BST problem transaction: how would you handle this fiasco?

A forum member offered a coin on the BST. It was a type coin worth several hundred dollars that resided in a PCGS holder. I offered to buy it at the seller's offering price, we agreed to the terms, etc. I dropped the check in the mail.
As we are finalizing shipping details and talking about football, I casually mentioned that I might break it out and put it in my 7070. He thought that was a great idea and, doing me a favor, he indicated that he went ahead and cracked it for me.
I might crack it out, but I might want it in the holder for my type set.

I guess it could range from a deal-breaker to no big deal if you want it anyway.

That depends entirely on what the coin looks like and what the grade/price was.
Regardless, I think you have grounds for backing out of the transaction at this point and if you so choose. Alternatively you could wait and evaluate the coin in-hand, as I presume you have the right to return the coin for a refund.

Ahhhh YUPPP, that is correct
Was it really in a slab?

Ask for your check back - sounds fishy to me.
You offered to purchase a specific coin in a TPG slab.
The seller accepted your offer to purchase a specific coin in a TPG slab.
After the contract was formed between the buyer and the seller, the seller cracked the coin out of the slab thereby placing himself in a position where he could not provide to you the item that your contracted to purchase from him (a coin in a TPG slab). This is a breach by the seller of his obligations to you and his breach of the contract excuses you from having to perform your obligations under the contract (pay the seller money).
Thus you are off the hook and if the seller sued you, you would have a defense to the lawsuit. You of course could sue the seller for breach of contract (though I do not know, without researching the law on your dime at my hourly rate
Sounds like way too much football talk!
If, then, else.
identification is certain? Were you granted a return privilege?
In any event, what you will be receiving is of lesser value than what you agreed to buy,
and I'd probably contact the seller saying that you expect to receive compensation
(in the amount of a PCGS grading fee) if the event you like the coin and decide to keep
it. If s/he balks, then I would back out of the deal.
How did you get yourself into this problem? If I didn't know you, I would think you were kidding that this happened!

Maybe it was a joke?
<< <i>I casually mentioned that I might break it out and put it in my 7070. >>
What exactly did you say? Apparently, he thought you were going to put it in your 7070 album and he thought he was doing you a favor. Sounds like a failure to communicate. If you don't want a raw coin send it back for a refund. I assume he sent you pics of the coin so a switch is not likely. Good thing you didn't tell him that you might clean it.

I have a ms68 Red 1936-S cent in a slab. I also have 49 other grades, unslabbed, from the same BU roll of 1936-S cents. If I was unscruplous, I could bait and switch for extra profit, Capice?

Sounds like you are OK though once you confirm the coin in the flip coming to you was the same coin in the holder.

I said exactly this:
"There is a pretty good chance that the coin will end up in my Dansco 7070."

What did he mean by "collectable holder"? Hopefully, it wasn't a doily slab or a first generation NGC black slab.

Was it a collectible holder?
Or was it a collectible in a holder?
The smiley face with collectible holder makes me think it was tongue in cheek.

What possessed you to do a transaction with someone you didn't know (who turned out to act foolishly)?
edited to add: You bought a coin in a PCGS slab. Before you could say anything, he cracked the coin out of the holder, thereby diminishing the value of what you just bought. I don't think you owe the seller anything.

The coin was nicely nestled in the intact PCGS holder, and the joke was on me.
To be honest, I did not know whether the coin was coming slabbed or not until I opened the box. Depending on the outcome of an unrelated grading event, I may still crack out the coin for my 7070, but that will be up to me.
I will post a photo of the coin if I get the seller's approval to do so. It's a great coin!

Huh? Why do you need anyones permission. It's now your coin and you can do whatever you want with it.

There is a good chance that posting the coin will immediately identify The seller. I took the liberty of quoting him, anonymously, and in the event that he might be uncomfortable with how he is portrayed in this scenario, I want to give him the courtesy of refusal.
