Let's be generous and say his postage and his TL + envelope cost 59-cents.
That left him with $3.40 to cover the "H part" of his S&H fee.
That is a very long way from "fraud." It is likely considered, by many of us, to be excessive; EBAY would not see it as excessive.
"H" is supposed to be built into the price of the item. Just like they do it at any retail store. But, that is not how the pricing structure is set-up on EBAY. Sellers have simply come to expect S&H to be a profit-center.

Where does the seller express his dismay at the unprotected nature of the shipment? Implied, maybe, but not clearly stated. And since when is $3 considered gouging? Maybe in the world of sidewalk lemonade stands, but not here IMO. He basically threatens the seller with a neg and accuses him of mail fraud which is ludicrous, not to mention legally without merit. I mean, we're talking a few bucks here, hardly ebay seller "hall of shame" material and nothing ebay is going to waste time on.
Buyers and sellers should communicate respectfully to each other. This was not done by either party ergo no negs deserved by either party.

I tried selling a little bit on ebay before. It sucks. I don't envy full-time sellers on ebay as they are doing a job I would not want to do. I've got absolutely no problem with anyone pocketing a couple bucks in handling off me as long as the following occur:
1.) The S/H price is stated in the auction
2.) The card arrives as described
3.) The card arrives in a reasonable amount of time
Maybe I just didn't know what I was doing when I sold (likely) but if people out there are selling 20-50 items a week then there is a large amount of work that goes into that which often doesn't get rewarded, be it monetarily or just in thankful recognition. There's a reason I don't sell anything on ebay anymore and I've got no problem coughing up a few bucks to keep the good sellers there.
That being said, the scumbag sellers can all burn in hell.
Mreuter, I would be pissed too. After you contacted the seller (because that's what you SHOULD do before blasting him with a NEG), I would leave either a Neutral or even a Positive Feedback, stating: "I got the card, but seller charged $3.99 for a unprotected envelope and a $0.39 stamp... and I'm not a freak."
That at least warns future business to consider the sellers shipping methods.
I am torn as I understand the over charging for shipping and I do not purchase from those I feel are inflating the price. I also understand the risk that if I bid on ONE CARD and the shipping is over .39 cents I might be covering the fees he will be paying. It is a fact of ebay. However as long as you got the card in the condition promised it was a good transaction.
If you got the card in white envelope and it was all torn then I would say HEY I paid you $3 for shipping and now I have a torn up card becasue you went cheap.
In the end it is Shipping and Handling. He spend .39 + envelope on shipping the rest went to 'handling'. Leave positive feedback with the shipping notice and enjoy your card.
