Ebay Advice

I bought this coin on Ebay about a week ago. When I received the coin, I didn't particularly like it because it had so much junk around the devices. He had stated in the listing that there was some toning on the coin, which is normally AOK by me. From the scans, it really didn't look like anything significant at all.

I emaliled him very politely when I got the coin and said that it had too much going on and that I would have to take him up on his return policy.

I got the following response:

"It states for this specific item under sellers payment instructions, no return.

I know it states in the description 7 day return, this is my generic listing. For specific items I put in sellers instructions whether I have a return. Sorry for the misunderstanding, but I will take no return for this item.

Tony"

What should I do?

    He says 7 day return right in the listing - he doesn't have a leg to stand on. Sadly there is little you can do besides leave him bad feedback and report him to EBay. If you are persistent enough ebay may intervene.

    That's the biggest problem with paypal, no seller protection unless you pay for it like credit cards offer.

    I think you can contest the payment through ppal no matter what ? they have mediation services. if you're in the automatic return window, I would give the ppal dispute a shot.
    I did this in the case of a counterfeit coin and got my money back from a seller...
  • First, Did you use a credit card with pay pal?

    If, so, file dispute with pay pal as item not as described and wait for their investigation, usually 10 days. They will email the seller and let him know you are unhappy and request a refund. If the seller says no, wait and see what pay pal has to say. If not satisified then, return the coin registered, signature, return receipt and then file a dispute with your credit card. The key is you have to return the item in order for the credit card to help you. The credit card company will give you a conditional credit and review the dispute and have their final answer in usually 60 days.

    I know this is a "grey" answer, but I have been there done that , and everything went my way.

    If you didnt use a credit card, then do the pay pal dispute thing and good luck.
  • It's almost like he planned it. States 7 day return in the description, then down at the bottom where hardly no one ever looks it says no return. It also says insurance not offered. Did he send this to you without insurance?

  • Well it DOES state that there are no returns on this item way on the bottom of the listing.

    To be honest, if I am buying a fairly generic item off of ebay that costs several hundred dollars, I would either want a much better picture, or know the seller. There is a fairly active sight unseen market on "widgets" that are then dumped on ebay for a quick score. For example, your coin has a Bluesheet value in NGC 63 of about $600.00.

    I don't know what recourse you have, but I would take it as an expensive lesson. image

    If a seller lists conflicting terms such as exists here I would hope that eBay would have a standard policy that enforces one over the other.

    The bass turd whacks you almost $16 for shipping and doesn't even insure it? Did he send it registered? Sounds like someone to stay FAR FAR away from.

  • Well, technicalities aside, I think if a seller states two different return policies (what if there were three different ones?) he should in all fairness honor the more favorable one to the customer. Maybe the word "fairness" bothers some, but it works for me -- if that term is a real problem for you in this circumstance, feel free to replace it with "coolness."

    I mean, the seller couldn't have edited out the conflicting policy for this auction? And where is the good will and reputation and customer service, building a long-term trust?

    bought many coins off my aunt after her husband died, and BEFORE i could intervene and help her sort through things.... He took everything slabbed and graded and broke up a complete Morgan silver dollar set to get one slabbed coin... Recently he tried to offer face value on a load of Liberty and Buffalo nickels....I hope you nail him to the cross. cheers!

  • The guy's a greedy jerk for trying to hold onto 200 bucks at the expense of good will and reputation. I would push pretty hard that the specific instructions indicated a 7 day return and should over-ride the generic instruction in boiler the concluding boiler plate.

    If you have to eat it, consider sending it to NCS for "conservation" which can work wonders on old gold that has picked up dirt/grease/grunge. With great trepidation, I sent them a Pop 1 1904 $20 in NGC MS66 PL that had traces of black junk in some of the letters and it came back without the hoped-for star but natural, clean, and dazzling.     I paid via PayPal using my AMEX.

    Should I go first through Ebay, PayPal, or just go right to AMEX?

    FYI, he chrged me $30 to ship 3 coins and the postage, including insurance, was $31.40. No beef there.

    He still wasted your money. I just sent 43 coins including 15 slabbed ones valued at $6K to PCGS via registered mail and that was only $25.

    I believe all eBay disputes are handled within paypal now when paypal was used for the transaction.

    Follow the paypal procedure. Which may lead to you mailing back the coin, registered & insured and providing paypal with the tracking number so they can verify it arrived.

    I recently had a coin return which the seller tried to claim I switched it which was total BS (that old story image) So he sent it back to me. I sent it back again and went through paypal to file a dispute (I had paid with a Mastercard through Paypal). He refused to respond to their emails about the return so they award all of my money back to me. image minus my shipping it back twice but I am still happy I didn't get burned.

    Good Luck with this one. That's a lot of money for a coin you aren't happy with.

    You paid with Amex, and Amex takes care of its own. Call Amex, tell them the incident, have a copy of the ad off of Ebay. They will contact the seller on your behalf, ask him to honor his ad. If he does not, Amex handles it on their end, crediting you and either taking $800 off him or covering it through their insurance. You may actually even get to keep the coin if he fights it. I love buying with Amex because they make sellars agree to the terms of the contract, period. They have to respond to the charge and then they have to explain why they have not refunded. This guy is toast. He wrote a contract with different terms, and he has to go by the more favorable one for the buyer.

    I would do the paypal dispute then Amex, in that order.
    Seller made a mistake with conflicting info.....while it is always good to notice that, and ask about it, it still conflicts....as such, he should honor the return.

    Sounds like he is not a seller to want to deal with. Paypal dispute so he gets that in his record....if not luck, then Amex dispute.

    I wouldn't send it back first though, as even with signature, he may make claims that someone else signed, it wasn't him, no returns, etc.....don't be out the money & the coin......

    I've been told I tolerate fools poorly...that may explain things if I have a problem with you. Current ebay items - Nothing at the moment

    You also said he shipped the coin insured, where at the bottom of his ad he states no insurance is available. Make sure to point that out to him the next time you write.

    If you dont use the Pay Pal dispute process they CAN and WILL suspend your account. They have a dispute process and it must be used. I have had to do this 5 times then went to my credit card and everything worked out perfect.

    Listen to those who say to go through PayPal first. When you signed up for your account you agreed to do just that, and not doing so could get you bounced.

    The fact that this seller slipped in that tiny no return sentence at that bottom makes it pretty clear that this is BS:

    I didn't see this mentioned already, but copy the listing right away.

    Do a cut and paste for legibility and a screen shot so he can't say you cut and altered.
