And with it the bad news of a card that has been trimmed. The seller I bought it from is on ebay and I will be contacting him soon. Btw this was on the CC Renew CC subscription vouchers.
So, the question I have is this: If the seller is not agreeable to a return with a refund can I still go the PayPal claim route? The card is significantly not as described.
And to throw another couple of kinks in the hose:
1-Another card I submitted from them came back as Min-Size not met
2-Another card that I didnt submit was called an EX, the front might have been close but the back was 100-0 centered. I figured I would just eat it ($60 card) but now I am of the mind to work on a refund for it as well.
So, in essence what would you do and what options do I have available to me?

Open an eBay SNAD case, almost impossible to lose. If that doesn't work, go to PayPal, and if that doesn't work and you used a credit card for the Paypal payment, you can initiate a chargeback.

On 1, unless you can notice a significant size difference from other raw cards from the same set, keep subbing until it gets slabbed.
On 2, if there was no back scan or mention of the back issues, open a SNAD on that one too.

About a month.
ETA: and I'm pretty sure the 45 day clock starts from the auction end or perhaps once payment is made.
