The fact that it was cracked out of a circulated proof holder and sold as the rarer business strike seems unethical. Maybe that's just me though. Of course it could have not been the seller who did that, he could have absolutely bought it as a business strike from someone else. Always have to play devil's advocate.
Obviously it's bad for a seller to misrepresent something, but on the flip side, buyers shouldn't be shelling out $1325 if they're not sure of the difference between business strike and proof.
The OP could simply link this thread to the last eBay buyer via the eBay messaging system (assuming a feedback rating will appear) and let them decide what if any action is necessary. I know what I think of the latest seller.

The first images are of a coin in a white ANACS slab graded Proof 50, the third and forth image are of a raw being sold as a business strike.
Note the lighter toning above the I on the reverse and below the M. Additional similarities can be found on the obverse.

Gotta say , your opinion is good enough for me
Well what is it? Proof or Business Strike? If a business strike, absolutely cracking it out and reselling was a nice score otherwise unethical.
