For 'grade' the marks on the cheek completely disqualify the coin from MS-63 or higher. That a TPG "gave points" for the nice color is not relevant to the condition of the coin, and is symptomatic of almost complete breakdown of honesty and objectivity.
It's nice that the owner got a big point bump....more potential money from a buyer who pays for color not quality.

Breaks in a coins color can look like gashes/marks, to the untrained eye. I am surprised you are making this rookie mistake. At least you were eloquent about it.
