Heritage sales tax

So Heritage is charging tax now on all auctions. I always thought that you can only be charged tax if you live in the same state. Just more reasons that more and more people will be dealing with PWCC and other Ebay auctions in the future instead of these auction houses.
Charging a 19.5% premium AND sales tax just blows.

    So are they charging regardless of the state you live in? If so, good. That will help even the playing field for all of us that live in Texas.

    is this true? so, they're charging each individual's particular states sales tax? and county also?

    From Heritage's website:

    Sales Tax Information
    Lots delivered to you, or your representative are subject to all applicable state and local taxes, unless appropriate permits are on file with Auctioneer. Bidder agrees to pay Auctioneer the actual amount of tax due in the event that sales tax is not properly collected due to: 1) an expired, inaccurate, or inappropriate tax certificate or declaration, 2) an incorrect interpretation of the applicable statute, 3) or any other reason. The appropriate form or certificate must be on file at and verified by Auctioneer five days prior to Auction, or tax must be paid; only if such form or certificate is received by Auctioneer within 4 days after the Auction can a refund of tax paid be made. Lots from different Auctions may not be aggregated for sales tax purposes.

    Note: You will be billed for sales tax unless you have the appropriate documentation on file at and verified by Heritage five days prior to the auction. This documentation consists of a Resale Form (download now) and a legible copy of your state issued license or permit issued in your name and/ or the name of the business for an appropriately related category of merchandise. If you do not have this documentation on file with Heritage, you have 14 days from the date of the sale to complete the form and send/fax a copy of your license or permit to receive a refund for the tax. Lots from different Auctions may not be aggregated for sales tax purposes.

    How does heritage have any jurisdiction to collect sales tax in states where they do not have a physical presence?

    Illegally? Don't see how this is legal.
  • Nothing in that disclaimer posted leads to believe I would be charged a sales tax fee. (I live in TN) Looks like the normal legal text. OP - What state do you reside in?

    That would be why you have to pay.

    Edit: Just got in so I can be less brief. Heritage does have an office in Chicago, it's not listed on the mast on their website, but trust me it's there. Could be wrong, but I think it's a smaller outpost that just handles a specific function of the company so it flew under the radar of Illinois taxes for awhile and I think they began charging resides in that fine states earlier this summer. For those of you not in CA, TX, NY, or IL you sweat not.

    I'm in Illinois as well...what if I had my winning auctions sent to another state? Would sales tax still be applicable?

    I just got my invoice and I was not charged sales tax.

    I stopped bidding in there auctions after I received a empty box from them 6 years ago.

    Even with sales tax, you can find some good deals when compared to the BIN prices (or shilled auctions) on ebay.

    no. and having an item shipped to another state is completely legal. just be sure to keep a copy of the shipping label.
