Someone turned me in to beckett......

    I just received a message from PETA stating the egg in my avatar is offensive. The poor little chick looking in horror at its little sibling chicken embryos, fresh from a sizzling hot buttery skillet...mmmm. Nevermind, I just lost my train of thought. Now I'm hungry.

    I think the big picture here is that BGS/Beckett must be in some serious trouble. Why else would they care what a nobody like you (or me) says?

    Okay, it's a slow evening ... well, at least for me. So just to humor myself, I did some digging. Trademarks are issued by the United States Patent and Trademark Office. Thus, we have federal jurisdiction. However, we may also have state jurisdiction under state common law. Searches for trademarks on the USPTO's website can be performed here:

    I typed in Beckett and found a couple of live registrations. But that's not important. The relevant statutes for trademark infringement are 15 U.S.C. § 1114(1) (Trademark Infringement), 15 U.S.C. § 1125(a) (False Designation of Origin, Unfair Competition) and 15 U.S.C. § 1125(d) (Cyberpiracy Prevention).

    Section 1114(1) provides:

    Any person who shall, without the consent of the registrant—

    (a) use in commerce any reproduction, counterfeit, copy, or colorable imitation of a registered mark in connection with the sale, offering for sale, distribution, or advertising of any goods or services on or in connection with which such use is likely to cause confusion, or to cause mistake, or to deceive; or

    (b) reproduce, counterfeit, copy, or colorably imitate a registered mark and apply such reproduction, counterfeit, copy, or colorable imitation to labels, signs, prints, packages, wrappers, receptacles or advertisements intended to be used in commerce upon or in connection with the sale, offering for sale, distribution, or advertising of goods or services on or in connection with which such use is likely to cause confusion, or to cause mistake, or to deceive,

    shall be liable in a civil action ...

    Section 1125(a) provides:

    Any person who, on or in connection with any goods or services, or any container for goods, uses in commerce any word, term, name, symbol, or device, or any combination thereof, or any false designation of origin, false or misleading description of fact, or false or misleading representation of fact, which—

    (A) is likely to cause confusion, or to cause mistake, or to deceive as to the affiliation, connection, or association of such person with another person, or as to the origin, sponsorship, or approval of his or her goods, services, or commercial activities by another person, or

    (B) in commercial advertising or promotion, misrepresents the nature, characteristics, qualities, or geographic origin of his or her or another person’s goods, services, or commercial activities,

    shall be liable in a civil action by any person who believes that he or she is or is likely to be damaged by such act.

    Section 1125(d) provides:

    A person shall be liable in a civil action by the owner of a mark, including a personal name which is protected as a mark under this section, if, without regard to the goods or services of the parties, that person— has a bad faith intent to profit from that mark ...

    So let's look at each one. Section 1114(a) appears inapplicable because lawnmower man, in using the Beckett Trademark, does not appear to be selling any goods or services. He is used it in his signature line. Additionally, does a message board constitute “commerce”? Section 1125(a) also appears inapplicable because, again, lawnmowerman is not using the Beckett Trademark in connection with any good or service, much less “in commerce.” Finally, Section 1125(d) appears inapplicable because lawnmowerman does not appear to have a “bad faith intent” to profit from the mark. I question whether lawnmowerman has ANY intent to profit from the mark, much less a bad faith one.

    Then again, I could be 100% incorrect as my focus is strictly on civil litigation and transactional law!

    You're probably right, but businesses don't like to admit they made mistakes (i.e., carol has already stated she will kick off anyone who uses the BGS trademark; she would never admit she was wrong). Assuming you're right, it still has no bearing on this situation.

    So... is is allowed to add an 'S' after the 'B' in the logo, and replace 'ECKE' at the top with 'ULLSHI'? Anyone know how to use photoshop?
