I already think the answer is no but I will ask anyway.
Is this how this set came from the mint?

Absolutely not.
That's a modern clamshell case that's easily opened and you can insert any coins you want.
There are no 1938 Mint sets

No, as the United States Mint never released any official uncirculated mint sets prior to the first set in 1947. Official sets contained 3 cardboard sleeves each consisting of 2 sets of coins from each minting facility, in a manila envelope. It would look similar to this later mint set. What you have are 5 coins put in a modern aftermarket plastic holder. The original double uncirculated sets were produced from 1947-1958. Hope this answers your question. Zack

Another tip off for me, apart from the use of types of plastics that were not in general use back then, is the word "Silver". Back then all dimes/quarters/halfs were and always had been made of silver. There would be no need to specify that on the case.
