Remote Transactions Parity Act

Ebay has provided a simple way for sellers to let their elected officials know that they strongly disagree with the proposed "Remote Transaction Parity Act," another attempt to require very cumbersome and expensive tax collecting by internet sellers. Even if you are not an ebay member you can use their link to send a strong message to your officials.

I hadn't seen it on eBay and I fully support it.
Thanks for bringing it to our attention derryb.

Thanks for posting this. I can't imagine being a small mail order merchant and collecting sales taxes and sending them in for over 9600 taxing jurisdictions in the US.

The big retailers will be supporting this legislation. It will put a nail in the coffin of much of their on-line competition. Lack of competition is a major factor in higher prices. Reason why not just on-line sellers but all consumers should fight this.

eBay would be in the best position to do this and I would support some sort of reimbursement to eBay for setup/programming costs to be borne by the taxing jurisdictions.

The Remote Transactions Parity Act actually helps small businesses, especially those who are brick and mortar.
The Remote Transactions Parity Act of 2015 restores free market principles to retailers by removing the government-sanctioned tax subsidy that is currently given to online-only sellers. Importantly, it also strikes a balance between states' rights and regulatory protections for remote and multichannel sellers.
"This bill is the product of a thorough and inclusive stakeholder process and enjoys broad support by the business community," said Betsy Laird, senior vice president of Global Public Policy for ICSC. "The Senate and the House have both spent significant time deliberating this issue. It is now time for Congress to stand up for local retailers and pass this job creating, bi-partisan, common sense bill."

Agree, it greatly reduces the on-line competition of all type retailers which normally will result in higher prices with these retailers. Look for all the big box retailers to support the legislation. Obviously a B&M retailer who does no on-line business needs to support this legislation. If he does conduct on-line sales then he needs to evaluate the collection and reporting of potentially thousands of taxing jursdictions or plan on ending his on-line selling. Also, keep in mind that from a consumer point of view the more competition normally the lower the price.

On the one hand, of course I want to avoid additional taxes and additional accounting burdens.
On the other hand, I see this situation ultimately getting resolved with a National Sales Tax.
Either way, we're screwed.

+3, ty for the link.
the beauty about derryb's post (6th in) is its simple, yet dead-on accuracy. pretty much my favorite flavor. simple and effective. from my experience, complication
permits abuse. i know that was a bit black and white.

Indeed. I never really got why folks lament about Congress doing nothing. To me that's almost always preferable to Congress doing something.
A national sales tax may not be the worst thing if there is a major overall in the federal income tax that goes along with it.
The time is long overdue for a Flat Tax which both Jerry Brown and Steve Forbes have both proposed as Presidential Candidates. If these two guys, who really are unable to agree on much, CAN agree on a Flat Tax... how bad can it really be?

My guess is based on the address you enter, it gets routed to the correct person.
I received a canned reply from my Senator basically saying they received it, thanks, thoughts important to us, etc etc and I'll receive a detailed response in the future.

Dear Friend,
Thank you for taking the time to contact my office about H.R. 2775, the Remote Transactions Parity Act. As someone who once helped run a small
business, I understand the importance of reasonable tax policies that allow all businesses to compete on a level playing field.
As you may know, the Supreme Court's 1992 decision in Quill Corporation v. North Dakota held that a state could not impose and collect sales taxes
on businesses that do not have a physical presence in that state, unless the United States Congress explicitly gives states the right to do so. In the absence
of such consent from Congress, online retailers have been free to avoid collecting sales taxes on transactions that occur in states where the retailer has no
physical presence. Therefore, the current tax structure provides a competitive advantage to many online retailers, who, unlike brick and mortar businesses,
may not be required to collect sales taxes.
In response, the Remote Transactions Parity Act was introduced to establish a framework for states to enforce and collect existing sales taxes on
Internet transactions. The bill would not create any new taxes, but would allow states to enforce their existing tax laws. The Remote Transactions Parity Act
would provide state audit protections to small businesses and also includes a small business phase-in, which would prohibit states from requiring certain small
online retailers from collecting taxes for three years after enactment. Additionally, this legislation would require the states to provide the necessary software to
its businesses who are required to collect and remit the sales tax.
As your Senator, I will continue to work with my colleagues on both sides of the aisle to enact tax policies that encourage our businesses to invest, innovate,
and create jobs, while building a strong middle class. Currently, the Remote Transactions Parity Act is pending before the House Committee on the
Judiciary. Should this legislation come to the floor of the Senate for a vote, I will be sure to keep your thoughts in mind.
It is a privilege to represent you and all Hoosiers in the Senate. Your continued correspondence is welcome and helps me to better represent our state. I
encourage you to write, call, or email if my office can ever be of assistance. You can also check out my Facebook page and follow me on Twitter by visiting my

You could have claimed the same thing going back 100 years in the mail order business. If I ordered something from a brick and mortar retailer who didn't have a physical presence in my state, there was no sales tax. I don't see how the internet changes anything....other than there is more in potential taxes to be scarfed up.
Even Barter transactions can have tax consequences.

I'm not sure how putting a tax on eBay transactions hurts small business?
In California, we are required to report and pay taxes on items we buy out of State, but it's rarely done I imagine.
The average government pension shortfall is 25%, so in order to make that up taxpayers will have to pay more taxes.
Thanks government unions for paying bribes (er, I mean campaign contributions) and thanks legislatures for taking those bribes (campaign contributions) and working together to screw the tax payers.

increasing costs for consumers/dealers on top of ebay/pp/shipping fees to start ultimately reduces an often times already small margin? or am i missing something. not too focused. less sleep, more shows/shops/sales is taken its toll. pleasantly so but energy isn't high.

Dear Mr. Newman:
Thank you for contacting me to share your opposition to H.R. 2775, the Remote Transactions Parity Act of 2015. I appreciate hearing from you.
America's small business owners work hard every day creating jobs, delivering products and services to consumers, and providing leadership in our communities. Small businesses are vital to the economic health of our district, state, and nation. We must be mindful of each new regulation that is implemented, making sure that they do not unnecessarily make it harder to start or run a business and create the jobs needed to get our economy back on track. According to the U.S. Small Business Administration, small businesses represent 99.7 percent of all employers, employ half of all private sector employees, pay 44 percent of the total U.S. private payroll, and have generated 65 percent of net new jobs over the past 17 years.
H.R. 2775 attempts to modernize our nation's outdated sales tax collection process. By closing tax loopholes, this legislation tries to level the playing field by placing the same state sales and use tax structure on all neighborhood retailers and small businesses. However, we must be certain that these changes do not stifle business growth and hurt consumers. We should not be making life more difficult for our job creators.
Although I am not a member of the Judiciary Committee to which this bill has been referred, you may be certain I will remember your opposition to H.R. 2775 should the House vote on this or relevant legislation in the future.
Again, thank you for the benefit of your views.
Sincerely,
Luke Messer
Member of Congress
