How Long Before Leaving Negative Feedback?

Hey Guys,

I'm not one to leave negative feedback on Ebay unless I absolutely have to and then I still feel kind of bad about it. I purchased a sealed pack of cards and when I received them the cellophane around the cards was not intact and ripped open There were about 10 cards missing from the pack including the one card I purchased the pack for. The padded envelope the cards were shipped in looked fine and didn't seem tampered with. The auction stated sealed pack. I sent the seller a message a week ago and haven't heard back. His Ebay rating is 99.9% (1062) so the seller doesn't seem like a deadbeat. He only has one negative in the last 12 months. It doesn't state anywhere that he is away on vacation or anything like that. Like I said, I don't like leaving negatives and the dollar amount wasn't all that much, but at least get back to me. I'm going to send another message and then give it another 3 days. If no response I guess I'll have to leave a negative. What do you guys think?

I wouldn't have waited this long to open a case (he's probably hoping you'll go away)

Just because a seller doesn't have a pile of negative feedback doesn't mean he isn't a deadbeat seller. For whatever reason, most buyers have decided they will only leave a neg if the transaction goes horribly wrong. Seller know that as long as they have a good return policy they can avoid negs.

IMO it's the biggest challenge with Ebay, feedback is not accurate, everyone is 99.9% positive which is not possible of course in any other merchant environment.

Agreed, I'd go ahead and open a case and mark it as "not as described". Keep us posted on the results.

So I emailed the seller again today and he got back to me right away. Here is the reply

"I don't open packs and take cards out .Im not educated on the starting line up sealed packs so I don't know if the Tony Gwynn card was suppose to be in there if I had one I would give it to you.The pack I shipped was sealed because I listed it and shipped it out myself.I wrapped the pack in bubble wrap.I don't know if when you opened bubble wrap around pack it ripped open the pack .To show you I'm a honest guy even thou I'm insulted to be accused of stealing I'm just going to refund your money." So I'm going to get my money. I love how he is insulted to be accused of stealing. I never accused him of stealing. All I said was the pack was not sealed and cards were missing. I asked if he had another Gwynn which was one of the missing cards.

ebay will remove negative feedback if a seller rips you off but you get refunded. Its entirely possible he has had more negative feedback that was later removed.
