    This link says that bullion (gold, silver and platinum are the only PM's mentioned) over $500 is sales tax exempt in Florida. Has anyone bought a palladium bar on eBay costing over $500? According to this link, you would have to pay the full sales tax.

    I don't know what Massachusetts' laws are, but when I lived in Oklahoma, and before that, Maine, I would have been liable for the taxes on the items I bought in New Hampshire.

    A lot of the states have that user tax which is voluntarily reported for out of state purchases. Since it is self reported, it is easy for the poster to simply not pay it even if it's owed.

    I agree. However even when it is easy to cheat on your taxes, it doesn't mean you're not cheating.

    In fact, I wish states would crack down on coin shows. A lot of sales tax cheating going on at our local coin show. That makes for a very slanted playing field for those who are obeying the laws.

    When the Wayfair laws came into effect and a lot of people on the forum were unhappy with ebay, a lot of them just said "I'll stick to buying at coin shows". Since it is THEIR state which requires sales tax be collected, you know what that means: more tax cheating at the local coin show.

    I like to tell myself that the dealers are discounting the coin to make $100 include the sales tax. It may not be true, but it makes me feel better.

    Oh, it's definitely not true. LOL. I'm tax exempt. Many of them don't ask me for paperwork and don't even seem interested if I hand it to them.

    I just won an auction and am being levied a sales tax by eBay, for a legal tender coin shipping to Florida. Would it be better to cancel the purchase, or to pay for it and then attempt to recover the funds from eBay? I’m worried the latter may never happen given some of the other experiences in this thread.

    Nothing is as expensive as free money.

    auction or buy it now? You should see taxes applied before payment if buy it now. If auction call ebay before paying. If they cannot refund taxes contact seller and explain your reason for asking him to cancel the sale.

    It would depend on the amount.
    Fair chance after several phone calls you will get your money back.
    But there is also a pretty fair chance you won't get it back or will just give up trying.

    Ya gotta ask yourself, do I feel lucky......

    It was an auction, and it surprised me because I bought another item via BIN that was over $500 this morning and there was no sales tax, so as others in this thread suggested it looks like eBay is applying the tax statute incorrectly. I spoke with eBay and they told me if I want the item that I’d need to pay for it and then submit a dispute. I don’t want to screw the seller over so that’s probably what I’ll do.

    After waiting 16 days since my last call I contacted ebay again today. :/
    After 5 different customer service reps and about an hour on the phone and I was told to wait 2 days for a response.
    This beats the 10 days & 21 days I have been told in the past, but I have also been told 2 before.
    Anyone wanna make a bet if I have a refund in 2 days. :D:D:D

    I sure don’t want any part of that bet. I liked it way better in the old days when eBay was like a garage sale. Now they tax everything.

    A little update:

    I have gotten refunds on all purchases where sales tax was incorrectly applied. After much back and forth with customer service I have been promised communication directly with the tax team. Not holding my breath, but a step in the right direction. Will let everyone know if I hear anything from them directly.

    I have contacted them as well with specific transactions of my own and the applicable tax code in question. Should be TIP 99A01-13 unless there's an update to that I'm not aware of. I'm no tax professional or attorney of course so this is not my area of expertise, nor even my own state :D If anyone has better information please let me know

    Hopefully they'll address it sooner rather than later. Still seems to be the same as of yesterday where US legal tender coins shipping to Florida under $500 right now are being taxed on eBay, and they shouldn't be.

    It appears you are having some issues with tax being charged on your purchases of gold, coins and other precious metals that should be tax free in your state.

    We want to apologize, for the inconvenience this may be causing you.

    Unfortunately, there is an ongoing issue with the system that is causing issues regarding sales tax being charged on gold and other precious metals in a few states. We have escalated this to our tax technology team and external vendors for a solution.

    Until we have a permanent solution for this issue, we can review the purchases on a case by case basis and process manual refunds. To make this process easier for you, it will be helpful for us to know if you purchase occasionally or if this is something you do on a regular basis.

    If you purchase less than five items in a month you would just need to send us an email with the following information on it for each purchase:

    eBay ID
    Item number
    Sales Tax Amount
    Ship to state
    Issue description
    Transaction date

    You can send this each time you make a purchase or once a week or so.

    If you purchase frequently, you may want to send a spreadsheet or list once a month or more often depending on what is the most convenient for you. If you would be sending a spreadsheet we would provide you with a different email to send it to so it goes directly to our tax legal team.

    Please note: We do not have an estimated refund time frame right now, but are taking care of it as soon as we can.

    I talked to them 2 days ago and explained my concern about the illegal collection of sales tax.
    I talked to them 2 days ago and and explained for the 10th time I would like my money back.
    I'm right back where I started over 2 months ago! :/
    This was just 1 of 3 communications with them today.

    Another eBay rep sent me a link to justify why they were collecting sales tax in my state.
    The link they sent clearly says "There is an exemption for the sale of currency and coins that is used as legal tender in any country. A purchase of any bars, nuggets, or bullion that is at least 50% pure is not currency and is taxable. However, all gold and silver coins are considered legal tender and still exempt."
    Either they don't have the reading skills or the desire to read what they are sending. :/
    It says exactly what I have been telling them since December.
    I think to qualify for a job as a eBay CSR you need to have an IQ in the single digits.

    It's funny their IT team has the time to do Managed Payments and redo the whole site but they can't fix a problem they have known about for over 6 months. eBay is making too much money by ripping off customers to have the desire to correct the problem.

    On a side note my last sale to Florida was on 7-19 it was for a PCGS graded half sold for $39 and the buyer was not charged sales tax. Not sure if the problem has been corrected or if it is an intermittent problem.

    @ifthevamzarockin no, I have not yet received a refund. I just emailed them again today requesting reimbursement for the illegally collected sales tax.

    I just added a "buy-it-now" item to cart and it is still charging me sales tax to ship to FL, so it does not seem to have been corrected yet unfortunately.

    Nothing is as expensive as free money.

    I was charged FL sales tax on a coin purchase on 7/20.
