he e-mailed you within hours of the auction ending)

    He's giving you a story about this because he wanted the cards to sell for more.

    Dispute this to the end Lee.

    Reminds me of the time my brother listed my Unitas rookie and 2 identical Namath rookies that don't exist.

    This situation always sucks because you can dispute all you want, but it comes down to the fact he has the cards and there is not a lot you can do to force him to ship them to you.

    In reality though, if he doesn't want to send the cards, he not gonna do it.. Your just gonna have to neg him and move on.

    I sure would not mutually agree to cancel it.. The problem is he has the cards and if he does not want to ge through he will not. But don't agree so he has to pay Ebay for the error.

    I emailed a few of the other buyers asking if they'd received the same message, and one guy said he did and was wondering what was up because he'd already asked whether he could bid from Canada 2 days ago and the seller answered yes. He probably won't send the cards, but I want to pay for them anyway if I have a 100% guarantee of getting the money back. Should I use my paypal balance or a credit card?

    Sounds like he is probably lying. However, I think the problem is that no matter how much you fight he just won't send the cards. Sounds like he will take the neg. Sucks. Too bad there are so many people like this clown out there. Keep us posted.

    He is likely not telling the truth.

    BUT, he will simply refund any payment you make, and he won't send the cards.

    If you feel you must pay, do a PayPal via credit-card; just for double protection.

    I would email him and be truthful, telling him the numerous reasons why you don't believe him. Then tell him you are paying for the auctions and expect him to complete his end of the transaction. You will either A: get the cards shipped to you, or B: open a paypal dispute and win your case, and receive one of those free paypal certificates they've been handing out lately for buyers having to go through the dispute process.

Not to be harsh, but a lot of the cards sold for lower than market value and I think you're trying to cancel the auctions after the fact because the prices aren't to your liking. Another of your winning bidders told me he sent you a message 2 days ago and it was answered by you, so you would've known about these auctions well before they ended. You would've received emails when the auctions started and when people asked questions, yet you claim you first became aware a few hours after they all ended. That just doesn't make sense to me. I will be paypalling payment to you and expect you to hold up your end of the bargain. You can't just cancel auctions after they end because you don't like the prices. That's the risk you run when you put stuff up for auction. If I had bid twice as much and won, you wouldn't let me cancel my bids after the auctions ended. Also, I posted this situation on the PSA forums and everybody there pretty much agrees with me. Sorry"

    Good move, contacting others, think you got him there. Would have possibly done it if he contacted me first and not ebay. Bottom line though, probably wont send them, at least make him pay fees.

    "listen to me sir, i could not have responded to anyones questions, i have been out of town for the past 4 days! i came home just today to find that my entire collection was up for sale. if you do not believe me then i dont know what to say or care for that matter, allthough i would like to say sorry for your trouble and time. i called my wife and had her cancel the paypal account, your transaction will be pending and ultimately fail due to the account no longer existing. now if you could please be a bit more understanding and agree to the mutual cancellation as i will be having my wife write email to all you folks, but ill be damned if any of these cards leave my collection!"

    I rarely do auctions. BINs are my deal.

    I use reserves, when I do an auction of a good item.

    I am not willing to give stuff away, and I do not want to
    help drive prices into the dirt by allowing a crashing
    market to work its magic.

    If I cannot get what I want for stuff, there is no point
    in selling it. Sadly - and happily - lots of folks have to
    sell stuff, no matter what they can get.

    This might be a stupid question, but how do I pay with a creditcard? When I go to pay for the auctions I only have the option to pay with my paypal balance or an echeck. I have two valid CCs on file. Any help would be appreciated.

    Don't agree to the mutual. He will have to eat the fees.

    Trade NEGs, if that works for you.

    I see that Anthony (Griffins) won a few of those cards too. I would PM him and see if he received the same emails about canceling.

    Also, I would try to contact bidders of cards that got higher prices than usual such as this one. If he contacted winners of cards that sold higher than expected then who knows what to think.

    Edited to add: This card also sold higher than usual to the same bidder (rocketeer71) as the other link I provided. I would definitely contact him and see if he got emails like you did.

    Several buyers have told me that, lately.

    EBAY fees on sure-pay thru PP, hit the account in this order:

    1. PP balance

    2. Linked checking account.

    3. Credit Card.

    PP says, " If you want to pay EBAY fees via CC, send the PP balance to the CA and select credit-card option when paying."

    (Which makes no sense since the checking account is # 2 in line.)

    I haven't bought anything expensive for a while, so I have just used the PP balance for tiny purchases.

    There used to be an option you could check to use the CC, even if the PP was loaded. Maybe not anymore???

    Sadly, this is the reality of it. ^^ The seller should buck up and come through, but money does funny things to people. I never understand sellers who are too cheap to set a reserve, but want to back out when they do not get what they want out of their cards.

    To pay with the credit card you should be able to go to the "back up funding source" after you log into paypal and are ready to pay. Hope that helps ya......

    Who- his kid? cancelled 6 cards on April 2nd and relisted them along with all the others? Fishy it appears he has only been a buyer in the past. I call sellers remorse..............

    No Geordie, I have more than that in there but thanks for the offer. His PP is closed anyway, so there's not much I can do but neg him and mentally beat him down with a logic-built argument as to why people like him are the downfall of society, thereby creating a shame cycle that will slowly eat away at his mind and result in him slumping into a deep depression that leaves him no other option than to walk off a cliff.

    by folks who use it regularly.

    In an EBAY survey last month, one of the questions was:

    "When you use live help, does it seem like you are talking to a real person?"

    I have OFTEN thought I was typing to a machine. I have noticed that phrases

    I guess the great deal isn't done until you get the cards in hand. Neg's are in order, but why bother sending the payment? What if he really messes with you by sending a package full insured, with DC and it's a bunch of commons or better yet, nothing at all but old newspapers. He would get to keep "your" cards and "your" money.
    Running an Ebay store sure takes a lot more time than a person would think!

    if he was on the level, he would have contacted you before he filed as mutually withdrawn i would think. i would give him 1 neg for each transaction. those 10 negs should certainly be a large red flag for future customers. also, since he wants to keep the cards, he can simply pay you the difference of your idea of the market value and what they actually sold for. he can therefore just cut you a check and keep his cards. i know you want the cards themselves, but thats not going to happen. maybe you can get financial compensation for your inconvenience. his son can pay him back. just a thought.

    I got the same message today on the 3 cards I won. The prices were fair, nothing special, and certainly not enough to cancel the sale.
    I refused to withdraw the transaction. He lives about 10 miles from me, perhaps a phone call will work.
    This bites. I just won a paypal dispute with some jacknut last week over a $6 card I never got and was sent without any tracking, and now the guy is sending a stream of nasty emails. Why are people getting so nuts all of a sudden, and on relatively inexpensive items?

    CD: neg his butt , what a jerk, he should have put a reserve on the items or a high opening bid.
    PS please bid on my auctions and whatever u win as long as I get paid u will get the item (well maybe) as long as I can find the post office .
