islemangu - Use the search feature for aswimmer, title only. You will find a lot of interesting threads from about a year ago.

how is it that the 'tighting'? person can keep posting negs - did he buy multiple items or something? just curious.

forgot to put the word "faux" in? ha!

Boy! He sure pissed tigting off.

Tighting is probably super-bidding on all his items and them refusing to take the items. Once he wins he can post feedback.

Seems like TIGTING has an axe to grind. He's the only one giving negative feedback for himself.........and others too! Interesting slant on the feedback game. I wouldn't put stock in either the seller or the buyer. AT 99.7% POS FB rating, ASwimmer has a good rating.
    My 2 cents.

Well, you obviously must not have been around last year. This seller is a purveyor of AT junk, which he does himself. I caught him buying the equipment and chemicals.

I've gotten several lots of inexpensive circulated foreign coins from aswimmer, with no problems... fast service, good communication, decent coins, etc. I didn't know he had a past around here. What's the story on him?

I have sold Barber dimes to TIGTING and bought them from ASWIMMER. In my opinion, TIGTING is the pickier of the two, but I have complaints with neither. Both are knowledgeable collectors. Neither seems to think of the day down the road when we can look back at this nonsense and laugh.

You can disagree with the way aswimmer does business but IMO what tigting is doing is worse.

You don't like a seller, don't bid. Tigting has annointed himself judge and jury and his actions are malicious.

Remember, it's eBay!!! I know people want to hold eBay to the highest standards possible but all it really is is a national flea market. Get over it. (This does not mean that I want to see people duped into purchasing fake or doctored anything but it's no different than when you go to a flea market and see all kinds of copies and knockoffs.)

I could go on, but I'll stop here. image

You're making assumptions about what tighting has done. All we know at this point is that he has posted multiple negative feedbacks against a known fraudulent seller. He may very well have been ripped off as he states in those feedbacks. If that's the case, there's nothing malicious about it.

Aswimmer has been proven a liar so many times around here that anything he has to say about the matter deserves no credence at all.

I just received an email from tigting, and it is very interesting, complete with the entire email exchange between them. At this point, I don't feel free to disclose the emails, but I will give you all the rundown of what happened.

Tigting bought several Barber dimes from aswimmer. In the auctions, aswimmer listed his no-problem return policy. Tigting received the dimes, and was not happy with them, so he returned them to aswimmer so he could get his money back, over $2100. Swimmer got the coins back, but did not refund the $2100. When tigting inquired as to when he would get his money back, Swimmer replied giving him a bankruptcy case number and basically told him tough luck, get in line with my creditors.

Swimmer obviously has his laws mixed up, you can not hide behind a bankruptcy to defraud people. I have advised tigting on the appropiate legal filings to make, including mail fraud.

I think you may have YOUR "Laws" mixed up, K6AZ.
I don't see anything you've written that would indicate fraud.
This "tigting" should have received a letter from the Federal Court handling the bankruptcy, naming him as one of the creditors, with the dollar amount due him. If aswimmer hasn't listed him....then aswimmer may have commited bankruptcy fraud, and tigting may have some recourse.
In bankruptcy court, the disposition of property is determined by the court trustee.
Obviously aswimmer was in possession of the property when he filed bankruptcy, and if so, he could not return the coins or reimburse tigtings' money without the approval of the court trustee.
I've got hit by 3 different parties filing bankruptcy against me, and I'm out over $177,000 just since this recession began.
Hurts like hell to lose money this way, I can tell from personal experience. But this is the law and like it or not, it's the way it is.

Obviously? I'll bet that the guy isn't even in bankruptcy but, assuming that he is, why is it so obvious that he was in possession of the property (after its return mind you) when he filed for bankruptcy.

No, I know laws, especially bankruptcy laws, very well. You do not file bankruptcy, then use it as a shield to defraud people on eBay. The buyer returned coins to Swimmer, and Swimmer either kept them or resold them, and did not refund tigting's money. That is a crime that bankruptcy does not protect you from. Until Swimmer refunded tigtings money, those coins belonged to tigting. Swimmer has to produce the coins or the money, or Swimmer is committing a crime, pure and simple.

Actually it could be a case of fraud, in all my 30plus years of banking I fought one case and won it. However it took a year and a half for the judge to rule. In this case the buyer got his merchandise and if he returned it he can file a claim with the court for it to be returned back to him, but I think he's out his cash. I can't see that swimmer could have kept the cash and the merchandise. Maybe the resident forum swimmer advocate SB, can clarify this. image

edited to add: If I were out $2100 with this guy I'd be a little po'ed too, can't blame him for having an attitude.

Well, bankruptcy is out of the picture, Swimmers case was dismissed. If you don't want to take my word for it, call this number:

    1-888-457-0604

Choose the option by case number, and enter this case number:

    0346011

Swimmer has no bankruptcy protection, and has defrauded tigting. I would be flaming hot too if I had been ripped for over $2100. I just hope tigting follows up in filing criminal complaints.

In January a seller who shall remain nameless gave me a negative after demanding $1000 under threat of return and posting a negative. The terms were very customer service oriented since all he had to do was return those pearl necklaces which I left out the word FAUX by mistake.

LOL - He left out the only important word in the entire auction! Sounds like an honest mistake...

Didn't Swimmer use bankruptcy as an excuse once before? I seem to recall him rambling on about it back when the threads were going on around here.

I seem to recall he did say that Russ, which would explain why this case was dismissed. In any event, this bankruptcy has been dismissed by the court, and aswimmer had better start figuring out how to refund this guy's $2100, or he may be fitted with some very special bracelets.

Just playing devil's advocate here for a moment (no pun intended in light of K6AZ's icon).

How do we know Aswimmer owes Tigting anything at this point? The referenced Aswimmer's page seems to indicate that all the merchandise was not returned (ok, he admits some of it was returned, so Aswimmer seems to admit he owes something to Tigting). Does Tigting have any evidence that Aswimmer recieved the merchandise back (after all, it's always the responsibility of the shipper to get a package to the receipiant). Then there's the part about credit card charges being reversed (or am I getting the stories between the "FAUX" perals and the $2100 in coins mixed up?)

I haven't posted everything I have, but I can assure you that the only liar here is aswimmer. In his emails to tigting, he admits to having received the coins in return and owing tigting the $2100+. This guy is a pathological liar, his aboutme page is nothing but lies.

It should also be pointed out that these auctions that tigting bid on took place in mid September, tigting spent nearly four months giving aswimmer every opportunity to make things right and refund his money. Swimmer would have none of it, and when confronted with the initial honest, factual negatives from tigting turned around and slammed him with 12 negatives full of lies.

This seller has a history of fraud, artificial toning, and bounced checks to other eBay'ers. I am astounded that anyone knowing his history could even remotely believe his side of any dispute.

    Another interesting aswimmer thread

I assumed the truthfulness of the statement that aswimmer was in bankruptcy when I replyed previously. If that's not the case, then of course there may be crookedness involved.
This guy tigting should go see the Chief of Police or Sheriff where he lives and get moving on this.
