Do I neg a seller on the Bay?

I have never given a negative to a seller before. I'm not sure if I am justified in this situation or not. I bought a
MS65 DMPL PCGS from a seller. He clearly states he doesn't have a return policy. He provided some pretty lousy
pictures and the coin arrived yesterday. The first thing that hits you is this big brown ugly mark around 4:00
on the obverse. Otherwise the coin looks great. I nicely emailed the seller and told him I was unhappy with
the coin and that I thought he didn't accurately describe the coin and I would like a refund. He basically told
me that I'm sh-t out of luck. I today sent him an email telling him I was unhappy with his decision, I thought
he did not accurately describe and photo the coin and I asked him to reconsider. I also told him that I would
hate for his 100% feedback to be threatened. I have never had this problem before and the few times
when sellers do not have a return policy they have always returned coins anyway. I normally don't buy from
sellers who don't have return policies but for whatever reason I purchased a coin from him. What do you all think?

I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

You should not have bid in the first place. Why didn't you ask for better pics?
Did he leave feedback for you already? If so, jump right in. If not, you know you'll get a neg back.

Sounds like you've bought from sellers that have a no return policy and returned items more than once.
He clearly stated no returns. You bid. You won. I don't care if they were the worst pictures in the world, if you don't like his terms - Don't Bid!
Take responsibility for your actions.

Does it matter that the seller didn't adequately describe the coin? What's YOUR eBay handle?

Even with the crappy photos the brown mark at 4:00 is pretty visible.
(Of course I say this AFTER you pointed it out)

skier07 is asking a honest question for a real dilema he has, you don't havge to be a jerk about it. All you have to say is that you don't think he should leave a neg and then state your reason in a constructive manner. Don't be a pain
Why step over the dollar to get to the cent? Because it's a 55DDO.
No return policy you just gotta take your chances and on this one you lost.
Judging or grading coins from photographs is frequently discussed on this forum and I think the consensus is that it is very difficult to do. Especially with all the tools that are out there to make a coin look much better than it really is.
If the auction link above is the correct link then that big ugly brown mark you describe is right there in his photo. You got a reasonable price and instead of negging your seller, you might want to consider a PCGS spot review. Maybe you can recover some of your costs or maybe PCGS can clean that spot up.
At any rate, a neg is pretty much uncalled for in this particular scenario.

Do you have a good picture of the coin that shows the ugly brown spot?
If you were selling the coin what would you have added to the description that would
make you feel it was accurately described?
I agree that is odd that the picture of the Label looks REALLY good..and the others are
pretty lousy.
Personally I wouldn't neg him...I would realize I took a chance (based upon the lousy pictures) and
move on. Lesson learned.

Flying Eagle that's pretty harsh. I do not plan on blocking him for an honest question. And if you got a coin for nearly $600, and the photos showed the spots, what would you do??????????
It's pretty damn crappy to have an auction without a return, what ever happened to customer service. I would NEVER have an auction without full money back return. I am not out to screw folks on Ebay, you need to run an honest business.
Skier07 this is also some learning for you. If it has crappy pictures and a no return, just don't bid. Or ask for better pictures.

I haven't looked carefully enough to see if this is the case or not but I'd probably only neg him if you are sure the photo was doctored in that area to hide the spot. I wouldn't neg him for a photo that was just bad overall. He had a clearly stated policy and it is a PCGS 1881-S MS65DMPL. You bid on it knowing the return policy and photos. For sight-unseen situations where I'm uncertain with the photo, I'll ask the seller for better photos beforehand.

I agree. To me, it LOOKS like a doctored image, but without seeing the actual coin I can't say -- maybe the picture was just funky. If -- and I mean IF -- the image was clearly doctored I'd raise some hell. But if it looks substantially like the image, I can see brown crud clearly from even a bad image and that would have been enough to keep me away.
In my opinion, the best recourse would be to ship the coin to PCGS and ask if they might be able to remove the grease stain. If they can, you may end up a big winner on the coin. Of course, it would have been nice if the seller took the coin back, too, but it appears that is not a priority for them.

I have to agree with CarsonCityGold on this. Sounds like, by your own words, you are a repeat ignorer of terms. And notwithstanding the rest of it, casts doubt on your role in this, not the seller's. Now that you've had a seller mean what they say, you might not do this again. No neg, obviously.

