Anyone filed a claim with ebay or paypal?

I believe I've been ripped off. I bought some silver on ebay and the buyer said he'd ship "immediately upon payment" via Priority Mail.
I paid three weeks ago and still nothing received, and no replies to my e-mails from the seller. My question is, has anyone here ever
filed a fraud claim on ebay or paypal? If so, did you eventually get your money back? I've never had to do it, so this would be my first time.

If there is already an existing thread on this subject, please point me to it.

There are likely a number of threads on this topic, but I'll share that I have had two occassions requiring a complaint with PayPal and both resulted in my receipt of a refund. PayPal will investigate (via email) and make a judgment, usually in less than a month if my two cases are typical. I feel better about using PayPal because of this experience. I hope this helps.

That's good to know. I was also wondering if filing the complaint with ebay along with paypal would help speed it up.

Also, does anybody know if the seller is penalized by ebay or paypal if they are found "guilty"? Reason I ask it that
I probably won't post negative feedback since I know for a fact the seller will retaliate and mess up my feedback.

Be sure to contact PayPal right away because there are time limits (now 45 days up from 30 days)

If there is money in the sellers account, they will put a hold on the amount in dispute while they investigate.

With eBay you have to file a fraud complaint (online), and follow it up with a fraud claim (via mail). They intentionally make it difficult to reduce the number of claims they pay. Make sure you send the fraud claim form registered mail with a return receipt, because eBay likes to throw them away (I think that's what they did with mine).

Even if PayPal finds in your favor, it doesn't mean you'll get any money back. One guy posted here he got 7 cents.

There is no penalty from either for ripping you off, but if the seller costs eBay money they will NARU him.

I've filed twice through PayPal. Both times I received my money back.

Edited to add: And I did neg the seller. It's gutless not to warn other buyers.

And that, right there, is the whole problem with Ebay's feedback system.

Yep, the feedback "honor" system is flawed. Even I don't bother giving feedback unless
I get one first. I already have one negative (it was retaliatory of course), and that's
    one too many.

Retaliatory feedback should be punishable by a permanent NARU. This would be a good first step toward making Ebay's feedback system actually mean something.

When someone is suspended either permanently or for a shorter period of time, they are labeled Not A Registered User by Ebay.

My experience with a Paypal claim is not very positive. I was ripped off for $70 and followed all the proper procedures in a timely fashion. In the end I only received $0.07 because that was what was left in the sellers account.

The good news is that Ebay NARU'd the seller even before I got the chance to neg her.

If you paid by Paypal and they aren't able to recover your money, and your account is funded by a credit card you can also file a dispute with the credit card. Paypal won't like it and it does run the risk of getting your paypal account closed (Make sure you have no cas in your paypal account before you do it) but it would be one way to recover your money.

Ebay claims are hardly worth the trouble--they run you through hoops for a max of $175.

I think you are better off just claiming it on your taxes under "loss by casualty or theft". You will have to do the long form, but, at least the IRS will give you credit for your loss. EBAY/PAYPAL are nothing more than High Tech Extortionists. They are in the business of making money, not paying it. Don't look for an easy route filing a claim with either ( they are the same company, by the way)

    Seller must prove delivery.

    Watch yur butt.

if you make insurance optional and the buyer refuses and you have no proof of delivery you are r shafted !

EX: " ONCE I HAVE SHIPPED ITS NOT MY PROBLEM"

Wrong,it is your problem,100 % of the time if you cant prove delivery you will lose the complaint via EBAY or PAYPAL !

    Simple contract Law.

You must deliver and prove it if need be.

Paypal accounts are a dime a dozen, so closing one is no threat.
