Should I leave negative feedback or just move on?

I won 4 concert tickets for my daughter and friends to see an all star concert (Springsteen, Pink, etc) in Los Angeles on 11/18. Selling had a buy it now of $600 (orchestra level) without a reserve. My daughter s budget was $75/ticket, so I bid $300 at the end and won them for $290. Before I had a chance to pay, I received a cancellation notice from the seller. I emailed and he said "mistake that tickets were already sold, sorry" I checked his feedback and completed sales and no record on Ebay so I emailed them back. So they were apparently sold on another website. So they sell them on 1 website, forget that they were sold and this time list them on Ebay????

I'm thinking they were not satisfied with the the winning bid amount.

  • It happens way too often. I just dropped negatives on two sellers for that same thing. It's just seller's remorse but it's not acceptable selling practice in my mind. We all learn the hard way, they're no acception

    I won't leave a negative on anyone. You are just asking for yourself to get sued.

    Sounds like the seller gave you an overall negative buying experience.

    Giving them the benefit of the doubt, they could have been selling them on multiple sites (I.e., stub hub) and that sale completed before the ebay one.

    I can see that being sarcasm, however, I remember reading about MedExpress suing customers who left negative feedback on their eBay purchases, and it ended up backfiring on them when they had to pay the defendant's legal fees.

    I was being serious. There have been cases where negligent sellers take in the right buyers who leave them a negative feedback to court and you are at risk of legal fees to defend yourself and in some cases be out further money.



    To me it just isn't worth the risk. It sounds like fun to get some retribution but that fun will end really quickly if the jerk tries to take you to court.



    Times have changed and people will sue for anything. A negative is defamation of character in their mind. It really stinks it is this way.

    If i simply state the fact and let other potential buyers read into it what they would like, that is construed as defamation of character? Shoot, I could even leave neutral and state same facts of sale.

    A neutral is safer.



    I am not generally super paranoid but when you read about the horror stories of EBAY members taking others to court over feedback and it costing them a lot of money to defend themselves or potentially lose I just say I am out.



    Do what you think is best and probably in most cases the person won't seek legal outcomes but generally these people are scum so you can't put anything past them.

    Without question you should leave a negative. That's the point of having the system. That way the next person won't get duped...what is this seller going to sue you for? You won tickets that he had listed then he backed off after the fact...clearly he didn't like the sale price or he sold them elsewhere or kept them...not your problem...dead beat seller without question. Should be exposed. Just my opinion of course. image

    I would neg them as well. If you don't they will just keep doing this to others without impunity.



    The important question is can you get tickets for your daughter still to see the concert. I say as a board lets do so,etching to make sure she gets a chance to see the concert and let her know not everyone in this world is rotten or cheats. I will be the first to contribute. Card sale, Paypal gift... Let's do this. Who is with me?

    I would neg them also. Try to take me to court for a legit neg left on eBay and I will countersue the hell out of you.

    That notorious case wherein a seller sued a buyer for leaving negative FB on ebay blew up in their face~not only was it thrown out of court, but the judge ordered the seller to pay all legal fees plus punitive damages to the buyer. As long as you are factual, and refrain from personal attacks or hyperbole, you will be fine. Negative feedback is part of the ebay system and part of the TOS that sellers agree to accept when they open an account.

    I very, very rarely leave a negative (like twice in 12 years on eBay). However, I had a similar situation within the past year where I got a really good deal and the seller claimed he accidentally destroyed the item. I did leave a negative in that case.

    If you do a Google search there are numerous stories about members getting taken to court. Not just one.

    I haven't studied the outcomes but when it is a prevalent thing why take the chance of having to take on that nightmare.

    Suing over a factual negative feedback is actually illegal in most states, including California where eBay is based.

    It's not prevalent. Probably far less than 1% sue buyers for negatives, and some of them lose and have to pay the buyer's legal fees.



    Do you drive? You're probably far more likely to get hurt in a car accident.

    You are probably right that it is less then 1%. That said it means it is going to happen to someone and getting the last laugh isn't worth it to me.



    Yes I do happen to drive and was hurt very seriously in a car accident when I was 19. I never thought that night as I was driving down the road that just a few moments later a drunk driver would press the gas and not the brakes and hit me in a mini van at 45 miles an hour while my girlfriend at the time and I were at a stop sign about to make a left hand turn.



    I had no choice in that matter. In the case of leaving negative feedback I do.



    In mid 2005 I was rear ended on I-4 in Orlando. Just a few months early I had gotten the car and it was my first nice car. I was so mad when it happened. I pulled off on the shoulder and waited for the cops to arrive. When he approached me he said what is your side of the story. I said what do you mean my side of the story. The lady with a Christian radio station sticker on the back fabricated a story and since there were no eye witnesses the cop took no sides. I challenged the results and even though the collision manager said there was no way that I could be at fault based on the damage to the car the insurance authority didn't side with me.



    Sometimes even though the facts seem indisputable some how they are. As I said I will just pass and go on to the next transaction. If someone wants to leave a negative obviously feel free but 1 out of 100 in your example may have to deal with some serious BS.

    Personally, I'd assume that the seller got a higher price, and I'd find myself in the same dilemma as you.



    I rarely leave negs, even if something doesn't go exactly as I had hoped.



    You and your daughter must be quite disappointed.



    However, when I think the seller's dishonest, or is offensive, they get what they deserve.

    Just FYI, I have left like 2 negs since 1998. One was for non payment of an item, back when sellers could leave a neg on a $1000 item. (Buyers should get automatic negs for non payment, but thats a different story) - The second time was when someone listed an item I bought for $95, buyer said he didnt have it in stock, then relisted the same item a half hour after cancelling transaction for $109. Negs should be WELL deserved when being left, but that falls into the category of "to each his own"
