He is a member on another site where I am a MOD, and I contacted him through there but have not heard back from him yet. I already reported the item.....I figure if he doesn't respond to me in a few hours....I will be right there in line with everyone else ready to mess with him.

This is just like the guy who got busted for selling pictures of toasters on Ebay a few years ago.....it made it all the way to Judge Judy.....and let's just say she wasn't have a "nice day"

I just reported it along with this TOM BRADY 2000 FLEER AUTOGRPAHICS #17 auction as well.

Seems that this person (and I use the term very loosely) is trying the same thing but when putting the auction up forgot to change the fine print and it says you are bidding on a picture of the adrian peterson card but I have no doubt that if somone wins this they will get a picture as well.

THIS WITH BECOME A HOT COMMODITY AND PEOPLE WILL BE SURE ENOUGH TO PUT FORTH THE MONEY TO BUY THIS SWEET PIECE OF ART!

A Debbie told me they were looking into it and rather than keep me on hold that I was to be assured that something is going to be done.

he put the disclaimer, YOU ARE BIDDING ON A PICTURE OF THE CARD" in caps this time in the body of the description instead of the micro fine print. If that's all it takes to get ebay off your back, then forget about selling baseball cards and sell some pictures of a Porsche Carrera GT or a Bugatti Veyron 16.4 for some big bucks.

Unfortunately, this scam has been used frequently. I can't believe ebay does not have a specific policy about selling photos of cards by now or at the very least, require this type of auction to state the fact in the headline, not the fine print.

I spoke too quick. It looks like they removed the item again. But I still ask the same question, "How many times is eBay going to let him get away with this?" It seems like after the second time they would just go ahead and kick him out, but they haven't.

good question. I have seen this scam for other items such as autographs. You would think hundreds, if not thousands of people have been burned. Ebay's feedback system is so pathetic given the threat of retaliation, that these sellers ratings don't truly reflect the depth of the problem. So, unless they implement a "rule" about this, post the fact in the headline for example, it will continue.

BTW, great job to all the folks who took the time to report this scum. Thank you for taking the time.

told them at 6 am this morning that they should contact the winning bidder to tell him to to pay if he hasn't already.
Private auctions on ebay should not be allowed

Private auctions have no place on ebay, I agree. No way to warn the buyer. This is exactly why these unscrupulous jerks use this method.

Zep, it's almost comical to read your ebay transcript. It's like these guys are coached by attorneys and have standard responses. In the mantime, these buyers are getting screwed because the sellers know nothing is going to happen to them. The legal issue is worth exploring and that is if the nature of the item is disclosed somewhere in the description, is it really fraud? Can you imagine getting a flyer from Best Buy for an online offer only for a $2000 72" plasma screen and in the fine print it says you're getting a picture of the actual item? How long would that last? EBAY hides behind the mantra of them simply being a "marketplace, not a retailer". And, if this changes, ebay will disappear because the costs associated with the number of people they would need to scrutinize auctions would go through the roof, literally. It's a catch 22 to be honest. The only approach that would work would be to disallow private auctions so that unwitting buyers could be informed.