True. But nothing has been misrepresented unless the picture was clearly doctored to hide most of the problem.
And unless we can see a picture of what the coin really looks like compared to the image, there's no way to tell if there was an intentional misrepresentation by image doctoring. If the coin looks substantially like the image, it's a "caveat emptor" moment though it's another reminder of the danger of buying from someone with an "all sales final" policy. I'd prefer to pay a little more from someone who stands behind their coins and doesn't play those games.
Do the world a favor and Neg him, knowing you wil get one as well, just roll with it you will do everyone a service.

It is a PCGS graded coin. The seller clearly stated the conditions of the auction with no implied GUARANTEE of Satisfaction. I think he deserves at least "NO FEEDBACK" than to Neg him. In spite of his attitude, it's pretty clear from the link that you entered into HIS territory and you are the WINNER.

I think you've got your answer by now. When I'm interested in one of these crappy pics listings, but it's TPG certified, I download the pics and brighten them up for better examination.

That just about sums it up, now doesn't it? At this point your recourse is to call Customer Service and to send it in for what is called a "spot review" and you will be made whole by PCGS.
Sorry, no negative involved. YOU entered into a contractual agreement with this seller thereby accepting HIS auction guidelines.
YES, he may be foul mouthed and is lacking in certain people skills BUT you agreed to the terms when you placed the winning bid.
He does not deserve a negative as he has held up his end of the bargain to the letter.
Good Luck. Call Customer Service, get a submission form, enter the coin info and on the top right encircle the words "Spot Review" which IS a FREE Service and send the coin to PCGS.
At this point, the above IS your only recourse and whether or not you'd like to or want to neg him is another matter which is strictly personal but I feel is WRONG! (JMHO)
If the link is correct - he took photos of the coin that he knew wasn't showing any problems, you can't make anything out. However, look how sharp and clear the photo is of the label, he obvioulsy can take good photos, but chose not to. The seller should have provided better photos, it's the sellers responsibility to provide accurate photos. It's also the Seller job to accurately describe the coin. He did neither.

Or if you paid by credit card, do a charge back and return the item registered mail. He'll have to chew it because it wasnt accurately described. Take photos first for proof.
But you need to take some responsibility for your actions. You gotta stop wasting peoples time by returning coins when they state no return. They know exactly what they're doing. The are willingly discouting problem coins, you as a buyer should know that. You are taking a big chance, either accept the risk, or stop bidding on them. Simple as that.

Before he does that, he might want to post a photo *here* so we can see if the coin was as described (albeit with a lousy image) or if the image was doctored. IMO, if the image was doctored to hide some of the problem he should have some recourse. If the coin looks substantially like the picture, the seller has (IMO) fulfilled his obligations.
I have a small business and customer service has and always is number one. This guy, whether it was intentional
or not, misrepresented his product. Anybody with half a brain whether they stated they don't have
a return policy, would reluctantly agree to accept a return. There were 23 bids on the coin. It's not like
this coin doesn't have a market. He told me I should sell it, I've never sold on ebay before, so selling a $600
coin for a new seller is not practical.
If we look at what he sells, and I didn't do a real good job of this before the auction, he sells a lot
of junk and he is overgrading his coins. Looking at his products leads me to believe that he probably
is not the most scrupulous fellow in the world.
I still haven't decided what I will do. I'm leaning towards negging him. I don't sell on ebay so the retaliatory
negative doesn't phase me at all. I really do think deep down inside that he deliberately misrepresented
the coin with his photo techniques. Notice how clear the label is. And secondly any reputable person doing
business under these circumstances whether they have a return policy or not should be able to deviate
in extreme situations.
Moral of the story is I should have done a better job when bidding, but it was just one of those days.

I do not think I was harsh but rather I find skier07's actions very poor to want to change terms of the auction, threaten the seller, and come here crying and badmouthing the seller. Terms were up front and he made the decision to bid and is now unhappy. I do not feel that the seller deserves a negative for this nor does he deserve to be badmouthed here. Customer service is alive and well even in this transaction. The buyer got the coin pictured in the auction and I assume it was shipped promptly and the terms and conditions of the auction were met by the seller. Just because the buyer wants to change those terms and now add a return privilege does not mean customer service is lacking. If the buyer wants a return privilege then he should have sought out an auction that offered this or better yet purchased the coin in person.

I think any chance of that went out the door when you threatened him with feedback extortion. He probably thought, SCREW this guy, im not going to give an inch.
If you feel the neg. is justified leave it. The feedback system is imperfect, but its all you have to work with.
A question to the seller would probably have told you all you needed to know.
